The employee acknowledges being able to negotiate the agreement and seek legal counsel, and agrees the restrictions are fair and do not threaten their livelihood. NON –COMPETE AGREEMENT

This AGREEMENT dated (Date of Agreement) by and between (NAME OF BAKERY) and
(NAME OF STAFF)

(NAME OF BAKERY) is located at (ADDRESS OF BAKERY). And is represented by the


Management in this agreement.

WHEREAS, (NAME OF BAKERY) deals on Bread production and distribution

WHEREAS, (NAME OF BAKERY) and (NAME OF STAFF) have entered into a formal
Employment agreement where (NAME OF STAFF) Will perform duties related to His/her
position as (INSERT STAFF JOB ROLE)

And

NOW, THEREFORE, in consideration of the foregoing premises, and the mutual covenants
contained herein, (NAME OF COMPANY) and (NAME OF STAFF) hereby agree as follows:

 NON-COMPETITION. For the entire duration of this agreement, and for SIX MONTHS
(you can increase or decrease duration) after (NAME OF BAKERY) relationship with
(NAME OF STAFF) Has been terminated for any reason, (NAME OF STAFF) will not
work as an employee, baker, driver, partner, consultant, agent, owner or engage in any
other capacity with a competing bakery or company.

This means that (NAME OF STAFF) must not perform any work in any bakery for 6 months after he/she
has stopped working for (NAME OF BAKERY) ………………………. (Town, local or State depending
on what you want) whether he/she resigns or is sacked.

 EMPLOYEE ACKNOWLEDGEMENTS: (NAME OF STAFF) acknowledges that


she/has been provided with the opportunity to negotiate this agreement, have had the
opportunity to seek legal counsel before signing this agreement, and that the restrictions
imposed are fair and necessary for the Company’s business interests. Finally, the
Employee agrees that these restrictions are reasonable and do not constitute a threat to
their livelihood.

 APPLICABLE LAW. This agreement and its interpretation shall be governed by the laws
of the Federal Republic of Nigeria.

IN WITNESS WHEREOF, the parties have executed this Agreement as of the date first above
written.
