It is voluntary for Customer to provide the above Customer information including personal data ("Data") to HKBNES. Without th e Data, HKBNES may not be able to provide products
and/or services to Customer. The Data collected will be used and/or disclosed for purposes of provision of the products and/or services to Customer and enforcing HKBNES's rights in
connection with the provision of the products and/or services; publication of any directory listing (unless Customer has opte d to be unlisted); credit checks;debt collection; market
research; prevention or detection of crime; disclosure as required by law or a government authority; provisioning of emergenc y services; and any other purposes as may be agreed
between HKBNES and Customer. HKBNES may disclose the Data to its suppliers/ contractors/ agents/ other network operators in connection with any of the aforesaid purposes and

overleaf, additional terms referenced to or attached to this Order Confirmation, policies and applicable tariffs relevant to the Services as published by HKBNES. In the event of any
inconsistency between HKBNES's General Terms and the Special Terms, the Special Terms shall prevail to the extent of such inconsistency.

Special Terms and Conditions for Broadband Service
1. Unless otherwise agreed in writing. Services will be activated by HKBNES wthin 3-6 weeks upon receipt of all necessary information from Customer.
2. Customer agrees that the Services will be charged at the List Price on a month-to-month basis after the expiration of the MCP. Any device(s)/premium(s)/coupon(s)
associated with the initial installation will not be re-issued. If Customer does not wish to use any of the Services, Customer must give 30 days prior written notice (by using
the prescribed form from HKBNES) to HKBNES to terminate the Services. MCP is specified in the Order Confirmation or Tariffs. If MCP is not specified in the Order
Confirmation or Tariffs, the MCP is 3 months. If any of the Services are terminated before the expiration of the MCP. Customer shall pay the aggregate prevailing
charges of the Services for the remaining term of the MCP. Monthly charge will remain unchanged during the MCP.
3. Customer authorises HKBNES to amend, update or complete the information in the Notice of Service Disconnection related to the Order Confirmation on its behalf
whenever necessary and take such action as HKBNES considers necessary to facilitate the disconnection of services by Customer 's existing service provider and the
porting of telephone numbers from Customer's existing service provider to HKENES. Customer agrees that the existing service provider will notbe liable to Customer for
any losses or damages suffered or incurred by Customer arising from the number porting arrangement.
4. Customer acknowledges that HKBNES may impose, and Customer shall pay on demand, (a) additional charges as per the applicable Tariff published at any time if any of
the fixed lines subscribed are used for special application: (b) additional charges incurred by HKBNES due to regulatory changes or changes in interconnection charges
between HKBNES and other service provider(s), and (c) cancellation charge for cancellation of order before service activation which will be the higher of the applicable
installation charge (regardless of whether it is waived or not) or amount of loss or damage suffered by HKBNES as a result of the cancellation.
5. Services shall only be made available to the installation address as stated in the Order Confirmation. HKBNES may refuse to r elocate the Services to any otheraddress
or charge Customer a relocation charge as specified by HKBNES.
6. Customer acknowledges that the Contact Person specified in the Order Confirmation shail be its authorized representative and HKBNES, its agents and/or contractors
may take instructions directly from Contact Person on any matters relating to the Order Confirmation including configuration of equipment, function or feature setting of the
equipment and service provisioning.
7. Provision of Services is subject to HBNES gaining access to the building and Customer's premises to install the necessary facilities including equipment and wiring and in
some situation access to the use of any in-situ wires in Customer's building or premises. Customer shall faciftate such access including (a) liaising with the relevant
building management office or building owner, data centre operator or relevant authority, and setting cross connection charge or any surcharges that may be imposed
(one-off and monthly recurring); and (b) where internal wing work is required to remove and reinstate any interior furishings that may be affected; provide necessary tools
such as construction platform and seeking permission to drill holes. HKBNES may cancel the Order Confirmation without any liability to Customer if access is denied or
necessary arrangement(s) are not made, or it is not technically or commercially feasible to install the required facilities to provide the Services.
