JUDICIAL AFFIDAVIT
I, DENIS A. ANTONIO of legal age, married and a resident of Brgy.
Rebecca, Gonzaga, Cagayan, after having been sworn to in accordance with the
law do hereby depose and state that:
PRELIMINARY STATEMENT
The person interviewing me is Atty. Ramses S. Peralta, with office address
located at G/F Balay Bisita 2, Smart, Gonzaga, Cagayan. The examination is being
held at the same address. I am answering these questions voluntarily, to the best of
my knowledge and fully conscious that I do so under oath and may face criminal
liability for false testimony and perjury.
QUESTIONS AND ANSWERS
Q1: Why are you here in our Office?
A1: I am here to give my testimony to the case that I will file, Sir.
Q2: And what case is that in particular?
A2: A case which seeks to nullify my marriage with Susan Guillermo
Antonio, sir.
Q3: Can you relay to me more details about your marriage with Susan?
A3: We got married on December 16, 2013 in a civil wedding at the
Office of the Mayor in Tuao, Cagayan, sir.
Q4: Do you have any proof that you indeed celebrated marriage?
A4: Yes, Sir. I have here our marriage certificate.

Q5: Did your marriage bear any child?
A5: We do not have any child, Sir.
Q6: Do have any property of value that you and Susan acquired during
your marriage, if any?
A6: As far as I know, we did not acquire any property of value, Sir.
Q7: Can you relay to me how you and Susan first met?
A7: We met in my sister’s boarding house where she was also living that
time, sir. There were many occasions that it was only the two of us
who were left alone in the boarding house. We became friends, and
this friendship blossomed into friendship after some time. Although
we did not go out for dates, we enjoyed cooking and eating together in
the boarding house, sir.
Q8: Can you describe how Susan was when she became your girlfriend?
A8: It was well in the start. She was a sweet girlfriend, however I had to
leave her for work. I am a seafarer, so we needed to have a long
distance relationship.
Q9: What happened during your first long distance relationship as
boyfriend and girlfriend?
A9: We were able to survive long distance relationship sir, when I went
back, we got married in a civil wedding.
Q10: After marriage, did you live together, where?
A10: Yes sir, we went back to her hometown, and lived there. However, I
had to leave again for work so, after some months of living together,
we had to live away from each other.
Q11: Can you describe the long distance relationship as husband and wife?
A11: When I was away, Susan would seldomly talk to me. There were
times that I had to call her parents to let her know I wanted to talk to
her. It was during that time that she was also chatting with another
guy, and it blossomed to an illicit affair.
Q12: How did you find out about the illicit affair during your marriage?
A12: I was on a vacation then, sir. We had this argument about finances
because Susan can not account where did my money go. I found out
she was talking over the phone with another guy, she confessed that
they have a relationship. In fact, the guy is also married, his wife filed
a complaint against her husband and my wife in the barangay.
Q13: What did you do when you found out about this?
A13: I said I wanted a separation sir, however, Susan pleaded and promised
not to be involved with the guy again. Before I went back to work, we
reconciled, sir.
Q14: When you went back to work, how was your relationship with Susan?
A14: When I was at work, we tried to mend the relationship sir. However,
there was this one time, we had disagreement again because she does
not want me to send money to my parents, and support my nephews
and nieces.
Q15: What else caused conflict between you and Susan while you were
away?
A15: Susan accused me of having an affair with another woman, sir.
However, this was a pure allegation.
Q16: What happened after those conflicts?
A16: I went home, sir for a vacation. I found out that Susan was still in
relationship with her ex-boyfriend.
Q17: What happened next, if any?
A17: We separated, sir. And Susan is now living with this guy, they
produced one child.
Q18: And what did you do when this happened, if any?
A18: I decided to move on with my life, sir, without her in the picture.
Since she is also living her own life now. There is no way our
marriage could be saved anymore, sir.
Q19: Did you consult any person concerning your marital situation?
A19: I consulted Dr. Evangeline E. Fajardo who is a psychiatrist.
According to her, both Susan and I are psychologically incapacitated
to comply with our marital obligations.
Q20: With what you went through, what can you say about your
relationship with Susan?
A20: I have lost every hope that anything good will happen to our
relationship. I felt trapped in an unhappy relationship. I cannot
continue living with a person whose behavior was soley for his own
selfish interest, with no intent to create and maintain a cohesive and
harmonious family. Hence, I filed this petition for the declaration of
nullity of our marriage to put an end into the cycle of emotional
turmoil I am experiencing.
Q21: I have no more questions to ask from you. Are you willing to sign this
Judicial Affidavit under oath?
A21: Yes, Sir.
