MEMORANDUM OF AGREEMENT
KNOW ALL MEN BY THESE PRESENTS:
This Memorandum of Agreement (hereinafter referred to as “MOA”) is made and entered
into by and between:
BATAAN PENINSULA STATE UNIVERSITY – BALANGA CAMPUS, a state university
with principal address at Don Manuel Banzon Avenue, City of Balanga, Bataan, represented by
its Campus Director, ROMEO S. NISAY JR., hereinafter referred to as BPSU – Balanga
Campus;
- and -
Department of Labor and Employment (DOLE) with office address at 2F The Bunker,
Capitol Compound, Balanga City, Bataan herein represented by its Head, Ms. Leilani M
Reynoso, hereinafter referred to as HOST Training Establishment Partner (HTEP).
WITNESSETH THAT:
WHEREAS, BPSU is a duly CHED recognized higher education institution, which offers
Bachelor of Science in Business Administration Major in Operations Management degree
program under the College of Business and Accountancy (CBA);
WHEREAS, the curriculum for the BSBA degree in BPSU includes Internship program
for its students, so as afford them experience in business administration and practical
knowledge, skills and desirable attitude, thereby augmenting their formal training;
WHEREAS, the HTEP supports this program of the BPSU and agrees to accept and
accommodate students enrolled in the BSBA On-the-Job Training or INTERNSHIP (600 hours),
to expose them to actual learning experiences from industry;
WHEREAS, the BPSU and HTEP shall endeavor to ensure that the INTERNSHIP
program will furnace strong academic-industry linkage between them, and that it will
complement existing course curricula to match industry demand.
NOW, THEREFORE, for and in consideration of the foregoing premises, the parties
hereby bind themselves to undertake this MOA, under the following terms and conditions:
1. The duration of the program shall be equivalent to Six Hundred Hours (600 hours) ;
unless otherwise agreed upon by HTEP and the BPSU;
2. The BPSU shall be responsible for briefing the Interns who intend to conduct practicum
exposure in the HTEP as part of BPSU’s Curriculum;
3. The BPSU shall provide the Intern basic orientation on the work values, behavior, and
discipline to ensure smooth cooperation with the HTEP;
4. The BPSU shall voluntarily withdraw the Intern who is found to have misbehaved and/or
acted in defiance of existing standards, rules, and regulations of the HTEP and impose
necessary sanctions on the said Intern;
5. The HTEP shall assign personnel who shall orient the Interns on the Rules and
Regulations of the HTEP, especially on such matters which pertain to safety and security
precautions, and who shall supervise and monitor the activities, performance and
progress of the student Interns;
6. The HTEP shall accomplish necessary forms (e.g. Intern Performance Evaluation, etc.)
and shall issue a Certificate of Completion to each Intern upon fulfillment of all the
training requirements;
7. The HTEP shall commit to take in qualified Intern for the semester wherein the
INTERNSHIP program is offered in BPSU;
8. The HTEP shall provide free relevant instruction and training to the Intern, consistent
with its policies, rules, and regulations. It shall treat the students in a professional
manner, and shall not subject him/her to task and work assignments that are risky,
dangerous or unrelated to the purpose of this Agreement;
9. There shall be no employer-employee relationship between the HTEP and the Intern. As
Intern, he/she shall not be entitled to the compensation/benefits accorded to an
employee, except when it may provide necessary incentives as it may deem applicable,
such as free duty meals, travel allowance and uniform.
10. The HTEP is not obliged to employ the Intern upon completion of training. However, the
HTEP, upon consultation with BPSU, may require qualified Interns to submit themselves
to examinations, interviews, and file pertinent documents to support their applications;
11. The Intern shall be personally responsible for any and all liabilities arising from gross
negligence in the performance of his/her duties and functions while under training;
12. The Intern shall not divulge any information that he/she may have access to, and any
such information will only be used for academic purpose;
13. Both parties shall have rights to pre-terminate the INTERNSHIP program if:
a. The INTERN violates the rules and regulations of the HTEP, or if there is serious
misconduct;
b. The HTEP does not provide the kind of responsible training as agreed upon; or
c. There is any violation of the foregoing covenants that will warrant the cancellation of
this Agreement;
PROVIDED, that the terminating party shall formally inform the BSBA Internship
Coordinator of the grievance before any decision to terminate is made and finalized.
The BSA Internship Coordinator shall intervene in order to rectify the situation in the
interest of all parties concerned.
14. This MOA shall become effective upon signature of both parties and implementation will
begin immediately and shall continue to be valid hereafter until written notice given by
either party, five (5) days prior to the date of intended termination.
COMMON PROVISIONS
1. Any change of training date shall be relayed to the other party the soonest possible
time by phone and e-mail.
2. The liability of each party under this Agreement is limited to the liability stipulated
herein.
3. This MOA supersedes and renders void all agreements, written or oral, prior to or
simultaneously with the signing of this Agreement regarding the same subject matter.
4. This MOA shall be valid and effective upon the signing thereof by the authorized
officers until the accomplishment of this MOA.

This instrument refers to a Memorandum of Agreement, consisting of three (3) pages,
including this page wherein this Acknowledgement is written, signed by the parties together with
their instrumental witnesses on each and every page hereof.