8. For Business Broadband / Fibre Business Broadband / Direct Fibre Internet Services: the access speed is measured and quoted in unit of Megabit per second(Mbps)
or Gigabit per second (Gbps). The actual throughput for each circuit will be affected by usage levels, network configuration, coverage and extraneous factors. HKBNES
may take such action as it sees fit to ensure that the throughput does not exceed the subscribed limits.
9. Customer acknowledges that voice communication services provided by HKBNES must not be used by lifeline user or connected to lifeline devices.
10. Customer acknowledges that HKBNES will not be able to ascertain and to provide the geographical location of the c aller to the emergency service authorities for
emergency call made via voice communication services provided by HKBNES. Customer must advise its geographical location to emergency service authorities during
emergency call. Customer will indemnify and hold harmless HKBNES or its officers or agents against any liability. claim, loss, damage or expense arising from any event of
emergency call from these services.
11. Upon service termination, HKBNES wil arrange to collect the equipment(s) installed at Customer's premises. Customer wil pay H KBNES charges if the
equipment(s) is not retumed in good condition.
12. Premiums (if applicable) are available while stocks last. To enjoy the premium, the Service must be successfuly installed, and Customer has prepaid the applicable
amount. HKBNES reserves the right to replace the premium with products of the same kind without prior notice to Customer, and the value of such replacement product
including installation (if applicable) may differ from those of the premiums. In case of any disputes, the decision of HKBNES shall be final. The premiurn cannot be
redeemed for cash and is not transferable. No refund wil be made once the premum is receemed. To enjoy the premiums, Customer agrees that HKBNES may transfer
Customer's company contact information to third-party service provider(s) or agent(s) for the purpose of (a) providing the premiums to Customer: (b) registration
purposes, and/or (c) delivery and/or installation of the premium (if applicable). If delivery/installation of premiums is required, such premiums will be delivered to
Customer's installation address within 8-12 weeks after the Services commence. If delivery / installation of premiumsis not required, Customer will receive premium
redemption notice by email within 8-12 weeks after the Services commence. HKBNES decision on the delivery methods of the premium shall be final. HKBNES may not
be the manufacturer/supplier of the premium offered. In that case, the ownership of the premium will be transferred to Customer at the point of successful redemption of
the premium; and any concerns on maintenance or complaints of the premiums should be directed to the manufacturer/supplier of the premiums and HKBNES is not
responsible for the use of the premium.
13. For FixIT Tokens (if applicable), the use of FixIT Tokens is subject to the Terms of FixIT Token Service (available at hkbnes.net/web/en/support/tnc). FixIT Tokens
will expire after the stipulated expiry date without further notice.

15. In case of any disputes. the decision of HKBNES shall be final.
Special Terms and Conditions of Aegis DNS Security Easy Protect Service
1. Aegis DNS Security Easy Protect Service (“Service”) is a cloud-delivered service that designed to provide DNS-layer security solution for Customer with 25 users or below
and their devices connected to the Internet and proactively identify and block malware and phishing sites. HKBNES will engage a designated vendor (“Vendor”) as a sub-
contractor to support the Service. Customer agrees and acknowledge that its IP addresses will be registered in Vendor’s platform to protect the Customer’s outgoing
internet traffic against attacks. Customer shall understand the terms and conditions implemented by the Vendor (Cisco) (please refer to
https://www.cisco.com/c/dam/en_us/about/doing_business/legal/service_descriptions/docs/Cisco-Umbrella-Enterprise-Terms-of-Service.pdf).
2. HKBNES has the right to change the Vendor.
3. HKBNES will use reasonable endeavors in providing the Service to detect all known malwares and phishing sites accessed on the Internet by the Customer but does not
guarantee that it will be continuous and completely fault-free or all malwares and phishing sites will be promptly detected and restricted at all.
