TERMS AND CONDITIONS

Validity - This is valid up to 12 months from the date of issue.

DTDC will book the consignments of the Customer on a credit basis for delivering the same to the
Consignee at the address as provided by the Customer.
The consignments shall not contain any items or materials which are classified as Prohibited Restricted or
Hazardous or Dangerous by the ICAO, DGCA, IATA, or by any law, regulation, or provision of
any Indian or foreign government or public authority. In the event of any consignment being
found containing any
of the aforesaid items or materials, the Customer agrees and undertakes to indemnify DTDC
and its officers in respect of all claims and losses that may arise consequent thereto.
Further, the Customer will be
solely responsible for all costs and consequences for booking any such items or
materials through DTDC.
DTDC reserves the right to refuse the booking of any consignment without assigning any reason
whatsoever. Further,
DTDC reserves the right to open the packing and check the contents of any consignment.
The Customer shall not book any of the following items: (a) Currency (b) Gold (c) Narcotics (d) Explosives
(e) Hazardous items (f) Bearer Bank DD or Cheque, (g) Liquids (h) Radioactive materials
(i) Pornographic materials (j) Tender documents (k) Share certificates (l) Glass items (m)
Firearms / ammunitions
or part thereof (n) Human or animal body parts/remains or any other article which is banned
under the Indian Postal
Act, 1896. The Customer shall be liable for all consequences arising from the booking of any
of
the afore-stated items
DTDC reserves its right to withhold delivery of any consignment booked by the Customer / Consignor if
proper acknowledgment, viz. signature, company seal, date, and time of delivery is refused by the
Consignee and DTDC will not be responsible for any consequence or loss due to such non-
delivery.
All deliveries will be made only at the address mentioned on the consignment/consignment note except
when other specific instruction is given by the Customer / Consignor.
The Customer will provide the full address and telephone no. of Consignee along with PIN CODE at the
time of booking the consignment to enable identification and prompt delivery. DTDC will not deliver
any consignment with post-box address only.
The Customer will submit a written declaration and invoice, stating the value and description of any non-
document consignment along with necessary documents required by concerned State / local
authorities for GST and all other clearances. DTDC shall not be responsible for any consequences
if such value or description or
documents are not furnished or are false or are inadequate.
The Customer agrees to pack the consignment in such a manner so that it is not damaged during
transportation.
The Customer agrees to pay and/or reimburse DTDC on demand the service charges, + GST and
applicable taxes, penalties, or all other levy or taxes in respect of any consignment booked by the
Customer.
DTDC will do its best to deliver the consignments within a reasonable time period or within a
specifically agreed time limit. However, DTDC will not be responsible for any loss incurred due
to a delay in delivery.
DTDC will not be responsible for any delay in delivery, loss, or damage of the consignment caused due to
any Act of God or force majeure including accidents, natural calamities, riot, commotion, strike, or
 any other cause whatsoever beyond the control of DTDC or due to inherent defect in the contents or
due to criminal acts of
third parties. No claim for loss or/and damage will be entertained by DTDC in such events.
DTDC will not be responsible for any indirect or consequential losses of any nature whatsoever arising from delayed
delivery or damage or loss of consignment.

DTDC reserves the right to use any mode of transportation, viz Air, Railway, Road or combination of any
such modes.
Risk Coverage options for Domestic and International Non-Dox will be specified in this contract form. The
risk
The surcharge shall be settled at the time of bill payment.
Claims, if any, shall be made in writing within 45 days from the booking date and will be settled only on
receipt of evidence of expenditure and other paperwork including (a) A letter of claim (b)
Consignor copy (c) Declaration/invoice copy (d) An undertaking that there is no marine policy,
and any other document
as may be required by the Insurance Company. For the purpose of claims, the value
declared at booking shall only be considered.
DTDC holds the right to destroy all records of delivery after 90 days from booking.
The Customer agrees to make payment to DTDC as per the rates agreed upon in writing within 15
days from the date of a bill being submitted to the customer. The customer also agrees to pay GST
and applicable Taxes and Fuel Surcharge. Payment to DTDC by the Customer will be made by
account payee cheque or DD in favor of ‘SV ENTERPRISES. (Formerly known as DTDC CHANNEL
PARTNER)’ For any delay in making payment of bill amount, DTDC shall be entitled to claim
interest @ 24% p.a. from the Customer. It is advised by DTDC that the Customer should not make
such payments in cash.
In the event of non-payment of any of the dues or payments, charges, taxes or levies as payable hereunder
DTDC shall have right of lien over any of the consignments of the Customer.
If Customer seeks facility to pick up and book consignments from various stations simultaneously, then
the minimum billing amount per station should be 5000 /- per month.
. The arrangement under this agreement will continue till it is terminated by either party by
giving 30 days
notice in writing to the other.
The terms and conditions printed overleaf of the consignment note shall be considered as part of this
agreement
and in event of any conflict, the
Consignment Note terms shall prevail.
Fuel Surcharge is subject to change based on the Fuel Index.
All disputes between the parties hereto arising in from the transactions under this agreement shall be
resolved by
arbitration under the Arbitration and Conciliation Act, 1996. The place of arbitration shall be
Mumbai.
