Chain of ownership of the Scheduled Property:

In respect of Schedule-A
It appears that, one Karam Ali, son of late Akram Ullah were the owner of the property
through inheritance and got recorded his name in R.S. Khatian No. 54 pertaining to Plot
No. 415, being the owner of the property, sold the land vide Sale Deed No. 2024
registered on 04.04.1985 in the Sub-Registrar’s Office- Baidyer Bazar, Narayanganj in
favor of Mohammad Murtaza, son of late Mohd. Yasin.

On the other hand, the aforesaid Karam Ali, being the owner, died leaving his son namely
Mohd. Mofazzal Hossain.

Afterwards, the aforesaid Mohd. Mofazzal Hossain, being the owner, sold the land
measuring 25 decimal vide a Sale Deed No. 2178 registered on 13.04.1985 in the Sub-
Registrar’s Office- Baidyer Bazar, Narayanganj in favor of Mohammad Murtaza, son of
late Mohd. Yasin.

Thereafter, the aforesaid Mohd. Mofazzal Hossain, being the owner, sold the land
measuring 30 decimal vide a Sale Deed No. 2376 registered on 22.04.1986 in the Sub-
Registrar’s Office- Baidyer Bazar, Narayanganj in favor of Mohammad Murtaza, son of
late Mohd. Yasin.

Afterwards, the aforesaid Mohd. Mofazzal Hossain, being the owner, sold the land
measuring 20 decimal vide a Sale Deed No. 2272 registered on 18.04.1985 in the Sub-
Registrar’s Office- Baidyer Bazar, Narayanganj in favor of Mohammad Murtaza, son of
late Mohd. Yasin.

Thereafter, the aforesaid Mohammad Murtaza, son of late Mohd. Yasin, being the owner,
sold the land vide a Sale Deed No. 5152 registered on 03.09.1994 in the Sub-Registrar’s
Office- Baidyer Bazar, Narayanganj in favor of Mortgagor-Borrower Tricepack Limited.
In respect of Schedule-B
It appears that, one Jahurul Haq, son of late Akram Ali Munshi were the owner of the
property through inheritance and got recorded his name in R.S. Khatian No. 89, 90
pertaining to Plot No. 420, 421, being the owner of the property, sold the land vide Sale
Deed No. 3492 registered on 13.06.1985 in the Sub-Registrar’s Office- Baidyer Bazar,
Narayanganj in favor of Mohammad Murtaza, son of late Mohd. Yasin.

On the other hand, one Ramijuddin, son of Alim Prodhan were the recorded owner of the
property in R.S. Khatian No. 139 pertaining to Plot No. 419, being the owner of the
property, died leaving his sons namely (1) Mohd. Afajuddin, (2) Mohd. Nowsher Ali, (3)
Mohd. Khorshed Ali alia Nur Ali.

Afterwards, the aforesaid (1) Mohd. Afajuddin, (2) Mohd. Nowsher Ali, (3) Mohd.
Khorshed Ali alia Nur Ali, being the owners, sold the land measuring 30 decimal vide a
Sale Deed No. 2377 registered on 22.04.1986 in the Sub-Registrar’s Office- Baidyer
Bazar, Narayanganj in favor of Mohammad Murtaza, son of late Mohd. Yasin.

Thereafter, the aforesaid Mohammad Murtaza, son of late Mohd. Yasin., being the
owner, sold the land vide a Sale Deed No. 5152 registered on 03.09.1994 in the Sub-
Registrar’s Office- Baidyer Bazar, Narayanganj in favor of Mortgagor-Borrower
Tricepack Limited.

In respect of Schedule-C
It appears that, one Jahurul Haq, son of late Akram Ali Munshi were the owner of the
property through inheritance and got recorded his name in R.S. Khatian No. 89, 90
pertaining to Plot No. 420, 421, being the owner of the property, sold the land measuring
21 vide Sale Deed No. 6558 registered on 02.12.1986 in the Sub-Registrar’s Office-
Baidyer Bazar, Narayanganj in favor of Mohammad Murtaza, son of late Mohd. Yasin.

Thereafter, the aforesaid Mohammad Murtaza, son of late Mohd. Yasin., being the
owner, sold the land vide a Sale Deed No. 5152 registered on 03.09.1994 in the Sub-
Registrar’s Office- Baidyer Bazar, Narayanganj in favor of Mortgagor-Borrower
Tricepack Limited.

Finally, being owner of the Scheduled Property the aforesaid Mortgagor-Borrower


Tricepack Limited mutated the scheduled land measuring 2.12 acre of Plot Nos. (1) 415
(54 decimal), (2) 418 (30 decimal), (3) 420 (27 decimal), (4) 417 (30 decimal), (5) 419
(30 decimal), (6) 421(21 decimal), along with other plots in its name with the Assistant
Commissioner (Land) through Mutation & Separation Case No. 7,180(09)/2019-20 dated
24.11.2020 under Mutation Khatian No. 914 and regularly paying the ground rent to the
Government authority under Jote No. 91.
In respect of Title Deed No. 12396 registered on 23.12.2018:

It appears that, Tonur Uddin was the S.A & R.S recorded owner of the scheduled
property. Being the sole owner said Tonur Uddin executed a Heba Deed in favour of his
daughters namely Nur Vanu, Ful Vanu, Lal Vanu, Sona Vanu, Maleka Vanu and Rup
Vanu vide Heba Deed No 6818 registered on 30.11.1994.

Then, said Nur Vanu, Ful Vanu, Lal Vanu, Sona Vanu, Maleka Vanu and Rup Vanu
being the owner by the Heba Deed became the owner and took the possession and were
in peaceful possession.

Thereafter, said Ful Vanu being the owner by way of Heba Deed executed a Heba Deed
in favour of Sona Vanu vide Heba Deed No. 1470 registered on 05.03.2003.

Moreover, said Sona Vanu also became the owner of a portion of property by way of Bel-
E –Was Heba Deed from her mother vide Heba Deed No. 411 registered on 23.01.2003.

Affterward, said Malek Vanu being the owner a portion of property by the Heba Deed No
6818 registered on 30.11.1994 executed a Power in favour of Sona Vanu vide Power of
Attorney Deed No. 2337 registered on 22.04.2003.

Thereafter, said Sona Vanu being the owner of a portion of land from the scheduled
property by way of Heba Deed and Power of Attorney sold to Ziaur Rahman son of Md.
Shamsur Rahman and Shahanur Begum vide Sale Deed No. 4447 registered on
20.07.2003.
It appears that, one Kangali Mondol being the owner recorded his name in the C.S
Khatian No. 146 Pertaining to Plot No. 2065

Afterward, said Kangali Mondol died leaving behind his successors namely Sree
Prosonno Kumar Nomdas and Sree Hori Kumar Nomdas who took the possession ad
were in peaceful possession.
Thereafter, said Sree Prosonno Kumar Nomdas and Sree Hori Kumar Nomdas being the
need of money sold their property to Mofez Uddin vide Sale Deed No. 485 registered on
16.01.1926.
Then, said Mofez Uddin being the owner by way of purchase took the possession and
recored his name in the S.A Khatian No. 389 and R.S Khatian No. 765.

Thereafter, said Mofez Uddin died leaving behind his successors namely Sabed Ali, Amir
Ali, Ayesha and his wife.

Moreover, one Lalito Mohon Bormon was the C.S recorded owner of part of land from
the scheduled property who sold his property to Sabed Ali and Amir Ali vide Sale Deed
No. 1470 registered on 26.03.1963.

Thereafter, said Sabed Ali, Amir Ali became the owner of the scheldued property and
recorded their name in the R.S Khatian No.714.

Afterward, said Sabed Ali died leaving behind his successors- wife, 5 son and 4 daughter
who took the possession and were in peaceful possession.

Moreover, said Amir Ali died leaving behind his successors- wife, 4 daughters and 2 son
who took the possession and were in peaceful possession.

Afterward, being the owners by way of inheritance successors of said Sabed Ali and
Amir Ali executed an oral partition agreement to exchange the possession. By the said
oral partition agreement Abdus Sattar, Abul Kashem, Abdul Barek, Abdul Kader and Md
Nomej became the owner of a part of the land of the schedule.

Then, said Abdus Sattar, Abul Kashem, Abdul Barek, Abdul Kader and Md Nomej being
the owner by way of oral partition agreement in the need of money sold their property to
Saiyed Arif Niaji vide sale Deed No 1737 registered on 03.04.1994.