4. Customer shall change the DNS (domain name system) setting in either router / gateway or firewall (if any) or configure it in the device setting and forward the DNS
queries to the Vendor. For bundled router, HKBNES will assist the Customer in configuring the DNS set up during broadband installation. For non-bundled router,
HKBNES will use its reasonable endeavours to assist in the setting up during broadband installation and will only handle the set-up when the Customer allows HKBNES
employees, contractors, or agents of HKBNES to access the equipment and/or router with administration login (if necessary). H KBNES shall not be responsible for any
loss or damages suffered by the Customer during the set-up.
5. If Customer alters the DNS setup, bypasses the Umbrella DNS in any way, or uses its own DNS setting to access the website, Um brella security protection will not be
available. If the end-device or any of the LAN network routing devices has been installed or configured for any other URL filtering software/ service, it may interfere with
Umbrella security protection. If Customer terminates the Service, Customer shall change the DNS setting and DNS queries from the Vendor.

Special Terms and Conditions for AegisConnect AegisInsight Service
1. The AegisConnect AegisInsight Service (“AegisInsight”) is a network monitoring services which aims to help Customer to monito r its WAN connection status andusage.
2. HKBNES will provide the AegisInsight via: (i) a web portal; (ii) a mobile portal; (iii) SMS alerts to a designated mobile number when data usage reaches a certain
threshold and (iv) email alerts to a specific address when data usage reaches a certain threshold.
3. The level of service for fault reporting of the AegisInsight is 8x5xNBD.
4. HKBNES will provide remote support to Customers via HKBNES’s helpdesk which is available 24x7X365 via HKBNES’s service hotlin e. Customer is responsible for
providing appropriate information such as description of failure and the time such failure occurred. HKBNES will use commercially reasonable efforts to assist the
Customer in resolution of issues. HKBNES shall not have any liability or responsibility in connection with, or arising out of a Customer’s actions, failure to act or delay in
acting on such events and/or alerts as and when presented.
5. Customer may access historical network status data via mobile portal or web portal for the past 3 months. HKBNES makes no gua rantee as to the availability or
retention of such historical network status data beyond this period, or the accuracy and completeness of such data. Customer acknowledges that the historical network
status data is provided for informational purposes only and Customer is responsible for making their own assessments based on specific requirements and
circumstances.
6. Customer hereby acknowledges and agrees that HKBNES may access Customer's web portal or mobile portal for the purposes of providing support and making
improvements. HKBNES will implement reasonable security measures to protect Customer’s data during access.
7. Customer acknowledges that deployment of the AegisInsight does not achieve the impossible goal of risk elimination, and therefore HKBNES does not guarantee that
intrusions, compromises, or other unauthorised activity will not occur on Customer’s network. Further, HKBNES shall not be he ld liable for any security breaches,
unauthorised access, or data loss that may occur despite the measures implemented to protect Customer's data.
8. The billing for AegisInsight will commence on the same date as the Service(s). Upon completion of installation of the Service (s) at the Installation Address asstated
in this Order Confirmation, HKBNES will provide the login information for AegisInsight within four (4) working days.
1. H3C Magie BX54 Router (“Router”) is manufactured by H3C Technologies Co., Limited (“H3C”). HKBNES is not the manufacturer of the Router and shall not be held
liable for any loss, damage or liability arising in conjunction with the purchase, possession or use of the Router by the Customer. The Customer agrees that any such
claims, disputes, or issues related to the Router should be directed solely to H3C, the manufacturer.
2. H3C provides 1 year carry-in warranty service for the Router via Tech Data Distribution (Hong Kong) Limited (“Tech Data”). Customer should keep the original copy of
the delivery note issued by HKBNES for warranty purposes.
