ዒIቭዘጵያ ዒሕፃ Aጅ ETHIOPIAN BUILDING PROCLAMATION
ዒሕቝ ገኄቭኇ ዙህኄቭ Eዛረዴዱጉ ጤማዞ WHEREAS, it has been found necessary to
ረዶ ዒሕፃ ዶቛቫ ወም ዒሕፃ ዶቛቫ determine the minimum national standard for the

ቘIቭዘጵያ ዝራላ ዛሞኡራሲያ WHEREAS, sub-article (3) of Article 51 of the
ሪፐቝጦኡ ሕዱ መዶሥቭ Aቀጽ $1 Uስ Aቀጽ Constitution of the Federal Democratic Republic of
/3/ ዒ ዙ ራል መዶሥቩ ዒገኇ ዒቭምህርቭ Ethiopia empowers the Federal Government to
Eዛሁም ዒሳ ስኇ ቬኡኊጪያ ሀዱር Aቀ establish and implement national standards and basic

NOW, THEREFORE, in accordance with Article
55 (1) of the Constitution of the Federal Democratic

Republic of Ethiopia it is hereby proclaimed as

2. Definitions
In this Proclamation, unless the context otherwise
2. ቭርጓሜ
requires:
ዒቃጥ Aዱቛቝ ዒቨጤዒ ቭርዲም ዒሚያሰጄኹ ኟል
ጣኄ ቘስቨቀር ቘዄህ Aጅ ኹስጉ 1/ “Ministry” means the Ministry of Works and
Urban Development;
1/ “ሚኆስቬር” ማጤቭ ዒሥራኇ ኜቨማ
ልማቭ ሚኆስቬር ኄኹ 2/ “building” means a permanent or temporary
construction used for the purpose of dwelling,
2/ “ሕፃ” ማጤቭ ጤመኊሪያ ጤቚሮ ጤ ቝሪኟ office, factory or for any other purpose;
ወም ጤማኇተኹም ሌላ Aዱልዶጪቭ
ዒሚኹል ቋሚ ወም ዳያ ዶቛቫ ኄኹ 3/ “building officer” means a person appointed by
an urban administration or designated organ to

ወም ቘቨ ሰዒመ Aኟል ዒቨሾመ ሰኹ 4/ “a registered professional” means a person who
ኄኹ is issued with a certificate as a design or
construction professional or a juridical person
4/ “ዒቨመዂዱቘ ቛጤሙያ” ማጤቭ ሥልጇ ቛጤኹ which is issued with a certificate as a design or
Aኟል ቨመዶ ቘዛዅ ወም ቘኢስቭራ construction consultant by the relevant body;
ኡሽ ዒቛጤሙያኄቭ ዒምሥኡር ወረቀቭ ዒቨሰ
ጄኹ ሰኹ ወም ቘዛዅ ወም ቘኢስቭ
ራኡሽ ዒAማኟሪኄቭ ዒምዱቛ ምሥኡር ወረ 5/ “a registered contractor” means a juridical
ቀቭ ዒቨሰጄኹ ዞርጅቭ ኄኹ person who is registered and issued with a work
permit by the relevant authority as a contractor;
5/ “ዒቨመዂዱቘ ዒሥራ ቨቋራ” ማጤቭ
ሥል ጇ ቛጤኹ Aኟል ቨመዶ ዒሥራ
ቨቋራ ኄቭ ዒምዱቛ ዒምስኡር ወረቀቭ 6/ “category ‘A’ building” means a one story
building with a span of 7 meters or less
ዒቨሰ ጄኹ ዞርጅቭ ኄኹ
between two reinforced concrete, steel or other
structural frames or any dwelling house not
6/ “ምዞቝ ‘ሀ’ ሕፃ” ማጤቭ ቘሁጤቭ ዒኢኡሪቭ
exceeding two stories;
ወም ዒቝረቭ ወም ሌጪት ስቭራኡተራል
ኹቅሮት መኟኜል ያጤኹ ርቀቭ 7 ሜቭር
ወም ኜዄያ ቘቫት ዒጣኄ ቛጤAዞ ቅ
ሕፃ ወም ማኇተኹም ኜሁጤቭ ቅ ቘቫት
7/ “category ‘B’ building” means a building with
ዒጣኄ ዒዶል መኊሪያ ቜቭ ኄኹ a span of more than 7 meters between two
reinforced concrete, steel or other structural
7/ “ምዞቝ ‘ለ’ ሕፃ” ማጤቭ ቘሁጤቭ ዒኢኡሪቭ
frames or of two or more stories not covered in
ወም ዒቝረቭ ወም ሌጪት ስቭራኡተራል
category ‘C’ or a real estate development of
ኹቅሮት መኟኜል ያጤኹ ርቀቭ ኜ7 ሜቭር category ‘A’;
ቘላ ዒጣኄ ወም ቛጤሁጤቭ ቅኇ ኜሁጤቭ
ቅ ቘላ ዒጣኄኇ ቘምዞቝ ‘ሐ’ ዒማሸ 8/ “category ‘C’ building” means any public or
ሕፃ ወም ቘምዞቝ ‘ሀ’ ዒቨመዙቘ institutional building, factory or workshop
Eዙሪል ስቬቭ ያጤ ዒቜቮት ልማቭ ኄኹ building or any building with a height of more
than 12 meters;
8/ “ምዞቝ ‘ሐ’ ሕፃ” ማጤቭ ዒሕቝ መዱልዱያ
ወም ቨቋም ኄኡ ሕፃ ዒ ቝሪኟ ወም
ዒወርኡሾ ሕፃ ወም ኜመሬቭ Eስኜ 9/ “construction” means the construction of a new

ቘላ ዒጣኄ ማኇተኹም ሕፃ ኄኹ building or alteration of its use;
9/ “ዶቛቫ” ማጤቭ Aዛስ ሕፃ መዱቛቭ 10/ “dangerous building” means a building that is
ወም ኄቛር ሕፃ ማሻሻል ወም structurally unsafe or constitutes a special
fire hazard or health risk;