Thereafter, said Saiyed Arif Niaji being the need of money sold his property to Ziaur
Rahman son of Md. Shamsur Rahman and Shahanur Begum, vide Sale Deed No. 3179
registered on 27.03.2016

Finally, said Md. Shamsur Rahman, son of Khalilur Rahman and Sofura Begum, Ziaur
Rahman and Asifur Rahman sons of Md. Shamsur Rahman and Shahanur Begum being
the owners by way of purchase sold 341.82 decimal of land to BAY ECONOMIC
ZONE LTD represented by its Managing Director Ziaur Rahman son of Md. Shamsur
Rahman and Shahanur Begum vide Sale Deed No.12396 registered on 23.12.2018 in the
sub regitrars office Kaliarkoir.

In respect of Title Deed No. 12395 registered on 23.12.2018:

It appears that, one Hossain Ali was the S.A and R.S recorded owner of the scheduled
property.

Thereafter, said Hossain Ali died leaving behind his successors namely Mist Asia
Khatun, Faruk Hossain, Nazma Begum, and Hajji Akram Ali who took the possession
and were in peaceful possession.

Then, said Mist Asia Khatun, Faruk Hossain, Nazma Begum, Hajji Akram Ali being the
owner by way of inheritance executed a Power in favour of Abu Musa to sle the property
vide Power of Attorney Deed No. 5011 registered on 28.04.2016.

Afterward, being the executed Attorney said Abu Musa sold the scheduled property to
Paruma Shoe Limited represented by its Managing Director Ziaur Rahman son of Md.
Shamsur Rahman and Shahanur Begum, vide Sale Deed No. 3985 registered on
23.04.2015.

Finally, said Paruma Shoe Limited represented by its Managing Director Ziaur Rahman
son of Md. Shamsur Rahman and Shahanur Begum sold their land measuring 14.22
decimals to the Mortgagor BAY ECONOMIC ZONE LTD represented by its Managing
Director Ziaur Rahman son of Md. Shamsur Rahman and Shahanur Begum vide Sale
Deed No. 12395 registered on 23.12.2018, in the Sub-Registrar’s Office, Kaliarkoir.

In respect of Title Deed No. 7451 registered on 23.10.2020:

It appears that, Mofez Uddin alias Mofez Ali and Tonur Uddin being the owner by way
of inheritance from their father became the owner and recorded their name correctly in
the S.A & R.S record correctly.

Thereafter, said Tonur Uddin executed a Bel-E-Was Heba Deed in favour of (i) Md.
Sirajul Islam son of Tanur Uddin (ii) Md. Alal Uddin son of Tanur Uddin vide Bel-E-
Was Heba Deed No. 5802 registered on 26.07.1993.

Afterward, said Mofez Uddin alias Mofez Ali executed a Declaration of Heba Deed in
favour of (i) Shamsul Haque son of Mofez Ali (ii) Md. Jalal Uddin son of Mofez Ali (iii)
Md. Solaiman son of Mofez Ali vide Declaration of Heba Deed No.28669 registered on
29.12.2005.

Thereafter, said (i) Md. Sirajul Islam son of late Tanur Ali (ii) Md. Shamsul Haque son
of Mofez Ali (iii) Md. Jalal Uddin son of Mofez Ali (iv) Md. Solaiman son of Mofez Ali
being the owner by way of Bel-E-Was Heba Deed No. 5802 registered on 26.07.1993 and
Declaration of Heba Deed No.28669 registered on 29.12.2005 executed a Sale Deed in
favour of Bay Rubber Industries Limited represented by its Managing Director Shamsur
Rahman son of Khalilur Rahman and Sofura Begum, vide Sale Deed No. 5134
registered on 15.03.2003 in the Sub-Registrar’s Office- Sadar, Gazipur for 59.25 decimal
of land situated in the District- Gazipur.

Finally, said Bay Rubber Industries Limited represented by its Managing Director
Shamsur Rahman son of Khalilur Rahman and Sofura Begum sold their land measuring
92.25 decimals to the Mortgagor BAY ECONOMIC ZONE LTD represented by its
Managing Director Ziaur Rahman son of Md. Shamsur Rahman and Shahanur Begum
vide Sale Deed No. 7451 registered on 23.10.2020, in the Sub-Registrar’s Office,
Kaliarkoir.

In respect of Title Deed No. 9555 registered on 04.10.2018:

It appears that, one Akkas Ali was the R.S recorded owner of the scheduled property.

Afterward, said Akkas Ali died leaving behind his successor, brother, Md. Abdul Barek
alias Bakku Miah who took the possession and was in peaceful possession.
Thereafter, said Md. Abdul Barek alias Bakku Miah being the owner by way of
inheritance executed a sale Deed in favour of Shamsur Rahman son of Khalilur Rahman
and Sofura Begum, vide Sale Deed No. 3295 registered on 08.05.2002.
It appears that, one Akkas Ali was the R.S recorded owner of the scheduled property.

Afterward, said Akkas Ali died leaving behind his successors, sister, Mist. Layli Begum
and Mist. Nazma Begum who took the possession and were in peaceful possession.

Thereafter, said Mist. Layli Begum and Mist. Nazma Begum being the owner by way of
inheritance executed a sale Deed in favour of Shamsur Rahman son of Khalilur Rahman
and Sofura Begum, vide Sale Deed No. 3345 registered on 12.05.2002.

It appears that, Bharot choron Bormon was the owner of the scheduled property.

Thereafter, said Bharot Choron Bormon died leaving behind his successor namely
Shama Choron Bormon who took the possession and being the need of money executed a
Sale Deed in favour of Hayet Ali and Ajgar Ali vide Sale Deed No. 711 registered on
20.02.1941 who recorded their name in the S.A & R.S Khatian correctly.
Afterward, said Hayet Ali being the S.A & R.S recorded owner executed a Sale Deed in
favour of Rezaur Rahman, Ziaur Rahman and Asifur Rahman sonf of Shamsur Rahman
vide Sale Deed No. 2747 registered on 03.05.1999.

It appears that Dhimai Sheikh was the S.A recorded owner of the scheduled property.

Afterward, said Dhimai Sheikh died leaving behind his successors namely Akkas Ali and
Bakku Miah, Surjoban Bibi, Bezarjaan Bibi, Balijaan Nessa.

Thereafter, being the successors of said Dhimai Sheikh said Akkas Ali and Bakku Miah,
Surjoban Bibi, Bezarjaan Bibi, Balijaan Nessa executed a Partition Deed vide Partition
Deed No. 4525 registered on 10.08.1982.

Afterward, said Akkas Ali died leaving behind his wife and two daughter as of his
successors namely Rohima Khatun, Laili Akhter, Nazma Begum accordingly.

Thereafter said Nazma Begum being the owner by way of inheritance executed a Sale
Deed in favour of Mrs. Suraiya Atik vide Sale Deed No. 6500 registered on 20.10.1998.

Afterward, said laili Begum being the owner by way of inheritance executed a Heba
Deed in favour of Rohima Begum vide Bel E Was Heba Deed No. 5649 registered on
23.10.1996.

Thereafter, said Bezarjaan Bibi being the owner by way of Partition Deed No. 4525
registered on 10.08.1982 executed a Sale Deed in favour of Rohima Begum vide Sale
Deed No. 2605 registered on 15.06.1993.
Afterward, said Rohima Begum being the owner by way of inheritance, Bel E Was Heba
Deed No. 5649 registered on 23.10.1996 and Sale Deed No. 2605 registered on
15.06.1993 executed a Sale Deed in favour of Mrs. Suraiya Atik vide Sale Deed No.
6285 registered on 12.10.1998.

Thereafter, said Surzoban Bibi being the owner by way of Partition Deed No. 4525
registered on 10.08.1982 executed a Sale Deed in favour Mrs. Suraiya Atik vide Sale
Deed No. 6284 registered on 12.10.1998.

Moreover, Barek Miah being the owner by way of Partition Deed No. 4525 registered on
10.08.1982 executed a Sale Deed in favour of Suraiya Atik vide Sale Deed No. 6286
registered on 12.10.1998.
Thereafter, said Suraiya Atik being the owner by way of Sale Deed No. 6500 registered
on 20.10.1998, Sale Deed No. 6285 registered on 12.10.1998, Sale Deed No. 6284
registered on 12.10.1998, Sale Deed No. 6286 registered on 12.10.1998 executed a Sale
Deed in favour of Rezaur Rahman, Ziaur Rahman and Asifur Rahman sonf of Shamsur
Rahman vide Sale Deed No. 6766 registered on 29.09.1999.

It appears that, Sadar Uddin, Torip Uddin and Nosor Uddin were the C.S recorded owner
of the scheduled property.

Afterward, said Nosor Uddin died leaving behind his successor Baser Uddin who took
the possession of the said property and became the S.A recorded owner.

Then, said Torip Uddin died leaving behind his successors namely Shahabuddin and
Dujon Ali who took the possession of the land and became the S.A recorded owner.

Afterward, said Baser Uddin, Shahabuddin and Dujon Ali being the owner by way of
inheritance executed a Partition Deed by which Baser Uddin became the owner of the
whole scheduled property vide Partition Deed No. 30121 registered on 06.06.1968.

