ORDER FINDING PROBABLE CAUSE Based on the preliminary investigation of the complaint, the Commission on Ethics departs from the amended recommendation of the Commission's Advocate and finds that there is probable cause to believe the Respondent, who serves as the Sheriff of Broward County, violated Section 112.313(6), Florida Statutes, by using his position to secure a benefit, privilege, or exemption for himself.! Therefore, the Commission on Ethics orders a public hearing as to whether the Respondent violated Section 112.313(6), Florida Statutes, as set forth in the paragraph above, A formal notice of hearing of the matters on which probable cause has been found will be prepared and sent to the Respondent and to the Advocate. ' This probable cause finding concems three allegations: (1) that during the appointment process for service as Broward County Sheriff, the Respondent provided false information and/or did not disclose information concerning his drug use history and an arrest for murder; (2) that while serving as Broward County Sheriff, the Respondent completed and notarized a certification form—namely a Criminal Justice Standards and Training Commission Form 68 submitted to FDLE—falsely indicating he had never had a criminal record sealed or expunged; and (3) that while serving as a law enforcement officer, the Respondent applied to renew his driver's license in February 2019, and false indicated in the application that this driving privileges had never been revoked, suspended, or denied in any state. Under Commission Rule 34-5.020, F.A.C., the Commission may resolve a complaint proceeding through a stipulation, settlement, or consent order entered into by the Respondent and the Commission's Advocate and approved by the Commission. If the Respondent wishes to pursue a settlement of this case, she should contact the Commission's Advocate at (850) 414- 3300 to discuss the terms of a possible settlement.
