regulatory law that regulates of governs practice of nursing in the Philippines.
It provides for grounds of reasons for reprimand, suspension or
revocation of a license to practice nursing in the Philippines.
The Nursing act, however is applicable only in the Philippines and is not
recognized anywhere in other countries.
Where the complaint is filed: the complaints is called administrative
complaints and is filed with board of nursing which under the PRC
It is one of the types of legal liability in the form of a negative reaction of
the authorized bodies of a particular state to administrative offenses committed by an
individual
Nature of Liability: the liability under and administrative case is
purely personal to the respondent nurse. In other words, the license of the hospital is
not affected by the guilty verdict on the supposed negligent nurse
Nurse can be liable in civil damages for negligence
nurse does not meet the accepted standards of practice, he or she may be found
negligent if his or her negligence caused a patient harm
Nurse can be and have been charged criminally for gross negligence or for
intentional acts
There are four elements that constitute a claim of nursing negligence :
Duty of care = a nurse fails to meet that of a reasonable standard of nursing
care.
Breach of duty= the care provided by a nurse fails to meet a reasonable
standard, resulting cauin mental and/or physical suffering for a patient
examples are: Not assessing a patient's condition (such as blood pressure
or blood sugar levels) on time. Errors when administering medication.
Failing to report test results to a doctor or other healthcare professional
Causation= proving that the nurses breaches duty of care has caused injury or
loss
example: After I exercise, I feel physically exhausted. This is cause-and-
effect because I'm purposefully pushing my body to physical exhaustion
when doing exercise
Damages = injuries the patient suffers due to the nurse's negligence.
Malpractce a nurse failed uphold legal or professional responsibilities.
when a nurse fails to perform the job duties that a competent nurse would do,
must be licensed when practicing the profession
Not updating a patient's chart or updating it incorrectly;
Failing to respond to a patient's call for assistance;
Failing to call a physician when needed
Any medical practitioner who performs any act constituting medical malpractice
or the illegal practice of surgery shall be punishable by imprisonment or fine or
both and, in all instances, the cancellation of the license to practice medicine
Liabilities of Hospital administrator= they are responsible for organizing and
overseeing the health services and activities in hospital or health. They will ensure
adequate patient care amongst duties and manage staffs and budget and also
communication in all departments.
