RE: DEMAND TO VACATE

Dear Mr. and Mrs. Ardimer:

Our Client Juan Dela Cruz, the owner of the parcel of land covered by Transfer
Certificate of Title No. 12345. Our Client has retained the service of the undersigned counsel to
notify you that he had already terminated his tolerance of your possession of the portion of the
land covered by Transfer Certificate of Title No. 12345 located at Pantukan, Davao de Oro.

You are well aware that there is no deed or contract or otherwise between you and our
Client. At most, your possession of the land is only by virtue of the tolerance of our Client.
Therefore, you need to vacate from portion of parcel of land owned by our client’s because he
will be using the portion you are occupying. At most, your possession of the land is only by
virtue of the tolerance of our client.

This Demand is thus given to you as a formal DEMAND that you VACATE the lot
owned by our Client that you are occupying WITHIN FIFTEEN (15) DAYS FROM RECEIPT
OF THIS LETTER otherwise we will be constrained to seek court processes to eject you from
the said land. In this eventuality, all expenses relative to this case, including but not limited to the
reasonable rentals, damages and attorney’s fee will be added to your accountabilities.

We are anticipating your immediate action on this matter.
