DEED OF TRUST
This DEED OF DECLARATION OF TRUST as executed at Jolarpettai on
29th day of July, 2024 by AKILAN PALANIMUTHU, son of Palanimuthu, aged
about 35 years, residing at No. 12 A, Mettu Chakkarakuppam Colony, S – Kodiyur,
Jolarpettai, Tirupathur Taluk & District – 635 851, hereinafter called the
FOUNDER/AUTHOR of the Trust.
WHEREAS the FOUNDER/AUTHOR of the Trust is desirous of creating an
educational Trust of public nature for running educational activities set out
hereunder; hereinafter called as “MCK EDUCATIONAL TRUST”.
AND WHEREAS it has been considered necessary to execute a Deed of
Trust declaring the objects of the Trust and powers and duties of the Trustees as
follow:
NOW THIS DEED OF TRUST WITNESSETH AS FOLLOWS:
1) NAME OF THE TRUST: The name of the Trust shall be “MCK
EDUCATIONAL TRUST” band the office of the Trust shall be function at
No. 12 A, Mettu Chakkarakuppam Colony, S – Kodiyur, Jolarpettai, Tirupathur
Taluk & District – 635 851 or such other place/s as may be decided by the
Trustees from time to time.
2) CREATION OF THE TRUST:
In pursuance of the intention, the FOUNDER/AUTHOR OF TRUST, has
settled the sum of Rs.1,000/- (Rupees ONE THOUSAND only) by cash unto and in
favour of the TRUSTEES herein to be held by them for and on behalf of the Trust
hereby created and known as “MCK EDUCATIONAL TRUST”. The receipt of
which sum of Rs.1000/- which has already been handed over to the TRUSTEES
mentioned hereunder, is hereby acknowledged by the TRUSTEES, who hereby
accept the appointment as such TRUSTEES of the said Trust, under the terms and

conditions, set out hereunder for the fulfillment of the objects of the Trust, more
fully and particularly described and set out hereunder.
3) VISION:
The Trust’s vision to be a leading Educational Trust in India, producing
students of noble mind, who blend naturally human values, traditions, culture and
democratic ideals, to contribute proactively in the international and local
communities as well as their homes and families.
4) MISSION:
The aim of the Trust is to provide Educational support in terms of Fees,
Books, and other material support to each and every needy poor students to make
them have an ideal learning environment to grow and excel from the time they
begin their educational journey with us. The Trust is purely created to do the utmost
possible to offer the students with a vibrant and enjoyable education opportunity
that equips them for lifelong challenges.
5) BOARD OF THE TRUST:
The FOUNDER/AUTHOR of the Trust has appointed the following persons
to hold the office of the Trust:
1) AKILAN PALANIMUTHU, aged about 35 years, son of Palanimuthu,
residing at No. 12 A, Mettu Chakkarakuppam Colony, S – Kodiyur, Jolarpettai,
Tirupathur Taluk & District – 635 851, shall be act as MANAGING TRUSTEE
for his lifetime.
2) SUNDARAMOORTHI NAMADEVAN, aged about 32 years, son of
Namadevan, residing at No. 15/15, Mettu Chakkara Kuppam Colony, S – Kodiyur,
Jolarpettai, Tirupathur Taluk & District – 635 851, will be act as JOINT
MANAGING TRUSTEE

3) PRAVEEN KUMAR, aged about 29 years, son of Kumar, residing at No.


10/21, M C Kuppam, S – Kodiyur, Jolarpettai, Tirupathur Taluk & District – 635
851, will be act as SECRETARY.
4) PARIVALLAL SARAVANAN, aged about 42 years, son of Saravanan,
residing at No. 42/A, Mettu Chakkarakuppam Colony, S – Kodiyur, Jolarpettai,
Tirupathur Taluk & District – 635 851, will be act as TREASURER.
5) PRASANTH DURAIRAJ, aged about 28 years, son of Durairaj, residing at
No. 18/7, Mettu Chakkarakuppam Colony, S – Kodiyur, Jolarpettai, Tirupathur
Taluk & District – 635 851, will be act as TRUSTEE.
6) VASANTH DURAIRAJ, aged about 31 years, son of Durairaj, residing at
No. 18/7, Mettu Chakkarakuppam Colony, Jolarpettai, Tirupathur Taluk & District
– 635 851, will be act as TRUSTEE.
7) HARIKUMAR SIVALINGAM, aged about 38 years, son of Sivalingam,
residing at No. 41/31, Vaniyambadi Main Road, Mettu Chakkarakuppam, Reddiyur
Post, Jolarpettai, Tirupathur Taluk & District – 635 851, will be act as TRUSTEE.
8) VALLARASU VASUDEVAN, aged about 30 years, son of Vasudevan,
residing at No. 15/15, Vaniyambadi Main Road, Mettu Chakkarakuppam Colony,
Jolarpettai, Tirupathur Taluk & District – 635 851, will be act as TRUSTEE.
9) NAVEEN DHANDAPADNI, aged about 26 years, son of Dhandapadni,
residing at No. 56, Mettu Chakkarakuppam Colony, Jolarpettai, Tirupathur Taluk &
District – 635 851, will be act as TRUSTEE.
10)DEEPAK DHANDAPADNI, aged about 23 years, son of Dhandapadni,
residing at No. 56, Mettu Chakkarakuppam Colony, Jolarpettai, Tirupathur Taluk &
District – 635 851, will be act as TRUSTEE.

