Employees’ Pension Scheme, 1995 (EPS-95) and availability of option for
contribution to EPS-95 on actual salary for pension – Reg.

Sir,

Attention is invited to the Circular No.EP-08-2023-04 dated 27.01.2023 and


subsequent directions issued on the subject vide which all the administrative
offices of FCI were conveyed instructions on the subject.

As per Supreme court judgement dated 04.11.2022, the entire process


regarding exercise of joint option by the eligible employees/ ex-employees
shall be completed with in four months from the date of judgement.

Various references have been received by field office whereby adherence of


timeline for submission of joint option along with calculation of payable
amount within prescribed time given by the Hon’ble supreme court i.e.
03.03.2023 may not be possible.

Also as per EPFO Circular dated 20.02.2023,point no. 6(vi) " The method of
deposit and that of calculation of Pension will follow through subsequent
circular."

In this regard, the following directions are issued as per approval of the
Competent Authority :
1. One copy of the Joint Option forms received from members may be forwarded by respective
FCI Units to concerned CPF Division of Zones/ HQ. as applicable without computation i.e.
Annexure III.
2. CPF Division shall forward these applications to respective RPFCs along with Trustee
Undertaking for further action.
3. Unit offices are also directed to complete the work of Annexure III simultaneously and submit

the complete set as per EP division circular dated 27.01.2023 to concerned CPF division at the
earliest.
4. All members are advised, online application of higher pension may be done on EPFO portal
without fail as well, as per EPFO guidelines and as also informed in FAQ. Unit office shall
aware the members to submit online application also.
5. CPF Section shall monitor & ensure the completion of higher pension work as per the
guidelines issued time to time & coordinate with local RPFCs in the matter.

All the members and nodal officers are advised to regularly visit EPFO
website for updates and necessary action.