Thereafter, being the owner by way of the said Partition Deed said Baser Uddin executed
a Bel-E-Was Heba Deed in favour of Kosor Uddin, Jomir Uddin, Anwar Hossain, Nasir
Uddin and Mizanur Rahman vide Bel-E-Was Heba Deed No. 2573 registered on
09.03.1991.

Afterwards, said Kosor Uddin, Jomir Uddin, Anwar Hossain, Nasir Uddin and Mizanur
Rahman being the owner vide Bel-E-Was Heba Deed No. 2573 registered on 09.03.1991
executed a Sale Deed in favour of Rofikul Islam Bhuiyan and Atikul Islam Bhuiyan vide
Sale Deed No. 2495 registered on 29.04.1997.

Afterward, said Kosor Uddin, Jomir Uddin, Anwar Hossain, Nasir Uddin and Mizanur
Rahman being the owner vide Bel-E-Was Heba Deed No. 2573 registered on 09.03.1991
executed a Rectification Deed in favour of Rofikul Islam Bhuiyan and Atikul Islam
Bhuiyan vide Rectification Deed No. 5105 registered on 28.08.1997.
Thereafter, said Rofikul Islam Bhuiyan and Atikul Islam Bhuiyan being the owner vide
Sale Deed No. 2495 registered on 29.04.1997 executed a sale Deed in favour of Rezaur
Rahman, Ziaur Rahman, Asifur Rahman sons of Md. Shamsur Rahman and Shahanur
Begum, vide Sale Deed No. 6767 registered on 29.09.2001.

It appears that, one Akkas Ali was the R.S recorded owner of the scheduled property.

Afterward, said Akkas Ali died leaving behind his successors, sister, Mist. Layli Begum
and Mist. Nazma Begum who took the possession and were in peaceful possession.

Thereafter, said Mist. Nazma Begum being the owner by way of inheritance executed a
Sale Deed in favour of Suiraiya Atik.

It appears that, one Ajgar Ali was the S.A and R.S recorded owner of the scheduled
property.

Thereafter said Ajgar Ali being the S.A and R.S recorded owner executed a Bel-E-Was
Heba Deed in favour of Bazlur Rahman and Gong vide Bel-E-Was Heba Deed No. 9873
registered on 23.11.1981.

Afterward, said Bazlur Rahman being the owner by way of Heba Deed executed a Sale
Deed in favour of Suiraiya Atik vide Sale Deed No. 6506 registered on 20.10.1998.

Thereafter, said Mist Suiraiya Atik being the owner by way of two separate Sale Deed
executed a Sale Deed in favour of Rezaur Rahman, Ziaur Rahman, Asifur Rahman sons
of Md. Shamsur Rahman and Shahanur Begum, vide Sale Deed No. 3368 registered on
14.05.2002.
It appears that, one Ajgar Ali was the S.A and R.S recorded owner of the scheduled
property.

Afterward, said Ajgar Ali being the S.A and R.S recorded owner executed a Bel-E-Was
Heba Deed in favour of Ashraful Alam and Gong vide Bel-E-Was Heba Deed No. 9873
registered on 23.11.1981.
Thereafter, said Ashraful Alam being the owner by way of Heba Deed executed a Sale
Deed in favour of Rezaur Rahman, Ziaur Rahman, Asifur Rahman sons of Md. Shamsur
Rahman and Shahanur Begum, vide Sale Deed No. 3376 registered on 14.05.2002.

It appears that, one Bharot Bormon was the owner of the scheduled property. After the
said Bharot Bormon died leaving behind his successors Sottochoron Bormon and Gong,
being the owner by way of inheritance Sottochoron Bormon and Gong became the C.S
recorded owner by recording their name in the C.S Khatian.

Thereafter, said Sotto Choron Bormon being the C.S recorded owner executed a Sale
Deed in favour of Amir Ali vide Sale Deed No. 2171 registered on 11.04.1921.
Moreover, said Sotto Choron Bormon being the C.S recorded owner executed a Sale
Deed in favour of Kismot Ali Gong vide Sale Deed No. 710 registered on 11.03.1941.

Thereafter, said Kismot Ali being the owner by way of purchase recorded his name in the
S.A Khatian.

Then, said Kismot Ali being the S.A recorded owner executed a Bel-E-Was Heba Deed
in favour of Md. Delwar Hossain and Md. Kaisar Ahmed vide Bel-E-Was Heba Deed
No. 1850 registered on 19.04.1993.

Afterwards, said Md. Delwar Hossain and Md. Kaisar Ahmed being the owner by way of
Heba Deed executed an Exchange Deed in favour of Mist. Suiraiya Atik vide Exchange
Deed No. 1124 registered on 02.03.1998.

Moreover, said Md. Delwar Hossain and Md. Kaisar Ahmed being the owner by way of
Heba Deed executed Declaration Deed in favour of Mist. Suiraiya Atik vide Declaration
Deed No. 2738 registered on 26.04.2000.

Thereafter said Mist. Suraiya Atik being the owner by way of exchange Deed executed a
Sale Deed in favour of Rezaur Rahman, Ziaur Rahman, Asifur Rahman sons of Md.
Shamsur Rahman and Shahanur Begum, vide Sale Deed No. 3603 registered on
29.05.2000.

It appears that, one Tonur Uddin was the S.A & R.S recorded owner of the scheduled
property.

Afterward, said Tonur Uddin being the S.A and R.S recorded owner executed a Heba
Deed in favour of Shirazul Islam vide Heba Deed No. 2669 registered on 20.04.2000.

It appears that, Gimai Sheikh alias Khimai Sheikh was the S.A recorded owner of the
scheduled property.
Afterward, said Gimai Sheikh alias Khimai Sheikh died leaving behind his successor
Akkas Ali who took the possession of the property and recorded his name in the R.S
Khatian correctly.
Then, said Akkas Ali died leaving behind his successors- wife- Rohima Khatun and
daughter- Nazma Begum who took the possession and were in peaceful possession.
Thereafter, said Rohima Begum being the owner by way of inheritance and purchase and
Nazma Begum being the owner by way of inheritance executed a Sale Deed in favour of
Rezaur Rahman, Ziaur Rahman, Asifur Rahman sons of Md. Shamsur Rahman and

took the possession and were in peaceful possession.

Afterward, said Miah Chan being the owner by way of inheritance died leaving behind

It appears that, Mofiz Uddin was the S.A recorded owner of the scheduled property who
executed a sale Deed in favour of Johiron Nesa vide Sale Deed No. 4496 registered on

Moreover, one Shukur Ali being the owner by way of purchase executed a Sale Deed in
favour of Johirun Nesa vide Sale Deed No. 2979 registered on 30.04.1960.

Afterward, said Johirun Nesa being the owner by way of two purchase Deed recorded her

Thereafter, said Sona Vanu being the owner by way of Heba Deed executed a Sale Deed
in favour of Alal Uddin vide Sale Deed No. 5475 registered on 07.08.2000.

Moreover, said Maleka Vanu being the owner by way of Heba Deed executed a Sale
Deed in favour of Alal Uddin vide Sale Deed No. 2669 registered on 20.04.2000.

Further, Kurban Ali, Kalu Sheikh, Biraj Ali and Abdul Quddus were the S.A recorded
owner of the scheduled property.

That, being the S.A recorded owner said Kurban Ali, Kalu Sheikh, Biraj Ali executed a
Sale Deed in favour of Mofez Uddin and Tonur Uddin vide Sale Deed No. 103 registered
on 10.01.1967.

Thereafter, said Tonur Uddin being the owner by way of purchase executed three Sale
Deed in favour of Alal Uddin vide Sale Deed Nos. 625,205 and 7045 registered on
17.01.1976, 09.01.1992 and 15.10.1985 subsequesntly.

Afterward, said Tonur Uddin being the owner by way of purchase executed Bel-E-Was
Heba Deed in favour of his six daughters namely Nur Vanu, Ful Vanu, Lal Vanu, Sona
Vanu, Maleka Vanu and Rup Vanu vide Bale-E-Was Heba Deed No. 6818 registered on
30.11.1994.

Thereafter, said Lal Vanu being the owner by way of Heba Deed executed a Sale Deed in

Moreover, said Rup Vanu being the owner by way of Heba Deed executed a Sale Deed in

Vanu being the owner by way of Heba Deed executed a Sale Deed in favour of Bay Agro
Industries Limited represented by its Managing Director Md. Shamsur Rahman son of
Khalilur Rahman and Sofura Begum, videSale Deed No. 7959 registered on 21.12.2003.
It appears that, Dubor Uddin was the S.A and R.S recorded owner of the scheduled
property who executed a Sale Deed in favour of Vashan Ali vide Sale Deed No. 2455
registered on 15.03.1957.

