PRE-TRIAL BRIEF
(For the two Accused)

ACCUSED JANICE LARANJO GORRES and NASSER


TAMBIDAN MACABUAT, through the undersigned counsels and unto
this Honorable Court, most respectfully file and submit this Pre-Trial
Brief, to wit:

I. SUMMARY OF ADMITTED FACTS


1. The jurisdiction of the Honorable Court.
2. The personal circumstances of both of the Accused.
3. Both of the Accused were not served with any subpoena in relation
to the instant cases before the Office of the Provincial Prosecutor.
4. Both of the Accused were not able to submit their counter affidavits
in relation to the instant cases before the Office of the Provincial
Prosecutor.
5. Both of the Accused were not able to participate in the preliminary
investigation before the Office of the Provincial Prosecutor.

II. PROPOSED STIPULATIONS


1. Will the Prosecution stipulate that Nasser Tambidan Macabuat is a
registered and licensed fiber trader?
2. Will the Prosecution stipulate that Nasser Tambidan Macabuat is
authorized to engage in the buying and selling of Philippine
commercial fibers?
3. Will the Prosecution stipulate that it is both of the Accused who
own all of the equipment used in the processing of the Abaca
fiber?
4. Will the Prosecution stipulate that it is both of the Accused who
pay for the salaries and wages of all the employees commissioned
to work in the processing of the Abaca fiber?
5. Will the Prosecution stipulate that the private complainant is not
the owner of the land where the plantation of the subject Abaca
was located?

6. Will the Prosecution stipulate that the private complainant is not
the owner of the subject Abaca trees and fiber?

III. ISSUES
1. Whether or not both of the Accused committed the crime charged
in the four (4) Information.
2. Whether or not both of the Accused are guilty of the crime charged
in the four (4) Information.
3. Whether or not both of the Accused were afforded with due
process.

Both Accused most respectfully reserve the right to present
other documents or evidence in addition to, or in substitution of, those
already mentioned should the need therefore arise; and/or propose
other issues as the exigencies of trial may demand; and/or reserve
