6 Y Company fails to comply with the rules of Water Prevention and Pollution Act,
1974. What action can be taken against the company?Code No. 3435/81
14 Certain area was declared by the State Government as “air pollution control area” and
the industry of the petitioner (pulverizing dolomite stones) was situated in the said area.
As per $.21(2) of the Air Pollution (Prevention and Control) Act, 1981 owners of the
existing industries were required to apply for obtaining the consent of the Board. The
petitioner didn t apply for the consent. On inspection it was found that the industry of the
petitioner had not set up the air pollution: control device. Since the people living in that
area complained about the emission of dust from the industry, the SPCB ordered the
closure of the industry U/S 23 of the Act. Decide the validity of the action of the Board.
The Petitioner Trust with a view to establish a medical college on the banks of
Kumudavathi River applied for permission to the concemed State Pollution Control
Board. The construction of medical cotlege is likely to pollute the Kumudavathi River,
located near the ‘proposed construction. Kumudhavathi flows into a particular reservoir
which is one of the major resources of drinking water to the city. The State Pollution

The petitioner was manufacturing chemicals and the officers of SPCB inspected the