0/ “Aስዳ ሕፃ” ማጤቭ ዶቛቫኹ Aስቨማማኑ
ያልጣኄ ወም ቘኜ ቨኛ ዙረዬ ጤEሳቭ Aዙዴ 11/ “designated organ” means an organ appointed by the
ዒቨዴጤጄ ወም ጤገኇ ጄቅ ዒጣኄ ሕፃ concerned Regional State to enforce this

which this Proclamation is applicable;
01/ “ዒቨሰዒመ Aኟል” ማጤቭ ህ Aጅ ኜኜ
12/ “document” means any plan, report, estimate
ቨማ ኡልል ኹጎ ቨ ጻሚ ቘሚጣቘቭ
or any other technical presentation required
ዳ Aዪ Eዛያስ ጽም ቘኡልጥ or prepared in connection with the design and
ዒሚሰዒም Aኟል ኄኹ construction of a building;
02/ “ሰኄዞ” ማጤቭ ኜሕፃ ዛዅኇ ዶቛቫ ዴር 13/ “private dwelling building” means a house
ቘቨያያዂ ዒሚያስ ልዶ ወም ዒቨዂዴዩ containing one or more habitable rooms with
ላ ሪ ርቭ ዒዴ ዶምቭ ወም ማኛ sanitary and cooking facilities for the use of a
ኹም ዒቬኡኆኡ ዲዜ ዒሚያስረዜ ሰኄዞ single family and may include any garage
ኄኹ and other domestic outbuildings within its
site;
03/ “ዒዶል መኊሪያ ሕፃ” ማጤቭ ጤAዞ ቜቨሰቝ
መኊሪያኄቭ ዒሚያዱጤዶጥ Aዞ ወም
ኜAዞ ቘላ ኡ ጪትኇ ዒመ ዜዬኇ ዒማቝሰያ 14/ “person” means any natural or juridical

person;

15/ “plan” means any drawing or model showing

04/ “ሰኹ” ማጤቭ ዒቨ ጉሮ ሰኹ ወም structural, sanitary, electrical, mechanical,
ቘሕዶ ዒሰኹኄቭ መቝቭ ዒቨሰጄኹ Aኟል fire protection and other drawings;

05/ “ ላ” ማጤቭ ዒAዞ ሕፃ መጄ ዓኄ 16/ “Regional State” means any regional state
ቭኇ ስ ቭ Eዛሁም ሕፃኹ ዒሚሠራቘቭ established in accordance with Article 47 of
ቁሳቁስኇ ዒAዱኄቛቝ ዂዝ ዒሚያሳ ዞ the Constitution of the Federal Democratic
ወም ሞዝል ሲጣ ዒAርኡቬኡተር ዒስቭ Republic of Ethiopia and includes the Addis
ራኡተር ዒሳኆቨሪ ዒኤሌኡቭሪኟል ዒሜኟ Ababa and Dire Dawa city administrations;
ኆኟል ዒEሳቭ መኜላኜልኇ ዒሌጪት
ሥራኺት ዞ ጦያኟቭቭ ትላል 17/ “stop order” means any order given by a
building officer or by a building inspector to
06/ “ኡልል” ማጤቭ ቘሕዱ መዶሥቩ discontinue activities on a building
Aቀጽ #7 መሠረቭ ዒቨቋቋመ ኡልል construction site;
ሲጣ ዒA ዛስ Aቘቛ ኜቨማ Eኇ
ዒዞሬዜ ኜቨማ Aስቨዜዙሮት 18/ “story” means that part of a building which is
ጨምራል situated between the top of any floor and the
top of the floor next above it, or if there is no
07/ “ዒማስቆሚያ ቭEዅ” ማጤቭ ቘAዞ ዒሕ floor above it that portion between such floor
ፃ ዶቛቫ ቫ ዒሚኟጡዞ ሥራ Eዛቋ and the ceiling;

19/ “urban administration” means an organ to
ወም ቘሕፃ ቨቆጇጇሪ ዒሚሰጉ ቭEዅ
which powers and duties of administering an
ኄኹ urban center have been given by law or
delegated by the concerned government
08/ “ ቅ” ማጤቭ ቘሁጤቭ ወጤጪት መኟኜል body;
ወም ኜላ ሌላ ወጤል ኜሌጤ ቘወጤጥኇ 20/ “urban center” means any locality having a
ቘኰርኆስ መጠል ያጤኹ ዒሕፃ ኡ ል municipal administration or a population size
ኄኹ of 2,000or more inhabitants, or which at least
50% of its labour force has, primarily,
09/ “ዒኜቨማ Aስቨዜዙር” ማጤቭ ቘሕዶ engaged in non –agricultural activities.

ሥልጇኇ ቨዶ ቛር ዒቨሰጄኹ Aኟል 3. Scope of Application
ኄኹ
1/ This Proclamation shall apply to:
!/ “ኜቨማ” ማጤቭ ማዂዴዬ ቜቭ ዒቨቋቋመ
ቘቭ ወም 2ሺ ወም ኜዄያ ቘላ ዒሕ
a) urban centers that have 10,000 or more
ቝ ቁጉር ያጤኹኇ ኜዄህ ኹስጉ ቚያስ
dwellers;
$ ቘመቮ ዒሚጣኄኹ ዒሰኹ ኃል
ኜዶቝርኇ ኹ ቘጣኄ ሥራ ዒቨሰማራ b) other urban centers that have less than

