Third offense – Any person apprehended for the third time violating any provision of the said
Ordinance and found guilty hereof shall be punishable to clean the surrounding within the vicinity of the
Barangay and by a fine of not less than Php.250.00 but not exceeding Php.350.00 or with an
imprisonment of not less than 20 days, but not more than 30 days or both fine and imprisonment the
discretion of the court.
Any minor found guilty for the violation of any of the provision of Section 3 hereof shall be proceeded
against in the accordance with the provision Article 192 of the Revised Child and Youth Welfare Code as
amended.
The parents or guardian of the minor who shall neglect, allow or permit to violate any of the
provisions of Section 3 thereof, shall be punished by public censure and a fine of not less than
Php.300.00.
Any person who fails to pay the fine shall be subject to subsidiary imprisonment the rate of 12.00 per
day.
Section 5. ---Any and all parts of any ordinance inconsistent with the provision hereof are deemed
repealed or modified accordingly.
Section 6. ---This ordinance shall take effect immediately upon the ratification on the approval of the
Sangguniang Barangay of Barangay 83-C and the office of the Sangguniang Panglungsod., Tacloban City.
