1. AUTHORITY

2. MATTERS TO BE INVESTIGATED:
a. To determine surrounding Circumstances behind the shooting incident that transpired on
December 4,2022 at about 6:00PM at Brgy, Opong, Catubig, Northern Samar, Victimizing
Catherine Lutao, Perpetrated by Suspect Liam Rameriz.
b. To determine the Criminal liability of the suspect for filing of the Case before the court.
3. FACT OF THE CASE:
a. That at about 6:10PM of December 4,2022, Baranggay Chairman Benjie Lobos of Brgy.
Opong, Catubig, Northern Samar Personally appeared before this office and reported that
December 4,2022 at about 6:00PM a Certain Catherine Lutao was shot by a suspect identified
as Merry Cris Olenan. That according to a foremontioned reporting person the victim sustain
gunshot wound in the left breast chest and was rushed to Catubig District Hospital for
immediate medical treatment while the suspect immediately filed towards the mountainous
area in north of said Baranggay escape.

b. That upon received of said report duty investigator immediately went to Catubig District
Hospital to verify the status of the victim while the alert team immediately went to Bryg,Opong
to safeguard the crime scene and to conduct pursuit Operation to arrest the suspect.
c. That upon arrival at Catubig District Hospital by the IOC the victim was already declared dead
by the duty physician.
d. That upon arrival of the alert team of Brgy, Opong, Catubig, Northern Samar, they
immediately cordoned the crime scene and conducted pursuit. Operation to apprehend the
suspect.
e. That during initial search conducted by the IOC at the Crime Scene, one(1) piece of fired
cartridge case was found on the grassy portion of the front yard of the victim house about six
meters from the the location where the body of the victim was found by the responding
baranggay officials.
f. That during the crime scene interview conducted by IOC, two(2) witnesses was identified and
voluntarily gave their statement pertaining to the incident.
g. In a judicial affidavit of Noli Corocoto, he averred that in December 4, 2022 at about 6:00PM
while he was out side of their house walking toward the Sari-sari Store he saw Merry Cris
Olenan walking towards the direction of Catherine Lutao and Carrying a short firearm. He also
said that while Merry Cris was approaching Catherine she took his firearm and suddenly fired
the same hitting the former in the left breast part or his body. He further said that in his fear he
immediately went inside the house of Dina Wong to hide.
h. In a judicial affidavit of Maricar MORILLO she averred that on December 4,2022 at about
6:00PM while she was outside of their house and having a conversation with Catherine Lutao,
she saw Merry Cris Olenan approaching them and notice that Merry Cris was carrying a short
firearm. She also said that while Merry Cris was approaching Catherine, she took his firearm
and and suddenly fired the same hitting the former in the left breast part of his body. She
further say that in his fear she immediately run inside to their house to hide.
I. In a post Mortem Examination Report of Lyka ablao Morillo is state that the victim cause of
death was due to hypovolemic shock first to the gunshot wound in the left breast part of the
body and PE results:1 gunshot wound with tattooing measuring from 0.5 to ICM POE.
j. In a death certificate of Catherine Lutao it state that Lyka Ablao Morillo was died on
December 4,2022 and the cause of death was Hypovolemic shock first to gunshot wound in the
left breast part of the body.
k. Follow up investigation conducted also revealed that in the evening same date before the
incident Merry Cris Olenan and Catherine Lutao attended a drinking session at the house of
certain Kiem Luna in the said Baranggay and during the said drinking session a heated argument
ensured between them that resulted to a fight between them wherein Merry Cris sustained
face injuries and broken nose.
4. DISCUSSION
a. In this instant case, it is crystal clear that Merry Cris Olenan shot Catherine Lutao in the left
breast part of his body that resulted to his death. It is also Clear that the suspect has motive of
revenge against the victim due to previous incident occurred between them.
5. CONCLUSION:
a. Based on the foregoing, the undersigned conclude that suspect Merry Cris Olenan is
Criminally liable for violation of article 248 of the Revised Penal Code of Murder there was an
Aggrivating circumstances of tretchery of Crime.
6. RECOMMENTION:
a. WHEREFORE, in view of the foregoing the recommends filing of the Case of violation of
Article 248 of of the Revised Penal Code or Murder against the suspect Merry Cris Olenan.

The undersigned prosecutor, charges Merry Cris Olenan of the crime of Murder, Committed
as follows:
That on or about the 4th day of December 2022 at about 6:00PM at Brgy, Opong, Catubig,
Northern Samar Philippines and within the Jurisdiction of this Honorable Court and the accused
she took the gun and did then and their, willfully, unlawfully, and feloniously, with just motive
with intent to kill, shot Catherine Lutao in left breast part of his body Causing his instanteneous
death.

CERTIFICATION AS TO CONDUCT OF INQUEST
I hereby certify that the accused was lawfully arrested without a warrant and that, upon being
informed of his rights, refused to waive the provision of Article 125 of the Revised Penal Code
and for this reason, an inquest was conducted, that based on the complaint and the evidence
submitted by the accused, despite the opportunity to do so, there is reasonable ground to