ጣኊ ዒሚዱኑ ቘቭ Aኟቛቚ ኄኹ፡፡ 10,000 dwellers and to which this
Proclamation shall be applicable in
3. ዒቨ ጻሚኄቭ ወሰ accordance with the decision made by the
Regional State concerned;
1/ ህ Aጅ ቘሚኜቨጥቭ ላ ቨ ፃሚ
ጣኇል c) public buildings, or buildings which could
be used for industrial or commercial scale
ሀ/ 0ሺ Eኇ ኜዄያ ቘላ ኄሪኺት ቛጫ agricultural occupancy or real-estate out
ተኹ ኜቨሞት side of urban centers.
2/ This Proclamation may not apply to any
ጤ/ ዒኄሪኺታተኹ ቁጉር ኜ0ሺ ቘቫት
building:
ቘጣኄኇ ቨ ፃሚ Eዛጣቛተኹ ቘሚ
መጤኜቨኹ ኡልል ቘሚወሰኅ ሌጪት a) completed on or before the effective date
ኜቨሞት of this Proclamation;
ሐ/ ኜኜቨማ ኹ ቘሚዱኍ ህቝ b) which is under construction with a
ዒሚዱ ጤዱልቛተኹ ሕፃኺት building permit issued before the effective
ዒIዚስቭሪ ወም ዒዂመኇ Eርሻ date of this Proclamation;
ቨቋሞትኇ ዒሪልስቬቭ ሕፃኺት፡፡
c) exempted by the decision of the Council
2/ ህ Aጅ ቘሚኜቨጥቭ ላ ቨ ፃሚ of Ministers for reasons related with
Aጣም national security and other purposes.
ሀ/ Aዪ ቘ ኇቘቭ ቀ ወም ኜዄያ 3/ Notwithstanding the provisions of sub-article
ቘ ቭ ቘቨጄኇቀቀ ሕፃ 2(b) of this Article, the urban administration or
the designated organ may apply this
ጤ/ Aዪ ኜ ኇቘቭ ቀ ቘ ቭ ቘቨሰጄ Proclamation to:
ዒሕፃ ዶቛቫ ቃዞ ቘመኟጡዞ
ላ ቘሚዱኑ ቘማኇተኹም ሕፃ a) a building under construction with a build-
ing permit issued before the effective date
ሐ/ ኜሀዱር ዙህኄቭ ዴር ቘቨያያዂ Eኇ of the Proclamation if such construction is
ቘሌጪት ምኡያቮት Aዪ ቨ ፃሚ not completed within three years of the
Eዜጣቘቭ ቘሚኆስቭሮት ምኡር effective date of the Proclamation;
ቜቭ ቘሚወሰ ሕፃ፡፡
b) in order to ensure the compliance of a

building for which alteration of service is

sought to render;

ዒሕፃ ዶቛቫ ቃዞ መሠረቭ c) a building to which a renovation is

ዒጄቘቀ መጣኅ ጤማረዴዱጉ 4. Submission of Application and Plans
1/ Any person intending to carry out construction
ሐ/ ዒEዞሳቭ ቃዞ ጉያቄ ቘሚቀርቝጤቭ
ህፃ ላ
shall submit an application to the urban
ዒኜቨማኹ Aስቨዜዙር ወም ዒቨሰዒመኹ
administration or designated organ.
Aኟል ህ Aጅ ቨ ጻሚ Eዛጣቘቭ
ማዞረዶ ትላል፡፡
4 6)&7 2/ The application to carry out construction shall
be made on an application form prepared by the
urban administration or designated organ and
ኡ ል ሁጤቭ
shall consist of a design and report according to

the category of building in question.
4. ማመልኜታኇ ላ ስጤማቅረቝ 3/ The application shall be accompanied with a
reference to main roads and names of

4/ The applicant shall submit proof of possession

ኺት ዒሚዱኍ ኇ መዱዟትኇ ዒቫወቁ 5. Planning Consent
ቫኺት ስም ዒሚዱል መረዬኺት
መቅ ረቝ ኊርቛተል፡፡
1/ Any person intending to carry out construction
4/ Aመልኟቱ ሕፃ ቘሚዱኄቛቘቭ ቫ shall secure a planning consent prior to

1/ A building officer shall check submitted plan

ማመልኜታ ኜማቅረ Aስቀዞሞ ዒ ላ Approval of plans shall not be withheld on

Proclamation or other laws.

2/ A building officer may approve plans with
comments provided that the comments refer to

ቘዄህ Aጅኇ ቘሌጪት ሕዷት
ኜቨመጤኜቩቭ ዞዴድኺት ዴር ዒቨጇጇመ 3/ Approved plans shall be stamped
“APPROVED” and shall bear a registration
መጣኅ ማረዴ ዱጉ ኊርቘቫል፡፡ ቘዄህ
number and date of approval and shall be

signed by a building officer.
መመዂኛኺት ምኡ ያቭ ቘማዞረዶ
Aዞ ላ Eዜ ዞቅ ማዞረዶ 4/ Application forms submitted with approved
Aትልም፡፡ plans shall be stamped “APPROVED” in the

appropriate space provided and shall bear a
registration number and date of approval.
Comments, if any, shall be entered on the form

6/ A copy of the signed and sealed application
4/ ኜ ዙቀኹ ላ ዴር Aቝረኹ ዒቀረቭ form and approved plans shall be permanently
ዒማ መልኜታ ቅ ት ቘቅ ት ኹስጉ ጤዄሁ displayed at the building site. All original
ቨቝጪ ቘቨዂዴዩኹ ኡ ቭ ቫ ላ approved application forms and plan shall be
“ ዞቋል” ዒሚል ምልኡቭ ቨዙርጐቛተኹ kept in good condition and presented at any
ዒምዱቛ ቁጉ ርኇ ዒ ዙቀቘቭ ቀ time, before and during construction, upon the
ሠ ርቛተል፡፡ Aስቨ ያዒቭ ኟጤ ጤዄሁ request of the urban administration or
ቘቨዂዴዩኹ ኡ ቭ ቫ ላ ሰ ሮ ቘሕፃ designated organ or the building officer or an
authorized inspector.

ዒቨያያ ዂኹ ላ Aዞ ቅጅ ጤAመልኟቱ submitted and approve or reject within the time
መጤስ ጤቫል ሌላኹ ቘኜቨማኹ limit. The time limit shall be determined by
Aስቨዜዙር ወም ቘቨሰዒመኹ Aኟል Regulation to be issued for the implementation of
ዂዞ ቀመጇል፡፡ this Proclamation.

