MANIFESTATION
Oppositor Manuel Dumog, through the assistance of the Public
Attorney’s Office, by the undersigned counsel, and unto this Honorable
Court, most respectfully manifests that:
1. On July 7, 2020, the Honorable Court issued an Order directing
petitioners and oppositor to submit the judicial affidavits of their
witnesses within fifteen (15) days from said date or until July 22,
2020;
2. Herein oppositor duly complied with the above Order of this
Honorable court and filed his judicial affidavit together with the judicial
affidavits of his witnesses on July 21, 2020 furnishing copies to
petitioners’ counsel;
3. Then on August 12, 2020, oppositor received a copy of the
Supplemental Judicial Affidavit of Petitioner Candido G. Mina Jr.,
alleging among others that there is a need to file the same because
when he executed his affidavit on July 2, 2020, there is no opposition
yet;
4. It is respectfully submitted that petitioners should have submitted their
supplemental judicial affidavit within the prescribed date given by this
Hon. Court in an order dated July 7, 2020. The fact that he executed
his judicial affidavit at the time that there is no opposition is of no
moment since he was made aware of the opposition during the
hearing on July 7, 2020. Hence, they should have filed the
supplemental affidavit within fifteen days from July 7, 2020 as
ordered by the Hon, Court and not waited for twenty-two (22) days
after the oppositor submitted the judicial affidavit of his witnesses;
and
5. With the foregoing, oppositor humbly request the Hon. Court that the
Supplemental Judicial Affidavit filed by Petitioners be not admitted as
part of the records of the case.
WHEREFORE, premises considered, it is respectfully prayed that this
Manifestation be noted by the Honorable Court.
Respectfully submitted.
Other reliefs, just and equitable under the circumstance are likewise
prayed for.
