As per $.21(2) of the Air Pollution (Prevention and Control) Act, 1981 owners of the existing industries were required to apply for obtaining the consent of the Board. The petitioner didn t apply for the consent. On inspection it was found that the industry of the petitioner had not set up the air pollution: control device.