9. Construction Permit
ዒቨጇሰኹ ዒህዲ ዞዴድ ቘAሩ
መዶጤ ኊርቘቫል፡፡ Aስ ላዳ ጣኊ A plan which has been approved in accordance with
ኜቨዱኌ ቨጨማሪ ማቝራሪያኺት ቘቨጤዒ Article 6 of this Proclamation shall constitute a
ወረቅቭ ቘመፃ ማያያ ትላል፡፡ construction permit.
3/ ቘሕፃ ሹሙ ኹዞቅ ዒቨዙረዱ
10. Validity Period of Plans
ማመልኜታኇ ላ “ኹዞቅ ቨዙርጓል”
ዒሚል ምልኡቭኇ ቀ Eዛሁም ዒሕፃ 1/ The validity of approved plans shall expire after
ሹሙ ርማ ሠ ርቘቫል፡፡ six months from the date of issuance where
construction work has not been started.
4/ ዒቀረቘኹ ላ ኹዞቅ ሲዙረዶ ዒሕፃ
ሹሙ ርማ Eኇ ማህቨም ያረ ቘቭ
ማመልኜታ Aዞ ቅጅ Eኇ ዒ ላኅ ሁጤቭ 2/ The validity of approved plans with which
ቅያኺት ጤAመልኟቱ ዒሚመጤስ ሲጣ construction work has been started within six
ዒህፃ ሹሙ ርማ Eኇ ማህቨም ያረ ቘቭ months from the date of issuance shall expire
ዒማመልኜታ ቅ Aዞ ቅያ ቘኜቨማኹ after five years from the date of issuance, if the
Aስቨዜዙር ወም ቘቨሰዒመኹ Aኟል construction work has not been completed.
ዂዞ ቀመጇል፡፡
3/ Upon expiry of the validity period as set out in

sub-articles (1) or (2) of this Article an
application for extension of the validity period

11. Building Officers
1/ ዒዶቛቫ ሥራኹ ኟልቨዩመረ Aዞ
ዒ ዙቀ ላ ዒሚ ኇቘቭ ዳ ዒሚያቘቃኹ 1/ Every urban administration or designated organ
ላኅ ኜ ዙቀቘቭ ቀ ዩምሮ ስዞስቭ ወር shall appoint a building officer, with the
ኟቘቃ ቘኋላ ጣኇል፡፡ required educational and professional
qualifications to enforce, on its behalf, the
provisions of this Proclamation and other laws.
2/ ዒዶቛቫ ሥራኹ ላኅ ኜ ዙቀቘቭ ቀ

Aምስቭ ዓመቭ ኟቘቃ ቘኋላ ጣኇል፡፡ after ascertaining full compliance with this
Proclamation and other laws.
3/ ቘዄህ Aቀ Uስ Aቀ /1/ ወም /2/
ቘቨዱጤ ኹ መሠረቭ ላ ቮ ዒሚቆ
3/ A building officer shall inspect all buildings
ቘቭ ዳ ሲያቘቃ ዳኹ Eዛራዂም ቘዄህ under the territorial jurisdiction of the urban
Aጅ መሠረቭ ላኅ Eዙዱኇ ዒማ ዙቅ administration or designated organ to ascertain
ጉያቄ መቅረቝ ኊርቘቫል፡፡ conformity with this Proclamation and other
laws.
01. ዒሕፃ ሹም
1/ Eያዜዚ ዒኜቨማ Aስቨዜዙር ወም ዒቨ 4/ A building officer may be assisted by staff of
ሰዒመኹ Aኟል Aስቨዜዙሩ ወም Aኟጥ the urban administration or designated organ in
ቘመወኜል ዒዄህ Aጅኇ ዒሌጪት the discharge of his duties; provided, however,
ሕጐት ዞዴድኺት ጤማስ ም that he shall be responsible for the ruling on
ዒሚያስትል Aስ ላዳኹ ዒቭምህርቭኇ applications for approval of plans and
inspection reports.

5/ A building officer is empowered to order
inspection of exempted buildings erected before

ኹስጉ ያጥ ሕፃኺት ኜዄህ Aጅኇ error; provided, however, that he must have
ኜሌጪት ሕጐት ዴር ዒሚሰማሙ adequate justification for ordering such
መጣኇተኹ ጤማረዴዱጉ ቁጉጉር rectification work.

7/ Without prejudice to his criminal liability, the

body shall make good the damage incurred by

ምኡያቭ ቘAዶቛ ቛጤመወጇቭ ቘሶስቨኛ or an approved person to carry out duties in
connection with review of plans for which he is

incapable of undertaking fully or partially.

ዞዴድኺት መሠረቭ ቘዶል ቨጄያቂ 2/ A building officer shall make written

13. Appeals
02. ኹኡልኇ 1/ Each urban administration or designated organ
shall establish a board of appeal which shall

hear, and decide on, decisions taken by building

1/ A Building officer may order a building

Aኟል ዒ ዙቁቭ ወም ኹዞቅ ዒቨዙረ demolished, if the plans utilized to construct
ዲቭ ሰኄዟት ቘህፃ ሹሙ ስም ሰጇል፡፡ such building does not comply with the
provisions of this Proclamation or other laws.
4/ ላኊት ጤመዱምዱም ዒሚሰጄኹ ኹኡልኇ
2/ In the event that the owner of a building who
ዒቁጉጉር ቨዶቛራቭም Eስኜማኜኇወ has been ordered by a building officer to
ዞረስ ጦሰ ትላል፡፡ demolish or remove his building fails to comply
with the order, the urban administration or
03. ስጤ ዶቛኑ designated organ may demolish or remove the
building and claim the incurred expenses from

approved plans, and may suspend all works on

15. Notice

1/ A person who has an approved plan for

ያዙርዴል፡፡ category “B” or “C” shall give notice to the
concerned building officer indicating the time
2/ ቘህፃ ሹም ህፃኹ Eዛያ ርስ ወም within which the construction is to be carried
Eዛያኄሳ ዒቨሰጄኹ ቭEዅ ዒህፃኹ out.
ቛጤ ቜቭ ያላኜቘረ Eዙጣኄ ዒኜቨማኹ
Aስቨዜዙር ወም ዒቨሰዒመኹ Aኟል 2/ The time within which a building officer may
ህፃኹ ቘማ ረስ ወም ቘማሳቭ decide on the notice given in accordance with