11)RAJA SAMIYAPPAN, aged about 39 years, son of Samiyappan, residing at


No. 5B, Mettu Chakkarakuppam Colony, S – Kodiyur, Jolarpettai, Tirupathur Taluk
& District – 635 851, will be act as TRUSTEE.
6) OBJECTS OF THE TRUST:
1) To provide financial assistance and guidance and support to the
students in the discovery and development of their own giftedness and
uniqueness.
2) To encourage the students to use their gifts and talents for the
betterment of others.
3) To make the students are called to responsible citizenship in the
world.
4) To provide comprehensive approach in education - the entire child is
educated physically, mentally, and spiritually.
5) To encourage faculty, staff, students and families to experience
learning and living fully integrated in the light of faith.
6) To prepare the students to be responsible intelligent in order to
assume leadership roles in civil and Just society.
7) To establish and run school to university education in a conducive
atmosphere to deserving students especially those belonging to the rural
community. Although this educational Trust is meant primarily for poor it does
admit other students irrespective of their caste and creed.
8) To import training to the students, qualify to be leaders in all walks of
life and serve their fellowmen with justice truth and love. It is expected that this
training would play a vital role in bringing about the desired change for the
betterment of people of our country more particularly the poorer and
marginalized sections of the society further it will foster an atmosphere of

intellectual vigor and moral rectitude in which the poor students of our country
may find their fulfillment and achieve greatness.
9) To promote all round development of the students’ abilities and
personality.
10) To develop an awareness of the role of science and its application in
the understanding of problems of the contemporary society.
11) To extend and disseminate knowledge and to foster its application.
12) To establish a community of scholars, students, and staffs in which
understanding and wisdom can grow and flourish.
13) To provide undergraduate and postgraduate programs in the field of
Engineering, Science, Management, Arts and Medical Science in the near future.
14) To support Trust mission by providing courses in the core curriculum.
15) To nurture qualities this will enable the students to function with
proficiency and compassion within the human family.
16) To empower the students to function in a global society by allowing
them opportunities to learn more about themselves and their society.
17) To develop leadership skills.
18) To prepare the students for entry in to graduate and professional
schools.
19) To prepare the students for entry level positions in government,
business and industry.
20) To publish journals, pamphlets, books for promoting the said aims and
objectives for private circulation.
21) To work in co - operation with the similar voluntary social work
organizations in India and other countries for the betterment of the students.

22) To establish branch offices, regional offices and the like and to
initiate inter – groups and inter – state projects and enable local group and
branches of social welfare organization to carry them out.
23) To participate and contribute in conferences, seminars, symposia
organized by foreign governments, international children Forums, United
Nations from time to time benefit from the exchange of ideas and experiences.
24) To raise funds, donations, grants from Government of India and State
Government of Tamilnadu and outside to carryout activities to achieve the
objectives of the Trust.
Do and cause to be done any and all such act as shall be conducive to the
social economic, cultural, educational, ethical welfare of rural and urban poor
children or other groups of people requiring support and assistance of the Trust,
provided such things or act are not contrary to not inconsistent with the sprit and
principles of law and which are necessary for the furtherance of the objectives of
the Trust, but shall not include any activities of profit and the income where so
ever derived shall be applied solely towards the promotion of the objectives of
the Trust.
To furtherance or to develop in peaceful way to undertake allied or
ancillary objectives or steps which may promote the furtherance’s of the above
objectives.
7) BENEFIT OF THE TRUST:
The Benefits of the Trust are open to all irrespective of Caste, religion, race,
sex etc. That the Trust will not carry on any activities with an intention of earning
profit.
8) THE PROPERTIES OF THE TRUST:
The properties of the Trust shall be:

