Subject: - Appeal against decision of the charge sheet no-ch-12/ET-7327
dated-05.04.2022 decided vide office order no-86 dated-
13.06.2023 by SE (OP) (OP) Circle, UHBVN, Ambala.
Respected /Sir,
With due respect, it is submitted for your kind consideration that
I had joined the SDO (OP) Sub-Division, UHBVN, Babyal on dated-___________as
LM. I performed my duties sincerely & honestly to the entire satisfaction of my
seniors and there has been nothing adverse against me in my entire tenure in Sub-
Division, UHBVN, Babyal except the present charge sheet, in which I have been
wrongly alleged with the following charges:-
1. Sh. Jai Narain working as a lineman was found responsible for
loss of revenue due to at the time of checking there are two meter
installed inside sage premises i.e. Varamada/Bada one old electric
connection in the name of Sh. Suminder Singh (A/c no.
A14YD1649800) and pending amount Rs. 19430/ second new
meter in the name of Sh. Manpreet Singh S/o Hargulab Singh (A/C
Do A14YD7:25W) also install d at the same premises it is found
that second electric connection was applied by Sh. Manpreet Singh
S/o Sh. Hargulab Singh vide application number A14-720-27 dated
2-7-2020 the connection was released vide SCO no. A14-720-27
dated 6-7-2020 (A/C no. A14YD 167125W
2. The site of Sh. Manpreet Singh was verified by Sh. Jai Narain, LM
was not properly verified, as there was already a domestic electric
connection in the same premises in the name of Sh. Suminder
Singh (A14YD164980A) pending amount Rs.164146 exist. Which
will not mentioned on the file at the time of site verification. As per
Nigam instruction only one electric connection of the same
category should be released in one promises. The PDCO of Sn.
Suninder Singh issued vide PDCO no 30/308, dated 3-5-21 for Rs.
19430/ which is also pending to effect
The Above charge sheet decided by SE (OP) Circle, UHBVN, Ambala
vide his office order no-86 dated-13.06.2023 with penalty to stop one annual
increment without future effect (attached as Annexure-A1) without considering
my reply (attached as Annexure-A2) as well as enquiry report of Sh. Sanjeev
Siwach XEN (OP) Division, UHBVN, Naraingarh.
The above named officer has appointed as enquiry officer vide office
order No-169 dated-11.10.2022 and he has enquired the matter and submitted his
conclusion. The conclusion is reproduced as under:
“On the basis of record supplied by both parties, matter enquired and
observed that as per family settlement papers, that bada also divided into two
share for which charge sheet issued to the official, the relevant portion of this
agreement/family agreement dated 18.11.2019 is hereby attached as Annexure-
A3.
In so far as agreement is concerned. Sh. Manpreet Singh who is son of
Sh. Hargulab Singh, applied for new connection in Bada on 02.04.2020 and sh. Jai
Narain verify the site for installation of new connection, which comes into the share
of his father Sh. Hargulab Singh. Therefore, there was not any kind of defaulting
amount was outstanding on the share of Sh. Hargulab Singh because this divided
share is not the parts of the property of Suminder Singh, in the name of which
defaulting amount was outstanding for Rs 16414/ at the tune of verification of new
connection.
Hence both these brothers, were summoning for attending enquiry
being involvement of these two brothers named Sh. Hargulab Singh and Sh.
Suminder Singh, Sh. Hargulab Singh appear on dated-23.02.2023 and submitted
statement that there is some clerical error in agreement dated 18.11.2019 as the
house where AC No. YD16-1882P was installed, was not came into his share.
Whereas another brother also summoned in the present case, but he did not
appear before the undersigned to submit the statement.
In fact, dispute regarding defaulting amount arises from the Origin
premises of Balbir Singh, having Account No. YD16-1882P with defaulting amount
1,70,298/- as PDCO issued on 30.12.2020 and effected.
This was single premises in origin after that it was divided into two
share along with Bada (where sh. Jai Narain verified the site) As per comments
submitted by SDO OP S/Division Babyal, he himself verified the site and submitted
that One portion of house came into the share of Sh. Suminder Singh where
energy meter having account no YD16-1882P was installed stated to be 2nd Party
by clerical mistake and other portion without meter, came into the share of
Hargulab Singh.
Hence from the above, it is clear that the charged official verified the
site as per document produced by Sh. Manpreet Singh on the site and it had been
assumed by the charged official as per documents that it is divided property
between two brothers and hence there was no connection/energy meter located
on the divided premises, so fresh connection was given to the consumer Sh.
Manpreet Singh However half share of the defaulting amount for Rs 8207/- out of
total outstanding amount for Rs 16,414/ standing at undivided premises (Bada)
was got deposited by charged official on 20.04.2023 by personal efforts Thus no
loss caused to the Nigam on account of verification of site by the charged official.
Thus in view of above facts and material available on record, and verbal
submissions made by the charged official during personal hearing on 18.04.2023
and written statement dated 25.04.2023 it seems that allegations against the
charged official have not been fully proved, however in my opinion rather than
giving punishment to the charged official, a warning letter may please be issued
to him, to be remain more vigilant while dealing with the such like duties and
responsibilities in future
The above is submitted for orders to decide the charge sheet please”
The charge sheet has been decided by the competent authority
without considering the facts of the case as well as enquiry report of the enquiry
officer. Thus the punishment is in-fructuous and same is not maintainable in the
eye of law.
In view of above narrated facts, I have not committed any kind of
negligent act as alleged in charge sheet. It is therefore, very kindly requested to
consider the above facts and accept my appeal as well as said charge sheet may
please be dropped and I may kindly be exonerated from the alleged Charges.
It is also further requested that an opportunity of personal hearing
may please be provided so that the brief facts may be brought to your kind
Knowledge which may be helpful for deciding the appeal in the interest of nature
justice.