4 6)'2 3/ A building officer may require additional notices
to be given according to the type and

4/ A person who has received an order from a

1/ An urban administration or a designated organ
1/ ቘምዞቝ ‘ጤ’ ወም ‘ሐ’ ሥር ዒሚወዞቅ shall issue special identification badges to

ዶቛቫኹ ዒሚኟጡዞቘቭ ዳ ዒሚያሳ under their supervision.
ማስቫወቂያ ጤሚመጤኜቨኹ ዒህፃ ሹም
ማቅረቝ ኊርቘቫል፡፡
2/ Inspectors carrying an urban administration’s or
a designated organ’s badge identifying them
2/ ቘዄህ Aቀጽ Uስ Aቀጽ /1/ መሠረቭ shall be permitted access to any building
ቘቀረቘ ማስቫወቂያ ላ ህፃ ሹም ዒሚሰ completed or under construction at any working
ጄኹ ኹሳኈ ዒዳ ዱዙቝ ህ Aጅ ጤማ hours.

ዒAሠራር ሁኈቫ ቨጨማሪ ማስቫወቂያኺት 3/ Inspectors may issue stop orders, with regard to
Eዛቀ ር መጄዒቅ ትላል፡፡ Eዙዄህ construction not conforming to this
Aኄቭ ሁኈቫ ሲያዴጉም ማስቫወቂያኹ Proclamation or other laws. Stop orders shall
ዒሚቀርቝ ቘቭ ዳኇ ዒሥራኹ ዙረዬ be made on inspection report form.
ቘዶል ቨቀምጊ ጤAመልኟቱ ኜ ዙቀኹ
ላ ዴር ቘ ሁ Eዛዙርሰኹ
4/ A building officer shall specify the period

demolition of works not conforming to this

ላጤመቀቘል Eዙቘቂ ምኡያቭ ጣኊ be submitted for review, a plan review fee shall
ጦቆጄር ትላል፡፡ be paid. Such fee shall be determined by
Regulation to be issued for the implementation
of this Proclamation.
3/ ዒህፃ ሹም ቘሥራ ላ ዒጤ ወም
ጦኹል ዒቫቀዙ ቁሳቁስ ቘቨመጤኜቨ
2/ Plan review fees shall be charged on the basis
ዒጉራቭ ምርመራ ምስኡር ወረቀቭ of total gross floor area of one unit of each type

08. ዒህፃ መጄቀሚያ ቃዞ
1/ ቘምዞቝ ‘ሐ’ ሥር ዒሚመዙቝ Aዛስ 3/ A plan review fee shall be paid at the time of

20. Plan Approval Fees
1/ A building officer shall charge fees for the

22. Refund of Fees
ዒወጤል Aጄቃላ ሥ ቭ መሠረቭ
ቘማዞረዶ ጣኇል፡፡
1/ A building officer may, upon a request in writing
3/ ዒ ላ መዱምዱሚያ ኡ ያ ዒሚኜ ጤኹ by the applicant, authorize the refund of fees

23. Fines

1/ An urban administration or a designated organ

ወም ማሻሻያ ሥራ ላ ጤማ ዙቅ who violate the provisions of this Proclamation.
ኡ ያ ያስኜ ላል፡፡ ዒኡ ያኹ መጄ ህ The fine shall be determined by Regulation to

2/ ቨዙዴዴሚ ወጤጪት ወም Aሀዟት 2/ The payment of fines may not relief the offender

with this Proclamation.

ቘቨሰዒመኹ Aኟል ኜሚወሰዚ ቨጨማሪ of or after demolition of a building leave it in
Eርምዬኺት ኄፃ Aያዙርዱኹም፡፡ a condition dangerous to the public or any
adjoining property.
!4. ዳያ ዶቛቫኺት
6/ Notwithstanding the provisions of sub-article
Aመልኟቱ ቘዳያ ዶቛቫኄቭ ያሳወቀኹ (1) of this Article, prior written consent from
ዶቛቫ ጤማኟጡዞ ማመልኜታ ያቀረቘ Eዙጣኄ the appropriate government organ shall be
required before repairing or extending

buildings of historical value.

ጦሰጄኹ ትላል፡፡ 26. Employment of Registered Professionals
!5. ዒAዱልዶጪቭ ጤኹጉ ስጤማዞረዶ 1/ A person intending to erect a building shall
ስጤማስ ቭ Eዞሳቭ ወም ጉዱኇ employ a qualified registered professional for
ስጤማዞረዶ Eኇ ስጤማ ረስ each type of design required for the category
of the building and retain their services for
the purpose of supervising the erection
1/ ዒህፃ ሹም ኜዄህ Aጅ ዴር thereof. The details shall be determined by

2/ Upon completion of building works, a

ዱቛል፡፡
1/ A person intending to erect a building shall

from any defective work due or negligence.
6/ ዒዄህ Aቀ Uስ Aቀጽ /1/ ዞዴድ The form and the amount of the guarantee to
ቚኊርም ዒቫሪኟ ቅርስኄቭ ዴ ያላተኹ be produced for each category of building
ህፃኺት ኜመጄዱ ወም ኜማስ ቭ shall be determined by Regulation to be

!6 ዒቨመዂዱ ቛጤሙያኺት ስጤመቅጄር
28. Responsibility of Contractors and Registered
Professionals
1/ ጤማኛኹም ህፃ ህፃኹ ጤሚዱኑቘቭ
ምዞቝ ዒሚጄዒቁ ዒዛዅ ዓኄቮት 1/ Without prejudice to his criminal liability,
ጤዒሥ ራኹ ቘሚመጉኅ ዒቨመዂዱ any registered professional, contractor or sub
ቛጤሙያኺት መሰራቭ ኊርቛተል፡፡ contractor shall be liable for any damage he
ርሩ ህ Aጅ ጤማስ ም causes to his employer in accordance with the
ቘሚወጇኹ ዙቝ ወሰ ኇል፡፡ ዒህፃኹ provisions of the Civil Code due to his

be responsible for the workmanship of the

designed according to acceptable building

38. Sewerage

Aኟል ቨቀቛኄቭ ቛጤኹ ዒህፃ ዛዅ
ዙቝ መሠረቭ ጉኟሬ ቨዙላዞጪ 1/ Where in respect of any building a suitable