Moreover, said Dubor Uddin died leaving behind his successor Vashan Ali who became
the owner by way of inheritance from his father and mother and took the possession of
the scheduled property.

Thereafter, said Vashan Ali being the owner by way of purchase and inheritance executed

Afterward, said Miah Chan being the owner by way of inheritance died leaving behind

Thereafter, being the C.S recorded owner said Asor Uddin executed a Sale Deed in

Afterward, said Miah Chan being the owner by way of inheritance died leaving behind

vide Sale Deed No. 10187 registered on 25.10.2018, in the Sub-Registrar’s Office,

It appears that, one Atikul Islam Bhuiyan son of late Abdul Hamid Bhuiyan and Harun or

Thereafter, Mrs. Suraiya Atik wife of Atikul Islam Bhuiyan became the owner by way of
purchase vide Sale Deed Nos. 84 and 2248 registered on 02.01.1985 and 22.04.1985
accordingly.

Then, said Mrs. Suraiya Atik wife of Atikul Islam Bhuiyan being the owner by way of
purchase vide Sale Deed Nos. 84 and 2248 registered on 02.01.1985 and 22.04.1985
accordingly executed a Sale Deed in favour of in favour of Ras Dairy & Fisherise Ltd.
Vide Sale Deed No. 7485 registered on 28.06.1995.

Afterward, the name of the company changed with the signed by N.M. Pnir Uddin,
registrar of joint stock companies and farms Bangladesh dated 29.11.2001 which states
that the name of Ras Dairy & Fisherise Ltd. has changed to Bay Agro Industries Ltd.
Vide memo No. 26430(274)/94 and its ownership was transferred to Alhajj Shamsur
Rahman, Rezaur Rahman, Ziaur Rahman and Asifur Rahman.

Thereafter, said Alhajj Shamsur Rahman, Rezaur Rahman, Ziaur Rahman and Asifur
Rahman purchased some land through the Sale Deed Nos. 7714 executed on 26.11.1998,

Afterward, said Alhajj Shamsur Rahman, Rezaur Rahman, Ziaur Rahman and Asifur
Rahman being the owner through the Sale Deed Nos. 7714 registered on 26.11.1998, Sale
Deed No. 6991 registered on 07.10.1999, Sale Deed No. 4582 registered on 12.07.1999,
Sale Deed No. 283 registered on 13.01.1999, Sale Deed No. 7925 registered on
11.11.1999, Sale Deed No. 838 registered on 07.12.2000, Sale Deed No. 4862 registered
on 17.07.2000, Sale Deed No. 1619 registered on 12.03.2002, Sale Deed No. 1628
registered on 12.03.2002, Sale Deed No. 198 registered on 10.01.2002, Sale Deed No.
7928 registered on 06.12.1998 and Sale Deed No. 4583 registered on 12.07.1999
executed a Sale Deed in favour Bay Agro Industries Ltd. Vide Sale Deed No. 6315
registered on 03.10.2004.

Finally, said BAY ECONOMIC ZONE LTD. a Company limited by shares incorporated
in Bangladesh under the relevant Companies Act, with Certificate of Incorporation No.
C-129510/2016 dated: 10.03.2016, having its address at TCB Bhaban (9 th Floor), 1
Kawran Bazar, Dhaka-1215, represented by its Managing Director Ziaur Rahman son of
Md. Shamsur Rahman sold their land measuring 10.0325 acre to the Mortgagor BAY
ECONOMIC ZONE LTD represented by its Managing Director Ziaur Rahman son of
Md. Shamsur Rahman and Shahanur Begum vide Sale Deed No. 5498 registered on
17.07.2021/18.07.2021, in the Sub-Registrar’s Office, Kaliarkoir.
In Respect of Sale Deed No.10509 registered on 01.12.2021:
It appears that, Md. Jiyaur Rahman became owner of some of the scheduled property by
way of Sale Deed No 3914 registered on 13.06.2000.

It also appears that, Md. Kasim Uddin was the C.S recorded owner of the scheduled
property, being C.S Khatian No 138, pertaining to the plot No 2045 who died leaving
behind his successors namely Dobor Uddin, Joino Uddin as his sons and Shohagi Bewa as
his wife.

Thereafter, said Dobor Uddin, Joino Uddin and Shohagi Bewa being the owner of the
scheduled property by way of inheritance duly recorded their name in S.A Khatian Being
S.A Khatian No 376 pertaining to the plot No 2045.

Afterward, said Joino Uddin being the S.A Khatian recorded owner of the scheduled
property died leaving behind his successors namely Abul Hossain, Jaher Uddin as his
sons, Sabjan, Shonavanu, Malekjan, Julekha Begum, Mst Aduri as his daughters and
Dalimon Nessa as his wife who took the possession of the scheduled property and were in
peaceful possession.

Thereafter, said Sabjan, Shonavanu, Malekjan, Julekha Begum and Mst Aduri being the
owner of the scheduled property by way of inheritance executed a Sale Deed in favour of
Abul Hossain and Jaher Uddin vide Sale Deed No 6178 registered on 08.09.1980.

Afterward, said Abul Hossain and Jaher Uddin being the owner of the scheduled property
by way of inheritance, Sale Deed No 6178 registered on 08.09.1980 and Sale Deed No
5637 registered on 24.10.1959, Dalimon Nessa and Mst Aduri being the owner of the
scheduled property by way of inheritance executed a Sale Deed in favour of Md. Jiaur
Rahman and Md. Asifur Rahman vide Sale Deed No 3614 registered on 16.06.2003.

It also appears that, Hukum Ali and Newaj Ali sons of late Akbor ali were the C.S
recorded owner of the scheduled property, being C.S Khatian No 426 Pertaining to the
plot No2046, 2049 who took the possession of the scheduled property and were in
peaceful possession.

Thereafter, said Newaj Ali being the C.S Khatian recorded owner of the scheduled
property died leaving behind his successor namely Hukum Ali as his brother who took the
possession of the scheduled property and was in peaceful possession.

Afterward, said Hukum Ali being the C.S Khatian recorded owner and being the owner by
way of inheritance died leaving behind his successors namely Sadarjan Bibi as his wife
and Gedi Bibi as his daughter
Thereafter, said Sadarjan Bibi being the owner of some of the property by way of
inheritance and some of the property by way of Bel-E-Waz Heba Deed executed a Heba
Deed in favour of Gedi Bibi vide Heba Deed No 5744 registered on 20.10.1960

Afterward, said Gedi Bibi being owner of the scheduled property by way of inheritance
and Heba Deed No 5744 registered on 20.10.1960 executed a Heba Deed in favour of
Khobiron Nessa vide Heba Deed No 528 registered on 19.01.1983.

Thereafter, said Khobiron Nessa being the owner of some of the scheduled property by
way of Heba Deed No 528 registered on 19.01.1983 executed a Sale Deed in favour of
Mst. Morjina Akhter, Md. Wasim Rana and Md. Jasim Uddin vide Sale Deed No 21793
registered on 12.12.1999.

Afterward, said of Mst. Morjina Akhter, Md. Wasim Rana and Md. Jasim Uddin being the
owner of some of the scheduled property by way of Sale Deed No 21793 registered on
12.12.1999 and said Khobiron Nessa being the owner of some of the scheduled property
by way of Heba Deed No 528 registered on 19.01.1983 executed a Sale Deed in favour of
Md. Jiyaur Rahman son of Alhajj Shamsur Rahman vide Sale Deed No 5772 registered on
07.09.2003.

Finally, said Md. Jiyaur Rahman being the owner of the scheduled property by way of
Sale Deed No 3914 registered on 13.06.2000, Sale Deed No 5772 registered on
07.09.2003, Sale Deed No 3614 registered on 16.06.2003 executed a Sale Deed in favour
of Bay Economic Zone LTD. represented by its Managing Director Jiyaur Rahman son of
Md. Shamsur Rahman and Shahanur Begum vide Sale Deed No 10509 registered on
01.12.2021.
In Respect of Sale Deed No.5363 registered on 13.06.2019:

It appears that, Ajgar Ali was the owner of the scheduled property by way of inheritance
from his father who duly recorded his name in the S.A Khatian, being the S.A Khatian No
384, Pertaining to the Plot No 2022.

Thereafter, said Ajgar Ali being the S.A Khatian recorded owner of the scheduled
property executed a Heba Deed in favour of Talashjan Bibi, Md. Ashraful Alam and
Bajlur Rahman vide Heba Deed No 4516 registered on 09.10.1988 who took the
possession of the scheduled property and were in peaceful possession.

Afterward, said Talashjan Bibi being the owner of the scheduled property by way of Heba
Deed No 4516 registered on 09.10.1988 executed a Bel-E-Waz Heba Deed in favour of
Bajlur Rahman, Ashraful Alam and Habibur Rahman vide Bel-E-Waz Heba Deed No
5173 registered on 28.06.2001.

