A RESOLUTION ADOPTING THE ORDINANCE 669 OF THE CITY GOVERNMENT OF
MALAYBALAY, AN ORDINANCE REQUIRING THE SEGREGATION AT THE SOURCE
OF ALL HOUSEHOLD, INSTITUTIONAL, INDUSTRIAL AND COMMERCIAL WASTE
AND/OR GARBAGE INTO COMPOSTABLE, RECYCLABLES, RESIDUAL AND
SPECIAL/ HAZARDOUS WASTE PURSUANT TO REPUBLIC ACT 9003.
WHEREAS, Republic Act 9003 otherwise known as the Ecological Solid Waste Management
Act provides for an Ecological Solid Waste program creates the necessary institutional
mechanism and incentives declares certain acts that are prohibited provides penalties and
appropriates fund for its implementation;
WHEREAS, section 10 of the said act specifically refers to relevant provisions of R.A. 7160
which states the LGUs are primarily responsible for the implementation and enforcement of this
Act within their territorial jurisdictions;
WHEREAS, section 21 of R.A. 9003 has likewise provided the “xxx LGUs shall evaluate
alternative roles for the public and private sectors in providing collection services, type of
collection system or combination of systems that best meet their needs provided that the
segregation of waste shall be primarily conducted at the source xxx and Section 22 of the same
Act called for the standards and requirements for the segregation and storage of solid waste;
WHEREAS, the Department of Environment and Natural Resources being the lead National
Agency tasked to monitor the compliance of LGUs with Law within this year and penalize LGU
who are non-compliant of this Act, thus this Ordinance.

Be it ordained by the Sangguniang Barangay that:
SECTION 1. The Barangay Government of Barangay 9 hereby requires the segregation
at source of all household, institutional, industrial and commercial waste and/or garbage into
compostable recyclable, residual and special/hazardous wastes pursuant to Republic Act 9003.
SECTION 2. For purposes of this Ordinance, the following terms are hereby defined as
follows:
a. SOLID WASTE shall refer to all discarded household commercial waste, non-hazardous
institutional and industrial waste, street sweepings, construction/non-toxic waste.
b. ECOLOGICAL SOLID WASTE MANAGEMENT shall refer to the systematic
administration of activities which provides for segregation at source, segregated,
transportation, storage, transfer, processing, treatment and disposal of solid waste.
c. SEGREGATION shall refer to sorting and segregation of different solid waste materials
in order to promote recycling and re-use of resources and to reduce the volume of wastes
for collection and disposal.
d. SEGREGATION AT SOURCE shall refer to a solid waste management practice of
separating at the point of origin such as commercial, industrial, domestic and institutional
source.
e. RECYCLABLE MATERIALS shall refer to any waste materials retrieved from the waste
stream and free from contamination that can still be converted into suitable beneficial use
for other purposes including newspapers, ferrous scrap metal non-ferrous scrap metal,
corrugated cardboards, aluminium, office paper, tin cans and other recyclable materials.
f. BIODEGRADABLES shall refer to waste materials that are compostable.
g. RESIDUAL WASTE shall refer to non-recyclable and non-biodegradable solid waste
materials such as foils, rubber, worn-out clothes, etc.
h. SPECIAL/HAZARDOUS WASTE shall refer to the toxic, infectious and poisonous solid
waste materials.
i. RECEPTACLES shall refer to individual containers used for the source separation and
the collection of recyclable materials.
j. MATERIALS RECOVERY FACILITY (MRF) shall include solid waste transfer station
or sorting station, drop off center, a composting and recycling facility.
k. STORAGE shall refer to the interim containment of solid waste materials after generation
and prior to collection for ultimate recovery or disposal.
l. COLLECTION shall refer to the act of removing, solid waste materials from the source
or from a communal storage point.
m. CITATION TICKET OR NOTICE OF VIOLATION shall refer to a written document
citing the offender/violators of his/her violations pursuant to the provisions of this
ordinance.
n. DISPOSAL SITE shall refer to a site where solid waste materials are finally discharged.
o. INSTITUTIONS shall refer to hospitals, clinics, funeral parlors, schools, churches,
public/private offices and the likes.
p. INDUSTRIAL ESTABLISHMENTS shall refer to agri-industrial businesses, plants,
mills and the likes.
q. COMMERCIAL ESTABLISHMENTS shall refer to hotels, resorts, recreational centers,
restaurants, cinema houses, public markets, department stores, groceries, sari-sari stores,
stalls, shops, vendors, parlors and the likes.
r. SMALL BUSINESS ESTABLISHMENT shall refer to all business with annual gross
income of two million Nine Hundred Ninety Nine Thousand Nine hundred Ninety Nine
Pesos (P2, 999,999.00) and below.
s. BIG BUSINESS AND COMMERCIAL ESTABLISHMENTS shall refer to all business
with annual gross income of Three Million pesos (P3, 000,000.00) and above.