2/ Where any person has not any suitable sewage

ቘሌጤቘቭ ቫ ሌጪት ቆሻሻ ማስወዱዬ ዂዝኺት
ጉቅም ላ Eዛኹጥ ዒኜቨማኹ Aስቨዜዙር Water may not be taken from a supply system for
ወም ዒቨሰዒመኹ Aኟል ጦ ቅዞ ትላል use by any fire fighting installation, unless:
ጣኊም አሚኟል ወም ዶ ቆሻሻ ማስወዱዬ
ቘሚኊርቘቭ ዳ ቆሻሻኹ ኜEቃኹ ጤማስወዱዞ 1/ the use of such fire protection installation and

prescribed by the urban administration or

ዒሚያመኄ ማኛኹም ዶቛቫ ዒዙረቅ ቆሻሻ
47. Application of the Criminal Code
ማኜማታ ዒሚቀመጉቘቭ ቘቂ ቫ ጦኊረኹ
ዱቛል፡፡ 1/ Offences committed by government officials and
other civil servants who are entrusted with the
power of issuing construction work permits for
construction works, or offences committed by
registered professionals, contractors or by building
owners in contravention of the provisions of this
Proclamation shall be punishable in accordance
with the provisions stipulated under this part.

2/ Notwithstanding the provisions of sub article
(1) of this Article, the provisions of the
ኡ ል Aምስቭ General Part of the Criminal Code relating to
Eሳቭ መኜላኜልኇ ዒEሳቭ ማጉ ያ ቨኜላ the commission of a crime and the sentencing
thereof shall be applicable for crimes

48. Improper Granting of Work Permit
ቛጤኹ ዒEሳቭ መኜላኜያ ዛዅ መስ ርቭ
መሠረቭ ዒEሳቭ Aዙዴ ጦቋቋምኇ ዒEሳቭ 1/ A building officer, or any other person who is
Aዙዴ ቚኜሰቭ ቘቨጄቃሚኺትኇ ቘAኟቛቚኹ vested with the power of granting permit for
ላ ዒሚዙርሰኹ Aዙዴ ጦቀስ ቘሚትል construction works intentionally :
መልኡ ዛዅ ጦዙረዶኇ ጦዱኄቛ ዱቛል፡፡
#5. ስጤEሳቭ ማጉ ያ ቨኜላ a) grants construction work permit to a person
who has no legal possession on the land on
which the building is to be constructed; or
ቃዞ ቨዱኑቮ ዒቨቨኜጤ ማኛኹም ዒEሳቭ
ማጉ ያ ዒኜቨማኹ Aስቨዜዙር ወም
ዒቨሰዒመኹ Aኟል ኜዂረዴኹ ዒኹጠ መስመር b) grants construction work permit to a person
ኹሀ መጄቀም ትላል፡፡ ጣኊም ዒኜቨማኹ whose documents supporting the application
Aስቨዜዙር ወም ዒቨሰዒመኹ Aኟል Aስ ላዳ are illegal or falsified; or
ጣኊ ዒቨዱኌኹ ቅዞመ ሁኈቫ ቘማስቅመጉ
Eዛህ ያጤኹ ዒEሳቭ ማጉ ያ c) grants an occupancy permit to a person
whose building design or the construction
1/ ኜሌላ Aማራ ዒኹጠ መስመር ወም thereof is not in compliance with the relevant
plan of the urban center in which such a
building is to be constructed;
is punishable with rigorous imprisonment from
2/ ቘኜቨማኹ Aስቨዜዙር ወም ቘቨሰዒመኹ five years to ten years and a fine not less than birr
Aኟል Eምኄቭ ቘገኇ ላ ትዶር ten thousand and not exceeding fifty thousand birr.

ቃቀም ኜኜቨማኹ Aስቨዜዙር ወም ኜቨሰ
ዒመኹ Aኟል መስ ርቭ ዴር ዒሚስማማ
1/ Any building officer or other public servant or any
መጣኅ ኟልቨረዴዱጄ other person under contractual agreement, who is
entrusted with supervising a building under
2/ ጤኜቨማኹ Aስቨዜዙር ወም ጤቨሰዒመኹ construction in accordance with this Proclamation,
Aኟል ቘቅዞሚያ ማመልኜታ ቀር ቃዞ intentionally refrains from stopping or causing the
ኟልቨሰጄ stoppage of the construction of a building the
illegality of which he knows or should have
ጦኜኇወ Aትልም፡፡ known shall be punishable with rigorous
imprisonment from five years up to ten years and
with a fine not less than birr ten thousand and not
exceeding fifty thousand birr.

Eኇ ህኅ Eዛያኜኇኹኅ ጠላ ኄቭ A building officer or any other public servant
ቘቨሰጇተኹ ሌጪት ዒመዶሥቭ ሠራቨኒት vested with the power of the building officer, or
ቘቨመዂዱ ቛጤሙያኺት ወም ሥራ who is in charge, at any level, of issuing any
ቨቋራጒት Eዛ ሁም ቘዶቛቫ ቛጤቜቮት document under his authority, with intent to
ዒሚ ሙ ጉ ቮት ቘዄህ ኡ ል ኹስጉ obtain an advantage, directly or indirectly, from
ቘቨመጤኜቨኹ መሠረቭ ወሰኇጥ፡፡ any person interested in a matter brought to his
attention by reason of his responsibility, or to

