PETITION FOR ADOPTION
To: A Judge of the High Court
The Petition of JONES LUNGU of House No. 40 Mukambo Drive, Kabulonga, Lusaka
of the Lusaka Province of the Republic of Zambia born on 22 nd October 1991 and
MUNDIA LUNGU born on 1st December 1994 his wife of the same address SHOWETH-
1. Your Petitioners are desirous of adopting the said MITCH BWALYA, under the
provisions of the Adoption Act.
2. Your Petitioners are resident at House No. 40 Mukambo Drive, Kabulonga, Lusaka in
the Lusaka Province of the Republic of Zambia.
3. Your Petitioner Jones Lungu was married to your Petitioner Mundia Lungu at the
Registrar of Marriages at Civic Center Lusaka on the 10th day of November 2018.
4. Your Petitioners are by occupation an architects at Patel Engineers.
5. Your Petitioner Jones Lungu is 29 years of age and your Petitioner Mundia Lungu is 26
years of age.
6. Your Petitioners do not reside with anyone else
7. Your Petitioners Jones Lungu and Mundia Lungu are not related to the said Mitch
Bwalya
8. The said Mitch Bwalya is
(a) Of the male sex;
(b) Unmarried
(c) A child of Mercy Bwalya the mother of house No. 10 Mwembeshi Road in Chilulu of
the Republic of Zambia and Musonda Hachi the father of Plot No. 30, Central
Street, Mumbwa of the Republic of Zambia
(d) Resident in Zambia;
(e) 1 year of age, having been born on the 10 th day of October, 2019, at the University
Teaching Hospital
(f) Resident at house No. 10 Mwembeshi road in Chilulu of Lusaka in the Lusaka
Province of the Republic of Zambia
(g) now in the actual custody of Mercy Bwalya of house No. 10 Mwembeshi Road in
Chilulu of the Republic of Zambia
(h) under the guardianship of Mercy Bwalya of house no. 10 of the Republic of Zambia
(i) is not entitled any property
9. Mercy Bwalya of house no. 10 Mwembeshi road Chilulu of the Republic of Zambia and
Musonda Hachi of Mumbwa of the Republic of Zambia are liable to contribute to the
support of the said Mitch Bwalya
10. The said Mitch Bwalya has not been the subject of an adoption order or an application
or petition for an adoption order.
11. Your Petitioners undertake if an order is made on this Petition, to make for the said
Mitch Bwalya the following provision, namely to enrol him at the Paediatric Centre at
the University of Teaching Hospital and expose him to the best medication treatment.
Your Petitioners will, if required, secure the above provision by bond or otherwise as
the Court may require.
12. Consents to the making of the an adoption order have been obtained from the
following persons and are annexed hereto, namely:
(a) Mercy Bwalya (Mother and Custodian
(b) Musonda Hachi (Father)
13. Your Petitioners have not received, agreed to receive, and no person has made or
given or agreed to make or give to the Petitioners any payment or reward in
consideration of the adoption of the said Mitch Bwalya
14. It is proposed that the costs of this Petition shall be provided for as follows, namely;
the Petitioners
15. Your Petitioners notified the Commissioner for Juvenile Welfare of their intention to
apply for an adoption order in respect of the said Mitch Bwalya on the 12 th day of
September 2020.
16. Your Petitioners do not desire that their identity should be kept confidential
17. If an adoption order is made in pursuance of the Petition it is proposed that the said
Mitch Bwalya should be known as Mitch Lungu
Your Petitioners pray-
(i) That an order for the adoption of the said Mitch Bwalya by your Petitioners
may be made in pursuance of the Adoption Act with all the necessary
directions:
(ii) That the costs of this Petition may be provided for as above mentioned or
otherwise as the Court may direct:
(iii) Such further or other order as the nature of the case may require.
And Your Petitioners will ever pray.