Thereafter, said Bajlur Rahman being the owner of the scheduled property by way of Heba
Deed No 4516 registered on 09.10.1988 and Bel-E-Waz Heba Deed No 5173 registered on
28.06.2001 executed a Sale Deed in favour of Rokeya Sharmin and Rabeya Sharmin vide
Sale Deed No 2262 registered on 04.04.2002.

Moreover, said Md. Habibur Rahman being the owner of the scheduled property by way
of Bel-E-Waz Heba Deed No 5173 registered on 28.06.2001 executed a Sale Deed in
favour of Rokeya Sharmin and Rabeya Sharmin vide Sale Deed No 6054 registered on
04.09.2002.

In addition to that, said Ashraful Alam being the owner of the scheduled property by way
of Heba Deed No 4516 registered on 09.10.1988 and Bel-E-Waz Heba Deed No 5173
registered on 28.06.2001 executed a Sale Deed in favour of Rokeya Sharmin, Rabeya
Sharmin vide Sale Deed No 7354 registered on 26.10.2002.

Finally, said Rokeya Sharmin, Rabeya Sharmin baing the owner of the scheduled property
by way of Sale Deed No 2262 registered on 04.04.2002, Sale Deed No 6054 registered on
04.09.2002, Sale Deed No 7354 registered on 26.10.2002 executed a Sale Deed in favour
of Bay Economic Zone Ltd vide Sale Deed No 5363 registered on 13.06.2019.

In the above mentioned manner, the Mortgagor, BAY ECONOMIC ZONE LTD
represented by its Managing Director Ziaur Rahman son of Md. Shamsur Rahman and
Shahanur Begum has acquired the sole and absolute title and ownership over the
scheduled land measuring 1500.00 decimal by way of purchase and subsequently got
mutated 1500.00 decimal in its own name in the Govt. revenue record vide Mutation
Khatian Nos. 1691, 1793 ,5100643, 598, 1791, 355, 1794, 1809, 1712 and Mutation
Separation Case Nos. 3125/18-19 dated 29.05.2019, 4568/21-22 dated 30.03.2022,
7795(IX-I)/21-22 dated 08.03.2022,18129(IX-I)/2021-2022 dated 15.03.2022, 1578/21-
22 dated 30.03.2022, 18128(IX-I)/21-22 dated 15.03.2022, 3171/21-22 dated 30.03.2022,
8517(IX-I)/21-22 dated 27.05.2022, 1627/19-20 dated 21.11.2019 Mutation Case No as
per R.S operation and accordingly has been paying the ground rent thereof under Jote
Nos. 579, 682, 240, 242, 680, 53, 683, 698/1, 600.

It appears that (i) Ali Amjad Khan, son of late Ali Ahmed Khan, (ii) Most. Anowara
Begum, wife of Ali Amjad Khan were the S.A recorded owner in the S.A Khatian No.
175 pertaining to Plot No. 607 and 608, along with other plots.

Later, the aforesaid Ali Amjad Khan, son of late Ali Ahmed Khan got recorded his
name in the R.S. Khatian No. 265 pertaining to Plot No. 3603 along with other
plots.

Thereafter, the aforesaid Ali Amjad Khan, son of late Ali Ahmed Khan, being the
recorded owner, has gifted land measuring 100 decimal vide an Affidavit beofore
the Notary Public in Bangladesh at Dhaka, bearing its certificate no. 26 dated
03.09.1991 in favour of his grandson named Ali Asif Khan, son of late Iqbal
Ansari Khan.

Afterwards, the aforesaid Ali Asif Khan, son of late Iqbal Ansari Khan got
recorded his name in the Dhaka City Survey Khatian No. 1018 pertaining to Plot
No. 5502 and 5503.

Thereafter, the aforesaid Ali Asif Khan, son of late Iqbal Ansari Khan, being the
recorded owner, sold land measuring 52.82 decimal vide a Sale Deed No. 6385
registered on 29.06.2006 in the Sub-Register’s Office- Dhanmondi, in favour of
Universal Health Services and Research Limited.
Finally, being owner the aforesaid Mortgagor-Borrower mutated land measuring 30.93
decimal in its name with the Assistant Commissioner (Land) through Mutation &
Separation Case No. 1693/12-13 dated 23.12.2012 under Mutation Khatian No. 11013
and regularly paying the ground rent to the Government authority under Jote No.
3413/18.

Finally, being owner the aforesaid Mortgagor-Borrower mutated land measuring 21


decimal in its name with the Assistant Commissioner (Land) through Mutation &
Separation Case No. 4005 (Dhan)/17-18 dated 09.07.2018 under Mutation Khatian No.
20390 and regularly paying the ground rent to the Government authority under Jote No.
14704/66.

Thereafter the name of the Mortgagor-Borrower have been changed from Universal
Health Services & Research Limited to Unico Hospitals PLC through RJSC and
accordingly changed the name by way of correction in the Mutation Khatian through
Assistant Commissioner (Land) office.

Finally, after changing the name, the Mortgagor-Borrower, UNICO HOSPITALS PLC
(changed from Universal Health Services & Research Limited), being owner mutated
land measuring 51.93 decimal in its name with the Assistant Commissioner (Land)
through Mutation & Separation Case No. Mutation Case No. 11,723(IX-I)/2022-23 dated
25.06.2023 under Mutation Khatian No. 28003 and regularly paying the ground rent to
the Government authority under Jote No. 167/101.
Chain of ownership of the Scheduled Property:

In respect of Sale Deed No. 9045 registered on 26.12.2010


It appears that (i) Nobin Chandra Pal, (ii) Nirod Chandra Pal, sons of late Nilmoni
Pal, along with others were R.S. recorded owner of the land measuring 7 acre in
the R.S. Khatian No. 1277 pertaining to Plot No. 7339 (1 acre), along with other
plots.

Thereafter, the aforesaid (i) Nobin Chandra Pal, (ii) Nirod Chandra Pal, sons of
late Nilmoni Pal, being the owners, sold land measuring 70 decimal vide a Sale
Deed No. 3330 registered on 27.10.1976, in the Sub-Registrar’s Office- Rupganj
in favour of (i) Mohammad Somiroddin, (ii) Mohammad Ainoddin, sons of Hamid
Ullah.

Afterwards, the aforesaid Mohammad Ainoddin, son of Hamid Ullah died leaving
behind three sons namely (i) Md. Sirajul Islam, (ii) Md. Jahirul Islam, (iii) Md.
Fakrul Islam, three daughters namely, (iv) Most. Zikira Begum, (v) Most. Shahida
Akter, (vi) Most. Salima Akter, and wife named (vii) Rokeya Begum, as his legal
heirs.
Thereafter, the aforesaid, (i) Md. Sirajul Islam, (ii) Md. Jahirul Islam, (iii) Md.
Fakrul Islam, (iv) Most. Zikira Begum, (v) Most. Shahida Akter, (vi) Most. Salima
Akter, sons and daughters of Ainoddin, (vii) Rokeya Begum, wife of Ainoddin,
being the owners by way of inheritance from late Ainoddin, sold land measuring
30 decimal vide a Sale Deed No. 12777 registered on 06.09.2005, in the Sub-
Registrar’s Office- Rupganj, in favour of Mahamud Hosen, son of late Mofazzol
Hosen.

On the other hand, the aforesaid (i) Nobin Chandra Pal, (ii) Nirod Chandra Pal,
sons of late Nilmoni Pal, being the owners, sold land measuring 59 decimal vide a
Sale Deed No. 3329 registered on 27.10.1976, in the Sub-Registrar’s Office-
Rupganj in favour of (i) Mohammad Suruj Mia, (ii) Mohammad Firoz Miah, sons
of Hamid Ullah.

Thereafter, the aforesaid (i) Mohammad Suruj Mia, (ii) Mohammad Firoz Miah,
sons of Hamid Ullah, (iii) Md. Sirajul Islam, son of Ainoddin and (iv) Rokeya
Begum, wife of Ainoddin, being owners, sold land measuring 74 decimal vide a
Sale Deed No. 15903 registered on 24.11.2005, in the Sub-Registrar’s Office-
Rupganj, in favour of Mahamud Hosain, son of late Mofazzol Hosen.

On the other hand, it appears that It appears that (i) Folivushon Pal, son of Upendra Pal,
(ii) Koishab Chandra Pal, son of Debendra Palalong with others were R.S. recorded
owner of the land measuring 5.23 acre in the R.S. Khatian No. 1374 pertaining to Plot
No. 7332 (60 decimal), along with other plots.

