CONTRACT OF SERVICE

KNOW ALL MEN BY THESE PRESENTS:

This Contract of Service is made, executed and entered by and between:

The BUREAU OF FISHERIES AND AQUATIC RESOURCES, Regional Fisheries Office


12, with office address at Prime Regional Government Center, Barangay Carpenter Hill,
Koronadal City, South Cotabato, created and existing under and by virtue of Presidential
Decree No. 1 and 461 of RA 8550, herein represented by its Regional Director USOP D.
PENDALIDAY JR., hereinafter referred to as the FIRST PARTY.

and

MICHAEL P. ALIMAN, of legal age, Filipino and with postal address at Barangay Poblacion,
Kabacan, North Cotabato hereinafter referred to as the SECOND PARTY

W I T N E S S E T H:

WHEREAS, the FIRST PARTY is in need of the services of the SECOND PARTY who
shall perform the work which the regular personnel could not perform;

WHEREAS, the SECOND PARTY has signified his/her intention to provide the
services needed by the FIRST PARTY of which the latter has accepted;

WHEREAS, the FIRST PARTY ensures that the SECOND PARTY possesses the
educational qualification, experience, skills, competence and personality traits which
include the good moral character required to perform the job as described herein;

WHEREAS, the SECOND PARTY, hereby attests that he/she is not related within the
third degree of consanguinity or affinity to the: 1) hiring authority and/or 2)
representative of the First Party; that he/she has not been previously dismissed from any
government offices by reason of administrative and/or criminal offense;

WHEREAS, the SECOND PARTY may be allowed to attend trainings and workshops
within or outside his Official Station, depending on the urgency, and shall likewise render
services corresponding to the number of days, in case he/she resigns from his/her work.

WHEREAS, the SECOND PARTY may be allowed to travel on official purpose


outside his/her official station with approved Travel Order from the FIRST PARTY and is
entitled for transportation expensesonly that is subject to the guidelines set forth by the
FIRST PARTY; and in accordance with COA Rules and Regulations;

WHEREAS, the FIRST PARTY shall in no case be liable for any untoward incidents
that may occur during the SECOND PARTY’s travel and likewise shall not be liable for any
accident, whether work related or non-work related within or outside the workplace of the
SECOND PARTY;

WHEREAS, in view hereof, the SECOND PARTY is hereby contracted as a


CONTRACT OF SERVICE WORKER (CSW) from July 01, 2023 to December 31, 2023 and
in consideration of the daily wage rate of P 693.36/day payable twice a month, every 15th
and last day of every month.

WHEREAS, The SECOND PARTY is required to perform the following


works/functions:

1. Coordinate with the LGU through the MAO in the identification, profiling and
validation of potential project beneficiaries.

2. Assist the PFO in the implementation of all TARGET components in the


municipality of assignment.

3. Coordinate closely with the LGU through the Municipal fishery coordinator of all
TARGET activities including his/her program of work.

4. Undertake trouble-shooting and/or report concerns that may require assistance


to the MAO and /or PFO.

5.Conduct necessary training needed by the fisherfolks in the community

6. Undertake progress monitoring of livelihood projects and submit reports thereat.

7. Participate/attend in relevant trainings, mentoring and coaching and other


activities as required.

8. Perform such other related functions as may be assigned from time to time by the
Immediate Superior.

WHEREAS, the Second Party shall render work from Mondays to Fridays including
Saturdays, Sundays and Holidays as directed by the Immediate Supervisor;

WHEREAS, only for the purpose of determining their daily wage, the monthly salary
shall be divided by twenty-two (22) working days as divisor;

WHEREAS, regardless of the varying actual number of working days in a month,


they shall be paid their whole/fixed monthly rate, provided that they have completed the
actual number of working days in the said month; Provided further that the number of days
un-worked/absent shall be deducted from the same (actual number of working days in a
month) using their daily wage computation;

WHEREAS, they shall be paid during regular, special and declared holidays and also,
when there is suspension of work, even if no work is rendered; provided that they are
present a day prior to and after the said regular, special, declared holidays and work
suspension. However, if the work suspension is after the Contracted Party has already
reported to work, they are still required to log their attendance in the biometric machine or
DTR;
WHEREAS, the Individual Contract of Service who has incurred at least three (3)
absences in a month for three (3) consecutive months, without justifiable reasons, during
the six (6) months period of the contract shall be ground for termination of contract;

WHEREAS, in observance of Republic Act No. 8491, otherwise known as the “Flag
and Heraldic Code of the Philippines”, the Individual Contract of Service is required to
attend the Flag Raising Ceremony every Monday except if such personnel is out of office on
official business or on official travel. Non-observance of the said law, after proper notice
and hearing, may be a ground for termination of contract;

WHEREAS, it is understood that this contract does not establish an Employer-


Employee relationship between the FIRST PARTY and the SECOND PARTY and that the
services rendered are NOT CONSIDERED AS GOVERNMENT SERVICE, AND THAT THE
LATTER IS NOT ENTITLED TO BENEFITS ENJOYED BY THE PERMANENT PERSONNEL
of the FIRST PARTY;

WHEREAS, it is agreed and understood that during the term of this CONTRACT,
there shall be no participation of the SECOND PARTY to any picket within the FIRST
PARTY’S premises. In the event that dispute/s may arise, the FIRST PARTY shall
unilaterally terminate this CONTRACT.

WHEREAS, the Individual Contract of Service will automatically cease upon its
expiration on December 31, 2023, or may be terminated for early completion or
discontinuance of the project, lack of funds or when the contracted party has committed
infractions such as absenteeism, drunkenness, lofting, falsification of documents,
dishonesty, non-observance of office rules and regulations, or when his/her service is no
longer needed, or when he/she committed any of the acts enumerated under Section
50 and 51 of the 2017 Rules on Administrative Cases in the Civil Service; provided
that, in case of an investigation, the Second Party shall be given five (5) days from
receipt of Notice to Comment/Answer to explain his/her side, and after due
consideration of gravity of the infraction and without prejudice to the suppletory
application of the 2017 Rules on Administrative Cases in the Civil Service, the First
Party has the discretion to apply the penalty of suspension of contract in lieu of
termination of contract whenever proper or appropriate;

WHEREAS, in case the contracted party shall end his/her contract with the
contracting party a 30-day prior notification is required.