ቨ ፃሚኄቭ ዒቨጄቘቀ ኄኹ፡፡ abuses the interested party contrary to law, or
accepted office practices, is punishable with

construction of buildings thereon, with intent

ጇም ዒዶቛቫ ጉያቄ ዒዶቛቫ ቃዞ certified in a document, or contrary to
ዒሰጄ ወም ቘዄህ መሠረቭ ጤቨኜኇወኄ the fact which is evidenced by such
ዶቛቫ ዒመጄቀሚያ ቃዞ ዒሰጄ document; or
Eዙጣኄ
ኜAምስቭ ዓመቭ Eስኜ Aሥር ዓመቭ ቘሚዙርስ b) omits to declare or refrains from
ኅ Eሥራቭ Eኇ ኜቝር Aሥር ሺህ ቘማያስኇ procuring a substantial fact contained in
ኜቝር ሀምሳ ሺህ ቘማቘልጉ ዒዱዂቝ መቀጒ a document which is capable of altering
ቀጇል፡፡ the decision to be rendered;
is punishable from five years to ten years

found to have built a building the type of which
Eሥራቭ Eኇ ኜAሥር ሺህ ቝር Eስኜ ጠምሳ
should not have been performed by the qualified
ሺህ ቘሚዙርስ ዒዱዂቝ ቅጇቭ ቀጇል፡፡ level issued to him by the relevant body or a
person, without having any qualified license, is
2/ ቘዄህ Aቀጽ Uስ Aቀጽ /1/ ዒቨመጤ found to engage in construction the kind of which
ኜቨኹ ጉ ቭ ዒቨ መኹ ቘተልቨኑኄቭ should have be performed by qualification, is
ዒጣኄ Eዙጣኄ ቅጇቩ ኜAዞ ዓመቭ Eስኜ punishable with rigorous imprisonment from five
Aምስቭ ዓመቭ ጦዙርስ ቘሚትል years up to ten years and with a fine from five

ቘመወኜል Eዛሰራ ኃላ ኄቭ ዒቨሰጄኹ ሌላ who is issued with a work permit by the
ዒመዶሥቭ ሠራቨኛ ወም ቘዒዙረዬኹ relevant authority፡
ዒቨጤያዓ መረዬ ኺት ወም ሰኄዟት
ጤመስጄቭ ኃላ ኄቭ ዒቨሰጄኹ ዒመዶሥቭ a) performs a construction work with a low
ሠራቨኛ ቛጤዲዜ ጤመዲዜቭ ወም quality or below standard material in
ቘቀጉቫም ጣኄ ቘቨዂሪ መዱዞ ኜቛጤዲዜዓ contravention of the standard set or the
ዒዱዂቝ ወም ሌላ ጉቅም ጤማዶኌቭ ቘማሰቝ accepted practice for such type of
ያጤ ቘቂ ምኡያቭ ቘዄህ Aጅ መሠረቭ construction; or
ቘሚወጇ ዙቝ ቘቨወሰኄ ዒዳ ዱዙቝ ኹስጉ

easily detectable by a professional of his
Eሥራቭ Eኇ ኜቝር Aምስቭ መቮ Eስኜ ቝር
kind;
ሶስቭ ሺ ቘሚዙርስ ዱዂቝ ቀጇል፡፡
is punishable with rigorous imprisonment
from five years up to ten years and a fine
from fifty thousand to hundred thousand birr.

1/ ማኛኹም ኜዶቛቫ ሥራ ዴር ቘቨያያዂ ዒቫ 2/ Any owner of a building who

መሠረቭ ኜዶቛቫ ሥራ A ፃ ም ዴር ቨያያ
¡ ኄቭ ያላተኹ መረዬኺት ዒማስ ር ሰኄዟት a) causes the drawing up of the design or
ዒመያ ወም ዒመጄቘቅ ዒሰኄዟት ቭኡኡ the construction work of such
ጤኛኄቭ ዒማረዴዱጉ ወም ዒመስጄቭ ኃላ ኄቭ construction by a person who is neither
ዒቨሰጄኹ ዒመዶሥቭ ሠራቨኛ ቘዲዜዓ ጉቅም qualified nor authorized to perform such
ያጤኹ ሰኹ ጤመጉቀም ወም ጤመዲዜቭ works; or.
ወም ጤራሱ ወም ጤሌጪት ቨዱቚ ያልጣኄ

ዒሰጄ Eዙጣኄ ወም an occupancy permit is not obtained or
to a service other than to which a permit
ጤ/ ቘቭኡኡል መዶጤጽ ያጤቘቭ ሁኈቫ is obtained from the relevant body, or
ዒሚ ያስዱኌኹ ኹገቭ ጤማስቀረቭ
d) constructs or causes the construction of his
ወሳኑ ኄቭ ያጤኹ ሬ ኄዱር ያስቀረ
building in any other manner which
Eዙ ጣኄ endangers public safety;
ኜAምስቭ ዓመቭ Eስኜ Aሥር ዓመቭ ቘሚዙርስ is punishable with imprisonment from five years
Eሥራቭ Eኇ ኜቝር Aሥር ሺህ Eስኜ ቝር ጠያ to ten years and a fine from birr twenty thousand

2/ ዒቨሳሳቨኹ መረዬ ዒቨሰጄኹ መረዬኹ ዒሚ
ያስኜቭጤኹ ዲዜቭ ጤመረዜቭ ዒሙያ Eኹ 3/ Where the crimes specified in sub article (1)
ቀቩ ወም ዒሥራኹ ኃላ ኄቭ ቘሚ ቅዞ and (2) of this Article are committed
ጤቭ ሠራቨኛ ዒጣኄ Eዙጣኄ ቅጇቩ ኜAም negligently, the penalties shall be

ዒጣኄ Eዙጣኄ ቅጇቩ ኜAዞ ዓመቭ Eስኜ in a construction work as a design or
Aምስቭ ዓመቭ ጦዙርስ ቘሚትል construction consultant:
Eሥራቭኇ ኜቝር Aዞ ሺ Eስኜ ቝር
Aምስቭ ሺ ቘሚዙርስ ዒዱዂቝ መቀጒ a) prepares the design or other relevant
ጣኇል፡፡ documents of a construction without
having due regard to the general safety
$2. ዙረዬኹ ዒማ ቅዞጤቭ ዶቛቫ ማኜኇወ regulations set forth for such specific
work; or

