Probation

The offender or their counsel files a petition for probation with the convicting court, who notifies the prosecutor. If qualified, the petitioner's application is referred to a probation officer for a post-sentence investigation report, which is submitted to the court within 60 days along with an interview of references. The court then determines within 15 days whether to grant or deny the petition for probation based on the report.

Procedures in Applying for Probation

Narrator: The offender or his counsel files a petition with the convicting court.

(The Counsel and the Petitioner enters)

Counsel: Good day Judge. We're here to apply for probation.

Judge: Good day. Who's the applicant?

Counsel: This my client Mr. Offender

Narrator: The court determines convict qualifications and notifies the prosecutor of the filing of the
petition.

Judge: Okay, I will notify the prosecutor regarding the filing of this petition.

Counsel: Okay Judge thank you.

(The Counsel and the Petitioner exits)

(The Prosecutor enters)

Prosecutor: Good day Judge.

Judge: Good day. This is the application of Mr. Offender for probation. I will need your comment within
10 days.

Prosecutor: Yes Judge.

(The Prosecutor takes the file handed by the judge)

Narrator: The Prosecutor is now going to start determining the convict qualification. The prosecutor
submits his comments on such application within 10 days from receipt of the notification. If petitioner is
qualified, his application is referred to the probation officer for post-sentence investigation.

(Probation officer enters the room)

Probation officer: Good day Judge.

Judge: Good day. This is the application of Mr. Offender granted by the prosecutor. You have to submit
your PSI Report in the court within 60 days.

(The Probation officer takes the file handed by the judge)


Narrator: The Probation officer started his PSIR

(The Probation Officer enters the hall)

PO: Good day Cap, good day mister. I'm here to conduct an interview regarding the case of Mr.
Offender. I'm just gonna ask a few questions.

Cap: No problem sir, go ahead.

PO: What kind of citizen is Mr. Offender here in your area?

Mister: He's a good citizen actually, but he quickly loses patience when it comes to his children because
he is the only one taking care of them and his wife has already passed away.

PO: Is that so. What other source of income does he have besides working in construction sites?

Captain: He is also a tricycle driver and a part-time mechanic in he's brother's wielding shop.

PO: Okay thank you for your cooperation.

(The probation officer exits the Hall)

Narrator: The post-sentence investigation report (PSIR) is submitted by the probation officer to the court
within 60 days. After the PSIR, the probation officer returns to the judge and present PSIR of the
Petitioner. The court determines the petition whether to grant or deny the petition for probation within
15 days upon receipt of the PSIR.
