COMMENT AND COMPLIANCE

COMES NOW, the undersigned counsel for the special purpose of posting
this comment and compliance and unto the Honorable Ombudsman most
respectfully avers:

1. That counsel received copies of Indorsements from the Office of the


Ombudsman and the Deped Regional Office respectively for a complaint from
XXXXXXXXXXXXXXXXXXXX against the former school principal of
CCCCCCCCCCCCCCCCCCCCCCCCCCC;

2. That the same were indorsed to the respondent teacher/school principal


for her Answer/Reply to the allegations against her;

3. That counsel likewise conducted a separate investigation with respect to


the said complaint, and that the allegations of the complainant are all bereft of
factual and legal grounds;
4. That all school heads as part of their school base management are
responsible for the securing the property of the school which includes,
school site titling and physical facilities management;

5. That CCCCCCCCCCCCCCCC on its part does not give any instruction


to encroach other private properties, infact, well settled from the records that
the school had been the declared owner for taxation purposes since 1973,
and that the actual lot data computation from the DENR shows that it is the
same area as reflected in the actual ground survey and that documents of the
school substantiating actual occupation in the concept of an owner has
clearly been established. Thus, it proceeded to the approval of the special
patent for Cawayan Elementary School.

6. That findings from an Investigation Report of the CENRO-DENR clearly


shows that there is no irregularity from the documents of the school and its
area which it occupies, and that complainant’s documents as proof of her
ownership could not established the same;

WHEREFORE, it is respectfully prayed that herein Comment and


Compliance of the undersigned counsel be taken consideration and be placed
in the records of the case;

WHEREFOREMOST, it is most respectfully prayed that the said complaint


against John Doe be dismissed as it devoids an iota of factual and legal
merit, and that special patent issued to Cawayan Elementary School remains
indefeasible and should not be subject to collateral attack.