ዒቨ ሰጄኹ ዒህፃ ሥራ ቨቋራ ቘኇኄቭ b) advises or permits a contractor or a
ወም ቘUስ ሥራ ቨቋራኄቭ Aዶቛቝኄቭ supplier to procure or use a cheaper or,
ቛጤኹ Aኟል ዒቨሰጄኹ ዒሙያ ዙረዬ unwarranted quality or different material
ዒማ ቅዞጤቭ ማኛ ኹም ዒዶቛቫ ሥራ which is not acceptable by normal
Aኜኇኹኊ ዒቨዱኌ Eዙጣኄ ወም ማኛኹም standards for the specific work, or
Aዶቛቝ ኟጤኹ Aኟል ዒቨሰጄ ዒሙያ ቃዞ relieves him of using a specific material
ሳኊረኹ ቘቛጤሙያ ጦሰራ ዒሚዱቛኹ ዶቛቫ essential thereto; or
ሠርቮ ዒቨዱኌ Eዙጣኄ ኜAምስቭ ዓመቭ Eስኜ
Aሥር ዓመቭ ቘሚዙርስ ኅ Eሥራቭ Eኇ ኜቝር c) approves a construction work capable of
Aምስቭ ሺህ Eስኜ ቝር Aሥር ሺህ ቀጇል፡፡
endangering public safely or the life,
$3. ዙረዬኹ ያልጄቘቀ ዶቛቫ ስጤማኜኇወ health or person of others or the safety of
1/ ማኛኹም ቘዶቛቫ ሥራ Eዛሰማራ the property of another;

ዒሚትጥኇ ቨዱቚ ኹ ሙያ ጉቃቄ
1/ Any public servant with intent to obtain for
Aዞርዷ ቚጣ ኊሮ ጦቫረሙ ትጥ himself or to procure to other undue
ዒኄቘሩ ስህቨቮት ሳያርም ወም advantage or with intent to cause damage in
Eዛቫረሙ ሳያዙርዶ ያኜኇወኄኹ any manner destroys, endangers falsifies,
ዶቛቫ Aዙዴ ያስኜቨጤ Eዙጣኄ deletes, or falsifies by modifying, deleting, or
ኜAምስቭ ዓመቭ Eስኜ Aሥር ዓመቭ altering in whole or in part the terms or
ቘሚዙርስ ኅ Eሥራቭ Eኇ ኜቝር ጠምሳ figures of government documents,
ሺህ Eስኜ ቝር መቮ ሺህ ዞረስ ቀጇል፡፡ instruments related to public interest or
similar instruments or documents under his
2/ ማኛኹም ዒዶቛቫ ቛጤቜቭ possession while he is carrying out his
official responsibilities, is punishable with
ሀ/ ጤሚያኜኇኹኄኹ ዶቛቫ ዒሚያስ ልዱኹ rigorous imprisonment from five years to ten
ዒዛዅ ሥራ ወም ቘቨሰራኹ ዛዅ years and a fine from birr twenty thousand to
መሠረቭ ዒሚኜኇወኄኹ ዶቛቫ ዒሙያ fifty thousand.
ዙረ ዬኹ ቘማ ቅዞጤቭ ቛጤሙያ ያሰራ
Eዙ ጣኄ ወም 2/ Where the crime is committed by a public
servant officially entrusted with filing,
ጤ/ ዒሚያኜኇኹኄኹ ዶቛቫ ዙረዬ ኜሚጄቀኹ keeping documents specified in sub article
ዒዶቛቫ ቁሳቁስ ያኄሰ ዒጉራቭ ዙረዬ ያላ (1) of this Article, or controlling the same,
ተኹ ቁሳቁሶት ቘጉቅም ላ Eዛኹጥ the punishment shall be rigorous
ያዙ ረዱ Eዙጣኄ ወም imprisonment from five years to twenty five
years and a fine from birr twenty thousand up
ሐ/ ዶቛቫኹ Aዶቛቝ ኟጤኹ Aኟል ዒመጄ to birr fifty thousand.

professional or contractor who is found guilty

under this part of the law shall be suspended for a

period from five years up to the maximum period

57. Powers and Duties of the Ministry
ሀ/ ዒዶቛቫ ሥራኹ ዒሚጄቀኹ መሠ
ረቫ ዒጉቃቄ ዙረዬኺት ያልጄቘቀ With respect to the implantation of this Proclamation
the Ministry shall have the following powers and duties

ቨቋራ ጤዄሁ ዶቛቫኹ ጦኹል 3/ supervise compliance with the implementation
ኜሚዱቛኹ ያኄሰ ዒጉኟሬ ወም ዒጉራቭ of this Proclamation by Regional States and
ዙረዬ ያጤኹ ዒዶ ቛቫ Eቃ Eዛያቀርቝ urban centers .
ወም Aዱልዶጪቭ ላ Eዛኹል ቃዞ
ወም ስምምኄቭ ቘመስጄቭ ወም 4/ provide, in coordination with other relevant organs
of the Federal Government, capacity building and
ሐ/ ሙያኹ ዒሚጄቀኹ ሥኄ ምዶቛር ቘመ technical support to Regional States and urban
ጇስ ቘዶቛቫ ሙያ ዂር ቨቀቛኄቭ centers so that they will be able to implement this
ዒማ ኊረኹ ወም ኜዙረዬ ቘቫት ዒጣኄ Proclamation.

ስምምኄቩ ቘመስጄቭ ዒሕ ቝ ዙህኄቭ
ጤAዙዴ ዒሚያዴልጉ ዶቛቫ Aዱልዶጪቭ With respect to the implementation of this

ዒጣኄ Eዙጣኄ ቅጇቩ ኜAዞ ዓመቭ Eስኜ circumstances and without contradicting the
Aምስቭ ዓመቭ ጦዙርስ ቘሚትል provisions of this Proclamation;

in areas outside urban centers where it is

1/ Articles 8 to 14 of the Urban Zoning and
