The Learned Counsel appearing for the Karnataka Lake
Development Authority of Bangaluru submits that
Bellandur Lake was part of the scheme, National Lake
Conservation Programme since 2000. It is also conceded
that the Bellandur lake was rejuvenated in 2002-03,
thereafter, no steps have been taken for rejuvenation till
date.
We are really surprised at the apathy that is
prevailing in the functioning of all the statutory bodies as
well as the State Government. It is conceded before us
that the fire that took place on the bank of the lake and
the lake was result of burning of green waste, methane,
municipal solid waste including plastic. It is also stated
that even as of now large quantity of untreated sewage is
being put into the lake and the chemicals that come from
the industries. Besides the contents of our order dated
20th February, 2017, we also issue show cause Notice to
all the authorities including the newly added Respondents

06 as to why we should not direct their prosecutions under

the Environment (Protection) Act, 1986 as well as payment

of environmental compensation in terms of Section 15 and
17 of the National Green Tribunal Act, 2010 as well as the
directions that should be passed for rejuvenation and
restoration of the Bellandur lake to its original pristine.
They shall also show cause as to the steps they have
taken in furtherance to the directions contained in the
Judgment of the Tribunal dated 4th May, 2016, reasons for
non-compliance thereof, if any. Let this Affidavit be filed
positively within two weeks from today with advance copy
to all the Learned Counsel appearing in this case. Central
Pollution Control Board shall also file the detailed Affidavit
within the period of two weeks.
List this matter on 20th March, 2017.

This Application is filed in Court. The same is taken
on record. Be registered and numbered as per rule. We
have heard the Learned Counsel appearing for the parties
without prejudice to the rights and contentions of all the
authorities and Respondents in the present case. The
Applicants are permitted to be impleaded as interveners.
They would only have the liberty to address the Tribunal,
if they wish to file any Affidavit, they should file it within
three days from today with advance copy to the State so
that that they are able to meet the issues made by them in
their respective Affidavits. Copies could be served at the
Learned Counsel at New Delhi or even at the Department
at Bangaluru.