3. In case of any defect, fault or damage of the Router and/or its accessories during the warranty period, Customer should contact Tech Data's Customer Service Centre
to schedule a service appointment. Customer should bring the original copy of the delivery note, along with the faulty unit, power adapter, and applicable accessories, to
the Customer Service Centre.
4. The warranty does not cover Router that has been altered or repaired other than by Tech Data, damaged due to improper use, neglect or normal wear and tear.
5. During the warranty period, a replacement unit of the Router will be provided to the Customer after the cause for failure or defect has been identified by Tech Data.
6. The Router is provided by HKBNES to the Customer on a lease-to-own basis. Subject to full payment of the service charges, the ownership of the Router will be
transferred to the Customer at the end of the MCP.
7. The Router may be delivered and/or installed within 8-12 weeks to Customer’s installation address after the Service commences. HKBNES reserves all its rights and final
discretion to determine the Router delivery modes and methods and HKBNES may change such modes and/or methods from time to ti me as it shall deem appropriate
without prior notice and/or giving any reason therefor. In this connection, the Customer agrees to give consent to HKBNES to transfer its contact information including
but not limited to its company name, business registration number, contact person, contact number, email address, correspondence and installation address to the
appointed contractor, courier or any authorised third-party service provider for the purpose to arrange for delivery and/or installation of the Router.

Special Terms and Conditions of「IT•Simplified」Packaged Solution
1. 「IT•Simplified」represents a packaged solution. A package includes the Product(s) or Service(s) specifically mentioned in the package description. Any additional
Product(s) or Service(s) not explicitly stated in the package description will not be provided. The Product(s) or Service(s) may be subject to product / service specific
terms and conditions, as set out at https://www.hkbnes.net/web/en/support/tnc.
2. The prices quoted to the Customer are valid for acceptance for 30 days from the date of issue of the quotation and/or Order Confirmation Form and/or are subject to final
confirmation. Any payment made to HKBNES is non-transferable and non-refundable.
3. The Package includes services and/or products provided by third-party suppliers. The Customer agrees to comply with and accept the terms and conditions of these
third-party suppliers. The monthly charge of the Package is exclusive of any additional fees incurred from using third-party services, including but not limited to transaction
fees or processing fees charged by payment system providers.
4. For the provision of voice line services, Customer authorizes HKBNES to amend, update, or complete the information in the Notice of Service Disconnection related to
the Order Confirmation on its behalf whenever necessary and take such action as HKBNES considers necessary to facilitate the disconnection of services by
Customer's existing service provider and the porting of telephone numbers from Customer's existing service provider to HKBNES. Customer agrees that the existing
service provider will not be liable to Customer for any losses or damages suffered or incurred by Customer arising from the number porting arrangement.
5. HKBNES shall not be liable to the Customer if any Product(s) and/or Service(s) are provided beyond the Preferred Contract Start Date, which is for reference only.
6. The Customer agrees that the Services will be automatically renewed and will be charged at the List Price on a month -to-month basis after the expiration of the MCP. On
renewal, any device(s)/premium(s)/coupon(s) associated with the initial installation will not be reissued. If the Customer do es not wish to renew any of theServices, the
Customer must give 30 days’ prior written notice (by using the prescribed form from HKBNES) to HKBNES to terminate the Services. If any of the Services are terminated
before the expiration of the MCP, Customer shall pay the aggregate prevailing charges of the Services for the remaining term of the MCP. MCP is specified in this Order
Confirmation or the Tariffs. If MCP is not specified in this Order Confirmation or the Tariffs, the MCP for the Service is 3 months. Rental charges will remain unchanged
during the MCP.