Thereafter, the aforesaid (i) Folivushon Pal, son of late Upendra Pal (ii) Mukandra
Chandra Pal, son of late Debendra Pal, being the owners, sold land measuring 60 decimal
vide a Sale Deed No. 1209 registered on 30.01.1975, in the Sub-Registrar’s Office-
Rupganj in favour of (i) Mohammad Lal Miah, son of late Dudu Miah.

Afterwards, Mohammad Lal Miah exchanged his land with Md.Rohom Ali through
exchange Deed No. 4062 registered on 08.06.1987, by this exchange Md. Rohom Ali
became owner of land measuring 60 decimal pertaining to Plot No. R.S.7332.

Thereafter, the aforesaid Rohom Ali Mia, being the owner, transfer land measuring 30
decimal vide a Bel Ewaz Heba Deed No. 711 registered on 18.01.1995, in the Sub-
Registrar’s Office- Rupganj, in favour of Shamsul Haque, son of Rohom Ali Miah.

Thereafter, the aforesaid (i) Shamsul Haque, son of Rohom Ali Miah and (ii) Md. Subed
Ali, son of Ohid box, exchanged their land with Md. Sakkod Ali through exchange Deed
No. 6292 registered on 30.05.2001, by this exchange Md. Sakkod Ali became owner of
land measuring 30.50 decimal pertaining to Plot No. R.S.7332 (15 decimal), along with
other Plots.
Thereafter, the aforesaid (i) Shamsul Haque, son of Rohom Ali Miah, being the owner
sold his land measuring 15 decimal vide a Sale Deed No. 12097 registered on
18.10.2001, in the Sub-Registrar’s Office- Rupganj in favour of Sayedur Rahmn, son of
Nur Box.

Afterwards, the aforesaid (i) Md. Sakkod Ali, son of late Ohid Box, (ii) Sayedur Rahmn,
son of Nur Box, being the owner, sold their land measuring 30 decimal vide a Sale Deed
No. 4287 registered on 28.02.2008, in the Sub-Register’s Office-Rupganj, in favour of
Mahjabin Obayed, daughter of Mr. Obayed Ali,

On the other hand, it appears that (i) Achim Uddin, (ii) Akkash Ali Mia, (iii) Fazlul Mia,
sons of ismail Mia, (iv) Lal Mia, (v) Chan Mia, (vi) Sona Mia, (vii) Suroj Mia, sons of
Kalai Hossain Mia alias Kolim uddin, along with others were R.S. recorded owner of the
land measuring 1.94 acre in the R.S. Khatian No. 729 pertaining to Plot No. 7626 (1 acre
60 decimal), along with other plots.

Afterwards, the aforesaid Lal Miah, son of Kalai Hossain, being the owner, sold his land
measuring 30 decimal vide a Sale Deed No. 4009 registered on 30.03.2005, in the Sub-
Registrar’s Office- Rupganj East, in favour of Mahammad Hossain, son of late Mofazzol
Hossain.

Afterwards, the aforesaid Sona Miah, son of Kalai Hossain, being the owner, sold his
land measuring 9.50 decimal vide a Sale Deed No. 2481 registered on 20.02.2006, in the
Sub-Registrar’s Office- Rupganj, in favour of Mahammad Hossain, son of late Mofazzol
Hossain.

Thereafter, the aforesaid (i) Achim Uddin, (ii) Akkash Ali Mia, (iii) Fazlul Mia,
sons of ismail Mia, being the owner, sold their land measuring 27 deicmal vide a
Sale Deed No. 2474 registered on 01.08.1989, in the Sub-Registere’s Office in
favour of Tayej Uddin Mia, son of Md. Murad Prodan.

Afterwards, the aforesaid Tayej Uddin, being the owner, transfer his land
measuring 22.5 decimal vide a Bel Ewaz Heba Deed No. 6242 registered on
17.09.1989, in the Sub-Registrar’s Office- Rupganj, in favour of (i) Md. Habij
Uddin, (ii) Md. Helal Uddin, (iii) Md. Amin Uddin, (iv) Md. Nazrul Islam, (v)
Md. Ajim Uddin.

Afterwards, the aforesaid Md. Amin Uddin, son of Hamid Ullah died leaving
behind only daughter namely (i) Joli Khatun, and wife named (ii) Most. Hawatun
Bibi, as his legal heirs.

Also, Sona Mia, son of Kalai Hossain, died leaving behind only son named (i)
Hasen Miah, and wife named (ii) Rohima Begum as his legal heirs.
Also, Suruj Mia, son of Kalai Hossain, died leaving behind his only son named (i)
Mikhail Miah, and wife named (ii) Most. Fatema Begum.

Thereafter, the aforesaid, (i) Hasen Miah, and (ii) Rohima Begum, son and wife
of Sona Mia, being the owner, sold their land measuring 2.5 decimal vide a Sale
Deed No. 9800 registered on 04.09.1997, in the Sub-Registere’s Office-Rupganj,
in favour of Joli Khatun, daughter of Md. Amin Uddin.

Thereafter, the aforesaid, (i) Mikhail Miah, (ii) Most. Fatema Begum, son and wife
of Md. Suruj Miah, being the owner, sold their land measuring 2.5 decimal vide a
Sale Deed No. 9799 registered on 04.09.1997, in the Sub-Registere’s Office-
Rupganj, in favour of Joli Khatun, daughter of Md. Amin Uddin.

Thereafter, the aforesaid Monu Mia, son of Aforoddin, being the owner, sold their
land measuring 2.5 decimal vide a Sale Deed No. 4071 registered on 21.04.1999,
in the Sub-Register’s Office-Rupganj, in favour of Joli Khatun, daughter of Md.
Amin Uddin.

Thereafter, the aforesaid (i) Habij Uddin, son of Tayej Uddin, (ii) Most. Fatema
Begum, wife of late Md. Suruj Miah, being the owner, sold their land measuring
6.75 decimal vide a Sale Deed No. 1693 registered on 11.02.1995, in the Sub-
Register’s Office-Rupganj, in favour of (i) Hawatun Bibi, wife of Md. Amin
Uddin, (ii) Joli Khatun, daughter of Md. Amin Uddin.

Afterwards, the aforesaid, (i) Hawatun Bibi, wife of Md. Amin Uddin, (ii) Joli
Khatun, daughter of Md. Amin Uddin, being the owner, sold their land measuring
11 decimal vide a Sale Deed No. 611 registered on 15.01.2006, in the Sub-
Register’s Office-Rupganj, in favour of Mahamud Hossen, son of late Mofazzal
Hossen.

Afterwards, the aforesaid, (i) Mahamud Hossen, son of Mofazzal Hossen, and (ii)
Mahjabin Obayed, wife of Mahamud Hossen, being the owner, sold their land
measuring 210.00 decimal vide a Sale Deed No. 9045 registered on 09.10.2016, in
the Sub-Register’s Office-Rupganj, in favour of the Mortgagor No. (1) Md. Abdul
Mannan Bhuiyan, son of late Sayedur Rahman Bhuiyan.

Finally, being owner the aforesaid Mortgagor No. (1) mutated his land of R.S. Plot No.
7339, along with other plots, in his name with the Assistant Commissioner (Land)
through Mutation & Separation Case No. 466/2016-17 dated 16.11.2016 under Mutation
Khatian No. 11407 and regularly paying the ground rent to the Government authority
under Jote No. 11707.
And, being owner the aforesaid Mortgagor No. (1) mutated his land of R.S. Plot No.
7332, along with other plots, in his name with the Assistant Commissioner (Land)
through Mutation & Separation Case No. 658/2016-17 dated 22.01.2017 under Mutation
Khatian No. 11456 and regularly paying the ground rent to the Government authority
under Jote No. 11756.

And, being owner the aforesaid Mortgagor No. (1) mutated his land of R.S. Plot No.
7626, along with other plots, in his name with the Assistant Commissioner (Land)
through Mutation & Separation Case No. 470/2016-17 dated 16.11.2016 under Mutation
Khatian No. 11405 and regularly paying the ground rent to the Government authority
under Jote No. 11705.

In respect of Sale Deed No. 5925 registered on 29.06.2016


It appears that one Nobin Chandra Pal, son of Nilmoni Pal, along with others were
the owners of the property and got recorded their name, in the R.S. Khatian No.
1277 pertaining to Plot No. 7339 (1 acre), along with other plots.

Thereafter, the aforesaid, Nobin Chandra Pal, son of Nilmoni Pal, along with
others, being the owner sold their land measuring 70.00 decimal vide a Sale Deed
No. 3330 registered on 27.10.1976, in the Sub-Registrar’s Office- Rupganj in
favour of (i) Mohammad Somiroddin and (ii) Mohammad Ainoddin, son of Hamid
Ullah.

Afterwards, the aforesaid Mohammad Somiroddin died leaving four sons namely
(i) Md. Manjurul Haque, (ii) Md. Fazlul Haque, (iii) Md. Bazlul Haque, (iv) Md.
Nazmul Haque, and Three daughters namely (v) Mosammat Peyara Begum, (vi)
Mosammat Nilufa Begum, (vii) Mosammat Hosna Begum, as his legal heirs.