SECTION 3. Storage. Collection and Transportation, Segregation at source must be properly
observed. Solid Waste shall be classified as compostable materials, recyclable
materials,residualwaste and waste brought out for collection which is not scheduled for the
particular day shall not be collected and the household owners and the entities of the this
Ordinance. Only residuals and special/hazardous waste (expert for hospital, funeral and
pharmaceutical wastes) shall be collected by the city on different schedule and shall be properly
disposed of collection or pick up pinots and transportation schedule shall be decided by the city
environment and natural resources office and must be widely disseminated.
Section 3.1, Residential/Areas
a. Residents must segregate their generated solid waste by providing separate receptacles
for every kind of waste and shall be brought out of the household vicinity only during the
scheduled time and day of collection.
b. Every household shall provide a compost pit for disposal of compostable wastes.Incase
where no space is available, the household shall provide covered container, collection of
which shall be done a week after paying a garbage collection fee as provided in this
ordinance.
c. Special/hazardous waste must be stored and sealed properly in a marked container/bag
before it shall be collected and disposed accordingly.
d. It shall be the responsibility of the indivual household to dispose all recyclables either
through the recyclable buyer, or to the City/Barangay Materials Recovery Facility.
SECTION 3.2 Commercial Establishment
a. Owners and/or lessees of all commercial establishments shall provide separate storage,
receptacle for segregated wastes and shall be kept in the premises of the establishment
until the scheduled collection time and day.
b. The use of biodegradable wrappers or bags (Paper Based) must be encouraged and
maximized
c. The lobby and immediate grounds of the establishment must be clean and orderly at all
times.
d. It shall be the responsibility of the owner/occupant to dispose all recyclable either
through the recyclable buyer or to the City/Barangay Materials Recovery Facility.
e. Composting materials shall be collected and disposed into the city composting facility.
SECTION 3.3 Institutional/Industrial Establishment
a. Industrial establishment must maintain their respective proper disposal site in conformity
with applicable policies of the DENR and provisions of RA 9003 and shall be responsible
in the safe storage disposal, transportation of wastes resulting from its operation.
b. No transport companies or individual entrepreneur shall be allowed to transfer or
transport toxic waste like plastic materials and chemicals, unless authorized and
accredited by the fertilizer and pesticide authority (FPA) and other agencies tasked for its
regulation.
c. Waste from hospitals, clinics, funeral parlor,pharmaceutical and establishment with
related operation that are non-hazardous will be collected and disposed during the
scheduled time and day of collection, while special/hazardous wastes must be properly
handled and sealed before it shall be transported and/or disposed by said establishment.
d. School, churches, public/private offices shall provide separate storage receptacles for
segregated wastes and shall be kept in the premises of the establishment until the
scheduled collection time and day.
SECTION 4. Fine and Penalties. Any household, business or commercial establishment.
Institution and industrial and manufacturing plants that will be found or apprehended not
complying with ordinance shall be issued a CITATION TICKET or NOTICE OF VIOLATION
and shall be penalized with the corresponding fines.
1. Big business and commercial establishment
Industrial and manufacturing plants. - 2, 000.00
2. Small business establishment - 1, 000.00
3. 1st offence-residential - 500.00
4. 2nd offence and succeeding offenses-residential - 1000.00
SECTION 5. REPARABILITY clause. If this ordinance or any provision of this ordinance shall
be declared unconstitutional or invalid, other parts provisions hereof which are not affected
thereby shall continue to be in full force and effect.
SECTION 6. Repealing clause. All local ordinance, executive order and administrative
regulations, or part of parts therefor which are inconsistent with any of the provision of this
ordinance are hereby repealed or modified accordingly.
SECTION 7. Effectively. This ordinance shall take effect after its publication once in a
newspaper of local circulation and posting for three (3) consecutive weeks in conspicuous places
of barangay 09Malaybalay city.
