Legal Bases of Special and Inclusive

Education
The 1987 Phil. Constitution, Article XIV, Section 1 and 2

“Education is the most powerful weapon to change the world” it is according to Nelson Mandela.
It is the key to reduce discrimination and to avoid poverty. Education is very important because
it is the key or our bright future, it is the way to achieve our goal, and it is the only way to
become what we wanted in future.
Everybody deserves an education even you’re a poor or rich citizen, even you’re an adult and
even you have disabilities.

What is Inclusive Education?

It is the place or environment were a student with or without disabilities a taught together as
equal. In the Philippines our country an inclusive education is for the person with the disabilities,
indigenous peoples, street children’s, abuse children’s, child laborers and the Muslim children
that means no learner shall be denied admission based on their disability.

We have articles for student for them to have free education.

According to the 1987 constitution of the republic of the Philippines article 14 section 1 that The
State shall protect and promote the right of all citizens to quality education at all levels. Not just
in elementary, high school and college but all level
It is the most powerful article because it is already approved by the constitution so this wont be
deleted as a article of the Philippines
and shall take appropriate steps to make such education accessible to all. That means that all
people deserve and must have access in education. and having the right education is from the
basic human rights and all children and youth must access in quality of education for their better
future and, by giving the right education for the children can make them develop their skills and
talents.
All children especially those really in need must have an access in free education and for those
students that have academic award and doesn’t have enough money to educate their own they
must be getting a support in the government that can help them to have scholarship to support
them.
According to the 1987 constitution of the republic of the Philippines article 14 section 2:
The state shall: (1) Establish, maintain, and support a complete, adequate, and integrated
system of education relevant to the needs of the people and society. When we say integrated it
is connected and must be in a one barangay or a city is having elementary, highs school and
college level that makes the school called integrated.
(2) Establish and maintain a system of free public education in the elementary and high school
levels. Without limiting the natural right of parents to rear their children, elementary education is
compulsory for all children of school age. The public school in elementary and high school must
be free for the student to learn and to study, it will be a big help for the family of the student
make their children learn for free. All students must learn in elementary before they are going to
high school.
(3) Establish and maintain a system of scholarship grants, student loan programs, subsidies,
and other incentives which shall be available to deserving students in both public and private
schools, especially to the underprivileged. The states giving a free scholarship for the student
who really deserving to have it but this Is also limited so if a student is have a better grades and
they working really hard for their studies, they able to ask for scholarship even you’re in a
student in private of public school.
(4) Encourage non-formal, informal, and indigenous learning systems, as well as self-learning,
independent, and out-of-school study programs particularly those that respond to community
needs. When we non-formal it is the education that you don’t need to go to school Monday to
Friday but for the formal education, a good example of this is like what we used to do when we
were going to school before the pandemic before, because we are going to school Monday to
Friday. And for the indigenous people because they have their own language but of course they
also deserve to learn something.
(5) Provide adult citizens, the disabled, and out-of-school youth with training in civics, vocational
efficiency, and other skills. Even a student didn’t finish his schools before he also has an
opportunity to lean and develop his/her skills. The schools that accepting student that didn’t
finish their education before is TESDA and ALS.

Not all family can afford to make their child go to school every Monday to Friday, so this article
was very helpful for all the Filipino citizen to avoid the poverty of the country. because education
is our guide to become successful someday, this article is very useful to provide the needs of
the student by giving them free education especially for those have a disabilities and having
financial problems also those indigenous people, all citizen deserves an education so develop
their skills and their talent in school.
