Position Paper: Legalization of Divorce in the Philippines

The Philippines is one of the only two countries that has not legalized divorce, and other
is Vatican City. As stated by Oxford Languages, divorce is to dissolve a marriage by a court.
There are many reasons why marriages lead to separation. It can be because they drifted apart,
third-party or infidelity, or domestic violence, other reasons. These reasons are enough for
divorce to be legal.
Even without divorce, families still separate, but some remain to be married but without
living with each other. Some may say that divorce is not needed due to annulment. However, its
due process is much complicated than divorce. It only qualifies if one is unable to consummate,
has psychological incapacities, if the other's consent to the marriage was a fraud or forced, or if
someone has a sexually transmitted disease. Annulment is also expensive and is very time-
consuming. Unhappy couples should have access to the more straightforward dissolution of
marriage.
Christians mostly populate the involved country. Therefore, they 7hold deep biblical
beliefs. They believe in the sanctity of marriage, and the commitment to the vows said in
marriages. The catholic church is very vocal in its protest, especially on the death penalty,
abortion, and divorce. The Catholic Bishops' Conference of the Philippines (CBCP) defined
divorce as a "grave offense" as it breaks the "contract performed in the front of God." However,
as stated in Article III (The Bill of Rights), Section 5 of the 1987 Constitution, the state and
church should be separated. In a nutshell, laws should be passed with no regard to religions. This
article recognizes that though most inhabitants are Christians but not all. Laws should be passed
for all Filipinos and must not be inconvenient for some who are not Christians.
As said above, marriage should be about two people's legal bond because of love.
However, as children come into the picture, it becomes one of the reasons why some people do
not accept divorce. Parental separation may take a negative impact on the children's
psychological health. However, parents who are constantly fighting also take a toll on the child's
mental health. A hostile environment is not healthy. Therefore, divorce might be a better option
to take. The parent's love for each other does not equate to less love given to children. The two
can still practice co-parenting to ensure that the children are still regarded and given the family
they deserve.
The Philippines should have a divorce. Divorce is cheaper and more convenient for
people who cannot stay married to each other. The Philippines, as a Christian country, should not
hold the rights of all Filipinos who do not hold the same beliefs to be compromised. Children and
partners who are experiencing abuse and living in an unhealthy environment should find a way
out of it. Filipinos who are not as financially prepared for an annulment should still find a way to
be out of the marriage.