7. Provision of Services is subject to HKBNES gaining access to the building and the Customer’s premises to install the necessary facilities including equipment and wiring
and in some situation access to the use of any in-situ wires in the Customer’s building or premises. The Customer will provide the necessary assistance to facilitate such
access including: (a) liaising with the respective Building Management Office or building owner, data centre operator or rele vant authority, and settling cross connection
charge or any surcharges that may be imposed (one-off and monthly recurring); and (b) where internal wiring work is required, to remove and reinstate any interior
furnishings that may be affected; provide necessary tools such as construction platform and seeking permission to drill holes. HKBNES may cancel this Order Confirmation
without any liability to the Customer if building access is denied or necessary arrangement(s) are not made, or it is not technically or commercially feasible to install the
required facilities to provide the Services. Services shall only be made available to the installation address as stated in the Order Confirmation. HKBNES may refuse to
relocate the Services to any other address or charge Customer a relocation charge as specified by HKBNES.
8. Specifications of broadband internet speed (e.g. 1000 Mbps) are based on an Internet connection from the wall plate at Customer's premises to the first piece of HKBNES'
network equipment. Maximum upload/download speed to local site could be up to the specification speed (e.g. 1000 Mbps). The actual bandwidth that the Customer can
enjoy may be affected by the Customer's hardware/ software, router specification, site traffic loading, content accessed, and other environmental factors; hence, it is
normally less than the specified speed. The bandwidth to overseas sites will also be subject to the conditions of the local network there, and therefore, the bandwidth might
be even less.
9. The Customer is required to register in the company's name and provide a valid Business Registration number, a copy of the Bu siness Registration Certificate, the
company name, contact telephone number(s), and email address(es) for liaison and account registration purposes. Registration in the individual's name will not be
accepted. The Customer also acknowledges that the Contact Person specified in the Order Confirmation should be its authorized representative and HKBNES, its agents
and/or contractors may take instructions directly from the Contact Person on any matters relating to the Order Confirmation including the configuration of equipment,
function, or feature setting of the equipment and service provisioning.
10. The Customer acknowledges that voice communication services provided by HKBNES must not be used by lifeline users or connecte d to lifeline devices. The Customer
also acknowledges that HKBNES will not be able to ascertain and provide the geographical location of the caller to the emergency service authorities for emergency calls
made via voice communication services provided by HKBNES. Customers must advise their geographical location to emergency service authorities during emergency calls.
The Customer will indemnify and hold harmless HKBNES or its officers or agents against any liability. claim, loss, damage or expense arising from any event of emergency
call from these services.
11. Upon service termination, HKBNES will arrange to collect the equipment(s) installed at the Customer's premises. If the equipment(s) is not retimed in good
condition, the Customer will pay HKBNES charges.
12. Premiums (if applicable) are available while stocks last. To enjoy the premium, the Service must be successfully installed, and Customer has prepaid the applicable
amount. HKBNES reserves the right to replace the premium with products of the same kind without prior notice to Customer, and the value of such replacement product
including installation (if applicable) may differ from those of the premiums. In case of any disputes, the decision of HKBNES shall be final. The premium cannot be redeemed
for cash and is not transferable. No refund will be made once the premium is redeemed. To enjoy the premiums, Customer agrees that HKBNES may transfer Customer's
company contact information to the third-party service provider(s) or agent(s) for the purpose of (a) providing the premiums to Customer: (b) registration purposes, and/or
(c) delivery and/or installation of the premium (if applicable). If delivery/installation of premiums is required, such premiums will be delivered to Customer's installation
address within 8-12 weeks after the Services commence. If delivery / installation of premiums is not required, Customer will receive premium redemption notice by email
within 8-12 weeks after the Services commence. HKBNES decision on the delivery methods of the premium shall be final. HKBNES may not be the manufacturer/supplier
of the premium offered. In that case, the ownership of the premium will be transferred to Customer at the point of successful redemption of the premium; and any concerns
on maintenance or complaints of the premiums should be directed to the manufacturer/supplier of the premiums and HKBNES is not responsible for the use of the

13. HKBNES reserves the right to modify, suspend, cancel or terminate the Package, and / or amend the applicable terms and conditions at any time without prior
notice.
14. In case of any disputes, the decision of HKBNES shall be final.