1) The said sum of Rs.1,000/- above referred to the receipt of which is


hereby acknowledge by the TRUSTEES;
2) Any properties movable or immovable, that may be acquired in future
by the Trust, either by purchase or otherwise;
3) All future additions and acceptations of the Trust fund;
4) All future voluntary donations both towards corpus or otherwise gifts,
legacies or grants in cash or in kind accepted by the TRUSTEES;
5) All future grants and contributions made to the Trust by the
Government, Government bodies, Trust or Institutions, Trade Union or Societies
etc; and
6) All future sums and assets which by and means become the property
of the Trust.
9) QUALIFICATION OF THE TRUSTEES:
The qualification for the TRUSTEES shall be any degree.
10)CO-OPTED TRUSTEES:
The FOUNDER/AUTHOR of the Trust shall co-operate Additional
Trustees. Such Additional Trustees are termed as CO-OPTED TRUSTEES.
Such CO-OPTED TRUSTEES shall hold the office only for the period said
below and the CO-OPTED TRUSTEE or Trustees shall be deemed to have
vacated earlier on the following contingencies:
1) If he/she does not desire to continue in office and resigns the office of
the Trustee.
2) If he/she is adjudged insolvent.
3) If he/she suffers from any illness affecting his/her mental capacity.

4) If he/she suffers from any chronic illness physically preventing


him/her from functioning as Trustee for continuous period of six months.
5) If, by a majority decision of the Trustees, the co-opted Trustee/s is/are
expelled for reasons that such Trustee/s action is prejudicial to the object and
intent of the Trust.
6) This co-opted Trustee’s term is for one year of continuous period.
11)OTHER TRUSTEES:
Whenever a vacancy occurs by reason of the CO-OPTED TRUSTEE
vacating this office under Clause 10 of above, then in all such cases, the Managing
of Trustee may fill up such vacancy at a meeting. The office of any co-opted of
Trustee who vacates office shall be filled up by the founder Trustees by co-option.
The Trustees vacating the office may be co-opted again.
12)APPOINTMENT OF BEARERS OF TRUST:
1) The Board of Trustee shall elect a MANAGING TRUSTEE and a
JOINT MANAGING TRUSTEE from among the Trustees, whose term of shall
be three years and they shall be eligible for re – election on expiry of their term
of office.
2) That if any difference of opinion shall arise among the Trustee as to
the execution of the trusts hereof or in exercise of the powers authorities and
directions herein contained or in any other matter arising out of or in relation to
the Trusts hereby declared the same shall be settled and disposed of in
accordance with the opinion of the two third majority of the Trustees and in the
event of the Trustee being equally divided the Managing Trustee and Joint
Managing Trustee of the Trustees shall have a casting vote in addition to their
own.

3) The Secretary and Treasurer of shall elected by the Board of Trustee


from among the Trustees of the Board. They shall be responsible to the
Managing Trustee in all matters concerning the accounts, funds and properties of
the Trust. The Treasurer shall be responsible to prepare and submit annual
income and expenditure statement and balance sheet of the trust within four
months from the closing of the financial year of the Trust before the Board of
Trustees.
13)MEETINGS OF THE TRUSTEES:
1) The MANAGING TRUSTEE and the JOINT MANAGING TRUSTEE shall
preside over all the meetings of the Trustees and in the absence of both, the Trustees
attended such meeting may elect any one of them to preside over the meeting;
2) The meetings of the TRUSTEES may be convened by the MANAGING
TRUSTEE and the JOINT MANAGING TRUSTEE or under their direction by any
other TRUSTEES;
3) The quorum of meeting of the Trustees shall be at No. 12 A, Mettu
Chakkarakuppam Colony, S – Kodiyur, Jolarpettai, Tirupathur Taluk & District –
635 851; and
4) In the event of equality of votes, the person presiding such meeting shall
exercise casting vote (additional vote).
14)POWERS AND FUNCTIONS OF TRUSTEES:
The Board of Trustees shall have the control and management of the Trust and
shall exercise the following powers:
1) To establish as many ad hoc committees as warranted for any purpose.
2) To determine from time to time to commence and to take up the object and
purposes for which the funds of the trust shall be used and allot and allocate to each
of the objects such portion of the funds as they deem fit.

3) To incur all expenditure necessary as in their own opinion useful for


carrying out the objects and administration of the trust.
4) The Managing Trustee and Joint Managing Trustee are empowered to
express their opinion and views for the efficient administration of the school.
5) The Trust members shall have power and authority to appoint or engage
and at their discretion to remove, dismiss or suspend one or more office supporting
staffs, laboratory staffs and school staffs or employees and persons in permanent,
temporary members or special service in connection with the work of the thrust and
trust properties.
6) To open one or more bank accounts of the trust with any bank or banks as
the Trustees may deem fit and deposit monies of the Trust in the Bank accounts.
7) To borrow for and on behalf of the Trust with or without security from
banks, Governments, Universities or any other government Body/bodies both Central
and State.
8) To incur such other items of expenditure as is necessary and incidental for
carrying out the objects of the Trust.
9) To institute, conduct, defend, compound, withdraw, compromise, adjust
and refer to arbitration or to do such things as are incidental and necessary,
concerning the affairs of the Trust and to sign and verify vakalaths, pleadings,
affidavits and other powers.
10) To delegate all or any of the powers vested in the Trustees to anybody to
frame rules, bylaws and other codes for the conduct of the affairs of the Trust and its
transactions and establishing any Committee.
11) To accept contributions in cash or in kind either by way of addition to the
trust funds generally or for any one or more of the specified objects of the Trust.
12) The Members of the Trust shall at any time invite and receive any
voluntary contribution from any persons or any other associations by way of

