I, Hanumanthu Raghunandan S/o. Sri H. V. Ramana Rao, aged about 46 years,
Occ: Pvt Employee, R/o Flat No. 302, Vijayasri Apartments, Rajeev Nagar,
Yousufguda, Hyderabad, do hereby solemnly affirm and state on oath as follows:
1. I am the Petitioner herein and Plaintiff in the suit, as such I am well aware of the
facts of the case as stated hereunder. I filed the above suit inter alia for a
declaration of the cancellation of General Power of Attorney vide document no.
106/1996, dt. 06.06.1996, unilaterally, to be null and void.
2. It is submitted that the present application is being filed under Section 148 read
with Section 151 of the Code of Civil Procedure, 1908 seeking to condone the
delay of ____ days in resubmission of the Petition filed under Order VI Rule 17
read with Section 151 of Code of Civil Procedure Code, 1908 for amendment of
plaint bearing SR No. 5605 of 2018.
3. It is submitted that, the Petition for amendment of Plaint was filed before this
Hon’ble Court along with another Petition filed under Order 1 Rule 10 seeking
impleadment of Defendant No. 15-19 in the Plaint.
4. It is submitted that, we were under the impression that the Petition for amendment
of Plaint will be taken up after the adjudication of the Implead Petition. It is
submitted that, when the Counsel for Petitioner/Plaintiff enquired in the Section
office with respect to the Petition for amendment of Plaint, the Counsel for
Petitioner/Plaintiff gained knowledge that the said petition has been returned with
an endorsement “There is no proper cause title in this Petition. Hence returned”.
5. It is submitted that, the IA filed under Order VI Rule 17 for amendment of Plaint
was returned on 22.01.2019. However, the same was not informed to us and the
returned Petition was put in the back record of the Court file.
6. It is submitted that the Petitioner/Plaintiff was never aware of the Petition being
returned. It is pertinent to note that the Implead Petition was duly allowed by this
Hon’ble Court on 06.03.2023 and when the Counsel for the Petitioner/Plaintiff
checked the back record of the Court file, only then we were informed that the
Petition filed for Amendment of Plaint has been returned.
7. It is submitted that the Petition for amendment of Plaint is being resubmitted along
with the fair copy of the Petition with the objections duly complied with.
8. It is submitted that, when the Petition for amendment of Plaint was filed there were
14 Defendants in the suit and now, since the implead petition has been allowed by
this Hon’ble Court, there are 19 Defendants in the suit. It is submitted that the fair
copy of the Petition includes the impleaded parties to the suit.
9. It is submitted that the non-compliance of the objections of the Petition is neither
willful nor wanton. Therefore the present petition is being filed seeking a relief to
condone a delay of ____ days in resubmitting the Petition for amendment of Plaint,
failing which the Petitioner/Plaintiff will suffer irreparable loss and injury, which
cannot be compensated at a later stage.
10. It is submitted that in the circumstances stated above, the Petitioner is constrained
to file this application for condoning the delay of ___ days in resubmitting the
Petition filed for amendment of Plaint.
It is therefore prayed that this Hon’ble Court may be pleased to condone a delay of
___ days in resubmission and pass such other order or orders as it may deem fit and
proper in the facts and circumstance of the case.
