Muhammad Aslam Sarwari, the father of petitioner was appointed
as Police Constable in Sindh Police. He died on 29.11.2011 during his
service from heart attack. The petitioner through instant petition seeks
his appointment in police department against deceased quota for the post
of Naib Qasid. It is case of the petitioner that Senior Superintendent of
Police, Sukkur declared his case for appointment against deceased quota
on same post as genuine but he has not been appointed for the said post
till date.
In response to petition, the respondents No.3 and 4 have filed
their comments, which reflect that the Range Scrutiny Committee under
the Chairmanship of the then DIGP Sukkur Range on 05.03.2021
scrutinized the case of petitioner along with other candidates for their
appointment against deceased quota for any post of Class-IV (other than
Naib Qasid) in wich case of petitioner was recommended for his
appointment as Malhi and forwarded to the IGP Sindh Karachi for further
approval from Home Department, Government of Sindh vide letter No.E-
II/2703-05 dated 11.02.2021. It further reflects that the IGP Sindh
Karachi vide letter No.11938-48/EB-III/T-7/DQ/2021 dated 05.11.2021
returned the case of petitioner (at Serial No.192) and other candidates
with the following remarks;-
i) The rules captioned as Sindh Police Shaheed, Deceased
invalidated or incapacitated Quota Recruitment Rules,
2021 have been notified after approval of Cabinet of
Sindh Government vide Notification dated 23.08.2021.
ii) The Special Provincial Recruitment Committee has also
been notified by the Home Department, Government of
Sindh who will conduct recruitment policy.

iii) The recommendations of Recruitment Committee(s) are
therefore returned to Range with the request to
maintain the lists of claimants of your respective Range
and place on record.
In view of above position, we dispose of this petition with consent
of learned counsel for the petitioner and with observation that as and
when the recruitment process is initiated in future the petitioner shall
apply for the appropriate post against deceased quota and his case would
be decided by the concerned authority in accordance with law and by
considering the Rule 4(4) of Sindh Police (Shaheed, Deceased,
Permanently Invalided or Incapacitated Quota) Recruitment Rules, 2021
for his age relaxation, as per Government Policy.