donation, legacy or otherwise. All such contribution shall be treated as forming part
of the school fund being the subject-matter of these presents provided that it shall
always be for members of the trust.
13) The Trust shall have power to deposit the school fund or any portion
thereof in any nationalised bank either by way of fixed deposit or in a current account
operated jointly the members of the trust in concurrence with founders of this trust.
14) The Trust fund shall not be invested in any private individuals or firm or
association of persons or body of individuals except the same shall be invested in
Government Securities or in any other approved investments only.
15) The Trust and its members shall conduct meetings at least once in a year
and as when it is considered to be necessary. The Minute Book of the same shall be
maintained and the same has to be signed by all the members of the Trust.
16) That for the good administration of the Trust, the FOUNDER/AUTHOR
feel that the Trust may act under advice from an Advisory Committee with regard to
technical and professional expertise and nominate key personalities as the Advisory
Committee members or any other experts as chosen by the FOUNDER/AUTHOR of
the Trust.
15)RESOLUTIONS:
1) The TRUSTEES may exercise all the powers vested in them in clause 11
under these presents by resolution passed at a simple majority of the Trustees
attended such meetings of the Board of Trustees.
2) Any resolution in writing signed by all Trustees holding office for the time
being shall be valid and binding.
16)SUITS:
The Secretary of the Trust is authorized to sue or to be sued on behalf of the
Trust.

17)EXECUTION OF DOCUMENTS:
All Deeds, Documents, etc., shall be executed by Secretary and Treasurer
jointly representing the Trust.
18)ACCOUNTS AND AUDIT:
1) The Trustees shall maintain true and correct accounts of all Trust funds and
of all the income and investments and all the outgoing expenses.
2) The year of account shall be the financial year commencing from 1 st APRIL
and ending 31st March, of each year.
3) Projects and programs shall be approved by the Board of Trustees and
allotment of funds made accordingly.
4) The Trustees shall each year issue a report setting out the accounts showing
the income and expenditure of the Trust for the preceding year not later than six
months from the end of the preceding year of accounts.
5) The accounts of the Trust shall be audited every year by a Chartered
Accountant who may be appointed for the purpose by the board of Trustees and the
audited statement of accounts together with Auditors’ report shall be laid before the
Board of Trustees for approval.
19)BANK ACCOUNT:
The Secretary and the Treasurer of the Trust shall operate bank account(s)
jointly.
20)POWER TO ALTER RULES AND REGULATIONS:
The Board of Trustees shall have full power and authority to make, alter and
rescind rules and regulations for the management and administration of the Trust.
Any amendment to the Trust Deed will be carried out only with the approval of the
Commissioner of Income Tax.

21)APPLICATION OF INCOME AND TRUST FUND:


The Board of Trustees shall be empowered to invest the funds of the Trust in
movable or immovable properties, in such manner as they deem fit for the purpose
of the objects of the Trust provided that such investments shall be in accordance
with the provision of Section 13(I) read with Section 11(5) of the Income Tax Act,
1961 as well as of any other law for the time being in force as are applicable to
charitable Trusts.
22)REMUNERTION TO THE TRUSTEES:
The Trustees are not entitled for any remuneration. They shall however be
entitled to receive out of pocket expenses incurred by them in the course of
discharging the functions of the Trust. Further the Income and funds of the Trust
will be solely utilized towards the objects and no portion of it will be utilized for
payment of Trustees by way of profits, interest, dividend or otherwise.
23)INDEMNITY:
Every Trustee shall be indemnified out of the fund in respect of any loss
arising from or contingent upon any investment made out of the funds of the Trust
unless such loss shall have been occasioned by own negligence and also every
Trustee shall be indemnified out of the Trust against all proceedings, suits, claims,
costs, damages and expenses occasioned by any claim in connection with the
matters or affairs relating to the Trust created by these presents or in the exercise of
powers or discretion vested in them by virtue of these presents.
24)IRREVOCABILITY:
The Trust is irrevocable.
25)ACTIVITIES OF THE TRUST:
The activities of the Trust shall be only within India and its Union territories
and shall not be extended anywhere outside India.
