DEFERRED SENTENCING AGREEMENT
‘The District of Columbia, by and through its attomey, the Office of the Attomey General (“the District")
and Jamael Anthony Bowman (the “defendant") agree to a disposition of this matter in accordance with the
following terms and conditions:
|. The defendant agrees to enter a guilty plea to the following charge:
FALSE FIRE ALARM: did willfully and knowingly give a false alarm of fire,
in violation of D.C. Code § 22-1319(a).
2. The District and the defendant agree to continue sentencing for 3 months.
3. The District will not seck to have the defendant detained pending sentencing unless the defendant is
rearrested, in the District of Columbia, based on probable cause.
4. The District reserves the right to allocute at the defendant's sentencing.
5. The defendant shall personelly appear in court on the sentencing date, and on any interim review dates set
ty the court prior to the sentencing date, unless his presence is waived with consent by the Distriet and
Court.
6. The defendant affirms that the address listed in the Arrest/Prosecution report is his/her current mailing
address.
7. This agreement and/or the defendant's statements relating to this agreement may be used against the
defendant by the District: (1) for impeachment purposes at trial in the above-captioned case; (2) in
response to a motion to seal criminal records pursuant to D.C. Code § 16-801 et seq.; ot (3) in response to
any civil suit the defendant may file against the District of Columbia arising out of this incident.
8, ‘The defendant agrees to abide by the following conditions while awaiting sentencing:
a, The defendant must not violate any law or court order during the period of this agreement.
b. The defendant must not be arrested based on probable cause during the period of this agreement.
If the defendant is arrested, he/she must immediately, through counsel, notify the District.
Page 1 of 29. As part of the agreement and prior to the 3-month return court date, the defendant agrees to pay a $1,000
fine and $50 contribution to the Crimes Victims Compensation Fund at the Finance Office of the D.C.
Superior Court, located at 500 Indiana Ave. NW., Washington, DC 20001, and provide proof to the
District.
10. Within 2 weeks of entering this agreement, the defendant agrees to write and deliver a letter of apology to
the US Capitol Police Chief.
11, Termination of Agreement.
© If the defendant abides by all terms and conditions set forth in this agreement, the District of
Columbia witl not oppose the defendant's motion to withdraw the plea and will enter a nolle
_prosequi in the above-captioned case at the time of sentencing.
* Ifthe District of Columbia determines that the defendant has violated any term or condition of
this agreement (including making a false representation in this agreement), the District will:
> oppose the defendant's withdrawal of the guilty plea;
} notenter a nolle prosequi in this case; and
move the Court to proceed to sentencing immediately.
All parties to this agreement understand and agree that the determination of whether the defendant has
violated any of the terms or conditions of this agreement rests exclusively with the District of Columbia.
Defendant understands that he bears the burden of producing sufficient documentation prior to the
sentencing date to demonstrate (o the District that has met all terms set out in this agreement.