Thereafter, the aforesaid (i) Md. Manjurul Haque, (ii) Md. Fazlul Haque, (iii) Md. Bazlul
Haque, (iv) Md. Nazmul Haque, (v) Mosammat Peyara Begum, (vi) Mosammat Nilufa
Begum, (vii) Mosammat Hosna Begum, all are sons and daughters of late Mohammad
Somiroddin, being the owner sold their land measuring 35 decimal vide a Sale Deed No.
4455 registered on 11.04.2002, in the Sub-Registrar’s Office- Rupganj in favour of
Mosammat Meheron Nesa, wife of Mizanur Rahman.

Thereafter, the aforesaid Mosammat Meheron Nesa, wife of Mizanur Rahman, being the
owner, sold her land measuring 35.00 decimal vide a Sale Deed No. 5925 registered on
29.06.2016, in the Sub-Registrar’s Office- Rupgnaj, in favour of the Mortgagor No. (1)
Md. Abdul Mannan Bhuiyan, son of late Sayedur Rahman Bhuiyan.

Finally, being owner the aforesaid Mortgagor No. (1) mutated his land of R.S. Plot No.
7339, along with other plots, in his name with the Assistant Commissioner (Land)
through Mutation & Separation Case No. 466/2016-17 dated 16.11.2016 under Mutation
Khatian No. 11407 and regularly paying the ground rent to the Government authority
under Jote No. 11707.
In respect of Sale Deed No. 12415 registered on 14.12.2014
It appears that one Ashrab Ali, son of late Hosen Ali, was the owner of the
property and got recorded his name, in the S.A. Khatian No. 570 pertaining to Plot
No. 4225, along with other plots.

Thereafter, the aforesaid Ashrab Ali, son of late Hosen Ali, being the owner
transfer his land measuring 75.00 decimal vide a Heba Deed No. 3140 registered
on 22.08.1950, in the Sub-Registrar’s Office- Rupganj, in favour of Md. Suruj
Miah (minor), son of late Chan Miah, represented by his legal guardian mother
Nurinnesa Bibi, wife of late Chan Miah.

Afterwards, the aforesaid Md. Suruj Miah, son of late Chan Miah, represented by
his lawful attorney Md. Mokter Hosen Fahim, son of Abdul Malek vide Power of
Attorney Deed No. 15726 registered on 25.04.2010, being the owner, sold his land
measuring 10 decimal vide a Sale Deed No. 228 registered on 09.01.2014, in the
Sub-Registrar’s Office- Rupganj, in favour of Md. Shahin Miah, son of Md.
Mojammel Haque.

Thereafter, the aforesaid Md. Shahin Miah, son of Md. Mojammel Haque, being the
owner, sold his land measuring 10.00 decimal vide a Sale Deed No. 12415 registered on
14.12.2014, in the Sub-Registrar’s Office- Rupganj, in favour of the Mortgagor No. (1)
Md. Abdul Mannan Bhuiyan, son of late Sayedur Rahman Bhuiyan.

Finally, being owner the aforesaid Mortgagor No. (1) mutated his land of R.S. Plot No.
7338, along with other plots, in his name with the Assistant Commissioner (Land)
through Mutation & Separation Case No. 948/2014-15 dated 29.01.2015 under Mutation
Khatian No. 10562 and regularly paying the ground rent to the Government authority
under Jote No. 10862.

In respect of Sale Deed No. 4728 registered on 15.07.2020


It appears that (i) Folivushon Pal, son of Upendra Pal, (ii) Koishab Chandra Pal, son of
Debendra Palalong with others were R.S. recorded owner of the land measuring 5.23 acre
in the R.S. Khatian No. 1374 pertaining to Plot No. 7332 (60 decimal), along with other
plots.

Thereafter, the aforesaid (i) Folivushon Pal, son of late Upendra Pal (ii) Mukandra
Chandra Pal, son of late Debendra Pal, being the owners, sold land measuring 60 decimal
vide a Sale Deed No. 1209 registered on 30.01.1975, in the Sub-Registrar’s Office-
Rupganj in favour of (i) Mohammad Lal Miah, son of late Dudu Miah.

Afterwards, Mohammad Lal Miah exchanged his land with Md.Rohom Ali through
exchange Deed No. 4062 registered on 08.06.1987, by this exchange Md. Rohom Ali
became owner of land measuring 60 decimal pertaining to Plot No. R.S.7332.
Thereafter, the aforesaid Rohom Ali Mia, being the owner, transfer land measuring 46.50
decimal vide a Bel Ewaz Heba Deed No. 5992 registered on 07.06.1995, in the Sub-
Registrar’s Office- Rupganj, in favour of Ismail Miah, son of Md. Rohom Ali.

Thereafter, Ismail Miah, son of Md. Rohom Ali, being the owner, sold his land
measuring 30 decimal vide a Sale Deed No. 10883 registered on 05.10.1999, in
the Sub-Registrar’s Office- Rupganj, in favour of Md. Aynal Haque, son of late
Kofil Uddin.

Afterwards, Md. Aynal Haque, son of late Kofil Uddin, being the owner, sold his
land measuring 30 decimal vide a Sale Deed No. 20442 registered on 26.05.2010,
in the Sub-Registrar’s Office- Rupganj, in favour of Fairdeal Properties Limited,
represented by its Managing Director.

Afterwards, Fairdeal Properties Limited, represented by its Managing Director,


being the owner, sold their land measuring 17 decimal vide a Sale Deed No. 4728
registered on 15.07.2020, in the Sub-Registrar’s Office- Rupganj, in favour of the
Mortgagor No. (2) Md. Raushan Akter Mannan, wife of Abdul Mannan Bhuiyan.

Finally, being owner the aforesaid Mortgagor No. (2) mutated her land of R.S.
Plot No. 7332, along with other plots, in her name with the Assistant
Commissioner (Land) through Mutation & Separation Case No. 18520/19-20
dated 21.06.2020 under Mutation Khatian No. 13915 and regularly paying the
ground rent to the Government authority under Jote No. 14215.

In respect of Sale Deed No. 6577 registered on 13.06.2017


It appears that (i) Hosen Ali, (ii) Kalu Miah, (iii) Madari Miah, (iv) Nayeb Ali, sons of
Somoroddin, (v) Rohom Ali, son of Ohid Khan, along with others were R.S. recorded
owner of the land measuring 7.79 acre in the R.S. Khatian No. 860 pertaining to Plot No.
7333 (5 decimal) 7334 (5 decimal) 7335 (5 decimal), along with other plots.

Thereafter, the aforesaid Madari Mia, being the owner, sold his land vide a Sale Deed
No. 3176 registered on 16.06.1970, in the Sub-Registrar’s Office- Rupganj in favour of
Md. Nur Box.

Afterwards, the aforesaid Md. Nur Box Miah, being the owner, sold his land vide a Sale
Deed No. 6237 registered on 21.08.1990, in the Sub-Registrar’s Office- Rupganj in
favour of Md. Hazrat Ali, son of late Hosen Ali.

Afterwards, the aforesaid Md. Nur Box Miah, and Mrs. Chandraban Bibi, wife of Md.
Nur Box, being the owners, sold their land vide a Sale Deed No. 9959 registered on
13.09.2000, in the Sub-Registrar’s Office- Rupganj in favour of (i) MD. Mokshed Ali,
(ii) Md. Masum Miah, son of Hazrat Ali.
On the other hand, the aforesaid Kalu Miah died leaving behind his son Md. Abdur
Roshid, as his legal heirs.

Thereafter, the aforesaid (i) Md. Abdur Roshid, son of Kalu Miah, (ii) Md. Hazrat Ali,
son of late Hosen Ali, (iii) MD. Mokshed Ali, (iv) Md. Masum Miah, sons of Hazrat Ali,
and (v) Habij Uddin, son of Nurul Islam, being the owners, sold their land vide a Sale
Deed no. 6577 registered on 13.06.2017, in favour of the Mortgagor No. (2) Md. Raushan
Akter Mannan, wife of Abdul Mannan Bhuiyan.

Finally, being owner the aforesaid Mortgagor No. (2) mutated her land of R.S. Plot No.
7333, 7334, 7335, along with other plots, in her name with the Assistant Commissioner
(Land) through Mutation & Separation Case No. 1041/2017-18 dated 03.01.2018 under
Mutation Khatian No. 12088 and regularly paying the ground rent to the Government
authority under Jote No. 12388.

In respect of Sale Deed No. 12461 registered on 11.12.2019


It appears that (i) Sona Miah, (ii) Akber Ali, sons of Ashrab Ali, (iii) Suruj Miah, son of
Chan Miah, along with others were R.S. recorded owner of the land measuring 79
decimal in the R.S. Khatian No. 2017 pertaining to Plot No. 7338 (47 decimal), along
with other plots.

