‘On March 3, 2023, a Professional Standards Division investigation was initiated relative
to Deputy Shawn Bacich. Chief Legal and Compliance Officer Molly J. Zilig authorized
this investigation.
Itis alleged that Deputy Shawn Bacich violated Milwaukee County Sherfs Office rules,
and regulations as well as Milwaukee County Civil Service rules regarding standards of
‘conduct: efficiency, refusing or failing to comply with departmental work rules, policies,
of procedures, and substandard or careless job performance.
It is alleged that Deputy Bacich completed court disposition paperwork incorrectly,
‘causing an occupant to remain in custody an additional eighteen days,
Professional Standards Division Lieutenant Steven Paar was assigned to conduct this
investigation.
Deputy Bacich was hired by Milwaukee County on January 8, 1999. He is currently
assigned to the Courts Division.

snagement System (RMS) with an add/update form and incorrectly wrote the bail as
$55,000 cash bail (CBL) instead of $5,000 Personal Recognizance Bond (PRB), Due to
this error, Occupant [spent 18 more days in custody than he should
have.

Deputy Shawn Bacich was interviewed relative to this internal investigation.
Deputy Bacich confirmed his assignment to Preliminary Court on January 24, 2023. He
staced that Occupant III case was held via video conference. He stated
that he filled out an add/update disposition form for this occupant. He said that the
addlupdate form is used when a defendant has a court appearance for an in-custody
case but has additional cases they need to appear for on an out of custody basis, By
filing out the form, it notifies the jall that the occupant needs lo be produced in court for
the future proceedings. Deputy Bacich stated that Sergeant Christine Baker asked him
to get the cash bail corrected for the case. He realized that te made a clerical mistake
by writing $5000 cash bail instead of the writing the correct entry of $6000 personal
recognizance bond,
Deputy Bacich stated he looks al cases up prior ofiing out the dsposiion fora case.

often finds mistakes that others have made. Deputy Bacich acknowledged fis eror in

case.
When asked what he should or could have done differently to avoid such a mistake, he

‘On August 6, 2021, a Professional Standards Division investigation was initlated
relative to Deputy Sherif Shawn Bacich. Chief Legal and Compliance Officer Molly J
Zilig authorized this investigation.
Itis alleged that Deputy Bacich violated Milwaukee County Sherif’s Otfice rules and

‘competence, refusing or failing to comply with departmental work rules, policies, or

in his inital incident report, but he did not include his name or lst him as a witness.
He said tha it was dangerous on the side ofthe freeway and he toot down his phone
siumber so the officer could leave the scene. but he never calied him for folow up.

Bacich said, ‘Ive read this over and... | mean, hera's come sloppy stuff in there,”
referring to his incident report, Deputy Bacich stated that it was not appropriate to
have an incomplete report and said, “I totally agree that there's a litle sloppiness in
here... on my part." He explained that he should have followed up and explained
things in the report better than he did at the time.
Deputy Bacich stated that he cut out the airbags of the Infiniti at the time of the crash,
bbut Assistant Distvict Aomey Emily Zimmel explained that they wouldn't test for DNA
on the 88 it was a violent feiony. He sald that ADA Zimmel couldn't
charge Mr because none of the witresses could testify thal he was driving
the Infinit at the time of the crash. Deputy Bacich did issue Me| citations for
Vehicle's Owner Liabilty, Operate Motor Vehicle after Suspension, and Operate
Motor Vehicle W/O Insurance.
Based on the aforementioned fects in this case, Deputy Sheriff Shawn Bacich is in

Deputy Bacich hes been employed with the MCSO since January 1988, approximately 8 % years
He is currantiy assigned to the Court Division as 2 Balliff. Deputy Bacich has wavelad to Ford de
Lae on at lest threo occasions since October 2008. On two of these occasions, he has hed police
contact with officers from the FDPD. On the third occasion, he did not have personel contact with
officers, owovar FDPO officers were attempting to make contact with him,
His frst contact with the FOPD was on October 1, 2006. This incident was relative to call from
Detrons atthe Kwik Trip gas station. Deputy Bacich was intoxicated and asked thet they call the
Bolce tor him, to give im a ride. The FDPD did arive on the scene, and Deputy Bacich wes,
luneooperative when dealing with the officers. He states he attampted to tll tom that it waa,
ust aoe, howaver, they were taking the incident seriously. Ho di state he was a MCSO desuty,
‘a8 fold interviewed and released from the scene.
The second incident involving Deputy Bocich was on February 25, 2007. Deputy Bacich wee at
Ditinger's Bar and slegedly passed a counterfeit $100.00 bil. He didnot have contact with FOPD
cfices tis right, however they did attempt to locate him at his hotel room atthe Fandy Hote,
‘wom #24. Deputy Bacich’s vehicle was parked inthe batl lt and there were fresh footie in
the snow leading nto room #24. Pole attempted contact two times by knocking on the door,
however there wes:ne answer. Deputy Bacien states he did ot hear any knocting on he hotel

