COMPLAINT AGAINST LILONGWE AND BLANTYRE DISTRICT COUNCILS AND


BLANTYRE, LILONGWE AND MZUZU CITY ASSEMBLIES

The Eye of the Child writes to complain on behalf of the Children of Malawi against the
Lilongwe District Council, Blantyre District Council and Blantyre, Lilongwe and Mzuzu City
Assemblies for neglecting children living or working on the streets.

It is Eye of the Child prayer that the Office of Ombudsman should charge the District
Commissioner for Lilongwe District Council, the District Commissioner for Blantyre District
Council and the Chief Executive for Blantyre City Assembly, the Chief Executive for Lilongwe
City Assembly and the Chief Executive for Mzuzu City Assemblies with a case of neglect and
act of bias in discharging duties, violation of section 23 of the Malawi Constitution and section
70 of the Child, Care, Protection and Justice Act (2010).

As mandated by the Child Care, Protection and Justice Act (2010), section 70, the District
Commissioner for Lilongwe District Council, the District Commissioner for Blantyre District
Council and the Chief Executive for Blantyre City Assembly, the Chief Executive for Lilongwe
City Assembly and the Chief Executive for Mzuzu City Assembly have been neglecting children
living or working on the streets and therefore violating section 23 of the Constitution as amended
in the year 2010 that demand the said officials to be acting in the best of the children in need of
care and protection.

Eye of the Child therefore resolve to complain to the Office of the Ombudsman to take
immediate action against the said institutions for neglecting children living or working on the

street and for not acting in the best interest of the child as mandated under section 23 of the
Constitution and section 70 of the Child Care, Protection and Justice Act (2010).

Eye of the Child wish to demand further that upon being found responsible, the Office of the
Ombudsman should order the District Commissioner for Lilongwe District Council, the District
Commissioner for Blantyre District Council and the Chief Executive for Blantyre City
Assembly, the Chief Executive for Lilongwe City Assembly and the Chief Executive for Mzuzu
City Assemblies to:-

1. Remove all children living or working on the streets and conduct night patrol to identify
and remove all children who are forced or engaged in prostitution within a period of 21
days and present a report to the Office of the Ombudsman within 30 Days of the order.
2. Develop and present plans to the Office of the Ombudsman for prevention of children
living or working on the street within the period of three months.
3. Allocate adequate resource and finance the implementation of the plans and present
reports to office of the Ombudsman every six months for the period of three years.

acting in the best interest of the children living or working on the street.