Thereafter, the aforesaid Md. Suruj Miah, son of Chan Mia, being the owner, sold his
land measuring 10 decimal vide a Sale Deed No. 5551 registered on 17.04.2004, in the
Sub-Registrar’s Office- Rupganj in favour of Hazera Khatun, wife of Md. Nuru Miah.

Thereafter, the aforesaid Md. Suruj Miah, son of late Chan Mia, being the owner, sold
his land measuring 10 decimal vide a Sale Deed No. 15373 registered on 08.11.2005, in
the Sub-Registrar’s Office- Rupganj in favour of Md. Nuru Miah, son of late Md. Rohim
Box Miah.

Thereafter, the aforesaid Md. Suruj Miah, son of late Chan Mia, being the owner, sold his
land measuring 10 decimal vide a Sale Deed No. 11288 registered on 04.09.2002, in the
Sub-Registrar’s Office- Rupganj in favour of Md. Nuru Miah, son of late Md. Rohim
Box Miah.

Afterwards, the aforesaid Md. Nuru Miah died leaving behind his two sons nameky (i)
Ahommod Ali, (ii) Shamim Miah, and one daughter named (iii) Jakia Begum and wife
named (iv) Ms. Hazera begum, as his legal heirs.

Thereafter, the (i) Ahommod Ali, (ii) Shamim Miah, (iii) Jakia Begum, (iv) Ms. Hazera
begum, being the owners, sold their land measuring 26.25 decimal vide a Sale Deed No.
133 registered on 04.01.2016, in the Sub-Register’s Office- Rupganj, in favour of
Fairdeal Properties Limited, represented by its Managing Director.

Later, the aforesaid Fairdeal Properties Limited, represented by its Managing Director,
exchanged their land with Abdul Mannan Bhuiyan through exchange Deed No. 12461
registered on 11.12.2019, and by this exchange Deed the Mortgagor No. (2) Md. Raushan
Akter Mannan, wife of Abdul Mannan Bhuiyan became owner of land measuring 26.25
decimal pertaining to Plot No. R.S.7338 (26.25 decimal), along with other plots.

Finally, being owner the aforesaid Mortgagor No. (2) mutated her land of R.S. Plot No.
7338, along with other plots, in her name with the Assistant Commissioner (Land)
through Mutation & Separation Case No. 12123/2019-20 dated 19.01.2020 under
Mutation Khatian No. 13521 and regularly paying the ground rent to the Government
authority under Jote No. 13821.

Chain of ownership of the Scheduled Property is as follows:


In respect of Title Deeds Nos. 38602, 38607, 38525 & 38504 registered on
31.10.1978.
It appears that one Monir Uddin Mollah, son of Hazi Kobir Uddin was the owner of the
Property and got recorded his name in the S.A. Khatian No.324 pertaining to Plot Nos.
871, 872 & other Plot and in the R.S. Khatian No. 496 pertaining to Plot Nos. 890, 891
and other Plot.
Afterwards, being owner of the property by way of S.A. & R.S. recorded, the aforesaid
Monir Uddin Mollah sold measuring 15.84 decimal of land to Md. Monjurul Haque
Mollah, son of Hazi Kobir Uddin Mollah vides Sale Deed No. 2926 registered on
19.04.1977 & Sale Deed No. 2953 registered on 20.04.1977.

Thereafter, being owner of the property by way of purchase, the aforesaid


Monjurul Haque Mollah sold measuring 05.28 decimal of land to Chowdhury Abu
Ahmed Rushdi, son of Md. Nur Nabi Chowdhury vide (a) Sale Deed No. 38602
registered on 31.10.1978, (b) Sale Deed No. 38607 registered on 31.10.1978, (c)
Sale Deed No. 38525 registered on 31.10.1978 & (d) Sale Deed No.38504
registered on 31.10.1978.
In respect of Title Deeds Nos. 38604, 38605, 38523 & 38503 registered on 31.10.1978.
It appears that one Monir Uddin Mollah, son of Hazi Kobir Uddin was the owner of the
Property and got recorded his name in the S.A. Khatian No.324 pertaining to Plot Nos.
871, 872 & other Plot and in the R.S. Khatian No. 496 pertaining to Plot Nos. 890, 891
and other Plot.
Afterwards, being owner of the property by way of S.A. & R.S. recorded, the aforesaid
Monir Uddin Mollah sold measuring 15.84 decimal of land to Md. Monjurul Haque
Mollah, son of Hazi Kobir Uddin Mollah vide Sale Deed No. 2926 registered on
19.04.1977 & Sale Deed No. 2953 registered on 20.04.1977.
Thereafter, being owner of the property by way of purchase, the aforesaid Monjurul
Haque Mollah sold measuring 05.28 decimal of land to Mst. Hasiba Chowdhury, wife of
Md. Nur Nabi Chowdhury vide (a) Sale Deed No. 38604 registered on 31.10.1978, (b)
Sale Deed No. 38605 registered on 31.10.1978, (c) Sale Deed No. 38523 registered on
31.10.1978 & (d) Sale Deed No. 38503 registered on 31.10.1978.
On the other hand, being owner of the property by way of S.A. & R.S. recorded, the
aforesaid Monir Uddin Mollah sold measuring 05.29 decimal of land to Md. Nur Nabi
Chowdhury, son of late Mokbul Haque Chowdhury vide (a) Sale Deed No. 38505
registered on 31.10.1978, (b) Sale Deed No. 38524 registered on 31.10.1978, (c) Sale
Deed No. 38606 registered on 31.10.1978 & (d) Sale Deed No. 38603 registered on
31.10.1978.

Afterwards, the aforesaid Nur Nabi Chowdhury passed away leaving behind his
heirs namely 1 wife and 3 sons namely- (1) Hasiba Chowdhury, (wife), (2)
Chowdhury Abu Ahmed Rushdi, (3) Chowdhury Shamim Hasnai Mehedi & (4)
Chowdhury Yeasin Adnan Yeasdi (sons).

Thereafter, being owner of the property by way of purchase and inheritance from
their Husband & father, the aforesaid Hasiba Chowdhury and other jointly got
approval of building Plan for construction of the 5 (five) storied Commercial
building on the said land from Rajuk vide its Memo No.
RAJUK/NAA/3C/2997/97/3555-stha dated 03.11.1997.
Chain of ownership of the Scheduled Property:
It appears that Eastern Housing Limited were B.S. recorded owner of the schedule
property measuring 5.32 decimal in the B.S. Khatian No. 51 pertaining to Plot No.
598, Mouza- Polashbari.
 
Thereafter, the aforesaid Eastern Housing Limited, being the owner, sold land
measuring 4.95 decimal vide a Sale Deed No. 12647 registered on 09.06.2005, in
the Sub-Registrar’s Office- Ashulia, in favour of Md. Mohibur Rahman Badal, son
of Md. Mukbol Hossen.
 
Thereafter, the aforesaid Md. Mohibur Rahman Badal, son of Md. Mukbol
Hossen., being the owner, transfer vide a Declaretion of Heba land measuring 1.50
decimal vide a Heba Deed No. 4036 registered on 13.03.2013, in the Sub-
Registrar’s Office- Ashulia, in favour of Samima Akter Lipi, wife of Md. Mohibur
Rahman Badal.
 
Thereafter, the aforesaid Samima Akter Lipi, wife of Md. Mohibur Rahman Badal,
being the owner, sold land measuring 1.50 decimal vide a Sale Deed No. 366
registered on 10.01.2019, in the Sub-Registrar’s Office- Ashulia, in favour of Md.
Mohibur Rahman Badal, son of Md. Mukbol Hossen.
 
Thereafter, the aforesaid Md. Mohibur Rahman Badal, son of Md. Mukbol
Hossen, being the owner, sold land measuring 4.95 decimal vide a Sale Deed No.
379 registered on 10.09.2019, in the Sub-Registrar’s Office- Ashulia, in favour of
 
(i) Md. Khalilur Rahman, son of Abdul Mannan Hawlader, (ii) Most. Momotaz,
wife Md. Khalilur Rahman.
 
Finally, being owner of the Scheduled Property the aforesaid (i) Md. Khalilur
Rahman, son of Abdul Mannan Hawlader, (ii) Most. Momotaz, wife Md. Khalilur
Rahman (Mortgagors) mutated the Schedule Property measuring 4.95 decimal
land in their name with the Assistant Commissioner (Land) through Mutation &
Separation Case No. 15025/2020-21 dated 03.08.2021 under Mutation Khatian
No. 6558, Plot No. 598, Mouza- Polashbari and regularly paying the ground rent
to the Government authority under Jote No. 86/31.