‘Toe third incident was on Apri 8, 2007, at Dilinger’s Bar. FOPD officers were callad tothe bat by
an employee of the establishment relative to the February complaint of the counterfeit # 100.00 Bil
Officers made contact with Deputy Bacich and advised him of the complaint. He states he Yhought
{was 0 joke and thon stated that the didnot believe he had peesed the bil, however i they had
fim on video it must be true, He went on to say that he normally doas not carry #100.00 bile, The
officers stated he was uncooperative; Deputy Becich states the officers were unprotessional, They,

vehicle for several traffic violations. ‘The stop was conducted on WIB on 194 at S. 68" St. The
vehicle was occupied by the operator and a sleeping passenger. Deputy Bacich then began
‘conducting standardized field sobrity testing on the operator. The operator performed poorly on
‘these tests. After the PBT portion of the test, Deputy Bacich advised the operator he was under
arrest for OWI. He then tuned to place his PBT into his squad. At that time the operator fled
from the scene on foot, jumping the guardrail and running into the neighborhood north of 194,
‘A search was conducted for the subject, but was unsuccessful in locating him,
Deputy Bacich later swore out a warrant with the Miwaukee County District Attorney's Office for
{an individual he believed to be the suspect. On August 25, 2013, Deputy Bacich and his FTO,
Deputy Conte, made contact with this suspect and determined that it was not the individual
involved in the original incident.

Bacich then looked for the ID himself. After smeling the odor of marijuana in the vehicle, Deputy
Bacich woke the passenger and had him move to the rear seat of his squad. Deputy Bacich then,
began conducting standardized fiek! sobriety testing on the operator. The operator performed
poorly on these tests. After the PBT portion of the test, Deputy Bacich advised the operator he
was under arrest for OWI. He then tumed to place his PBT into his squad. At that time the
‘operator fled from the scene on foot, jumping the guardrail and running into the neighborhood
north of 194.

Deputy Bacich was counseled regarding several tactical errors committed during this incident.
Deputy Bacich removed the operator from the vehicle for officer safely, but left him unsecured
behind the vehicle while he looked for the ID. He then never obtained the subject's name prior to
‘conducting SFST's. Therefore when the subject fled, we did not know who we were looking for.

attention away from him allowing the subject the opporturity to flee.

‘On Tuesday, August 13, 2013, Deputy Shawn Bacich arrested a 53 year-old white male for
Operating While Intoxicated. The subject was conveyed to the Patrol Division intoximeter room,
‘where he tested .00 on the intoximeter machine. Unsure how to proceed, Deputy Bacich
‘contacted Sgt. Aaron Dobson for direction
It was determined that the subject would be released to a responsible party. The subject
subsequently contacted Sgt. Dobson to complain about the arrest, the fact that his vehicle was
towed, and that he needed his CPAP machine, which was in the vehicle, in order to sleep. A
‘deputy was sent to retrieve the CPAP machine and deliver it to the subject's house. All of the.
‘subject's citations regarding this incident will be administratively voided and all towing fees and
charges dropped per the Patrol Division Captain,
Deputy Bacich informed Sgt. Dobson thatthe subject had performed “prety wel” on field sobriety
tests prior to the arrest. He further stated that he had observed "maybe two" out of six clues on
the HGN test. When asked why he had arrested the subject, Deputy Bacich told Sgt. Dobson
that he thought the subject was intentionally “messing” with the PBT machine and refusing 0
provide an adequate sample.
Deputy Bacich is hereby counseled regarding the necessity of having enough impairment clues
to establish probable cause prior to requesting a subject to submit a PBT test. He is also
counseled that a PBT test is voluntary and a subject's refusal to submit one or perform one.

hours on July 21, 2009.

complaint stated that on July 21, 2009 both deputies were sleeping; I cannot interview
that person due to their dese to be anonymous.
