MEMORANDUM OF AGREEMENT
This Memorandum of Agreement made and entered into this __________ day of ________________, 2021 by
and between:
BARANGAY BUNTATALA, a Local Government Unit (LGU) in the district of Jaro, Iloilo City and represented by
its Punong Barangay Hon. Starlene M. Hosenilla of legal age, Married, Filipino and a resident of Barangay
Buntatala, Jaro, Iloilo City, Philippines, hereinafter referred to as the FIRST PARTY; and,
______________________________________, of legal age, ______________, Filipino and owner of
_________________________________ Junkshop with business address at Barangay _________________,
Iloilo City, Philippines, hereinafter referred to as the SECOND PARTY.
1. PURPOSE AND SCOPE
The purpose of this Memorandum of Agreement is to set fort the terms and conditions. Scope of work and
responsibilities of the parties with their collaboration on junk and scrap business as partner in the recovery
of valuable wastes and as alternative recycling center for the Barangay in compliance to RA 9003.
Specifically, both parties will cooperate to develop a lasting business relationship based on mutual trust,
sustainability of scrap/recyclable/junk supplies and competitive pricing.
2. BACKGROUND
Both parties see the benefits of this undertaking having a desire to pursue the project and have determined
that each brings unique roles, expertise and experience to succeed in this endeavor.
The FIRST PARTY, the barangay in its Solid Waste Management Program has implemented the
segregation at source of the garbage materials into biodegradables, recyclables and residuals. Solid
wastes materials are collected and deposited in the Barangays Materials Recovery Facility (MRF) and
designate waste depository that when these solid materials are plenty could be brought to the shop or
collected by the assigned person of the SECOND PARTY.
The SECOND PARTY, upon receipt will classify these reusable or recyclable scraps and buy them at a
competitive price and remit the money to the barangay thru the Barangay Treasurer. The SECOND PARTY
shall submit to the barangay written summary of the sold recyclable materials and the rejected scraps.
3. PARTY’S RESPONSIBILITIES
The Barangay, being the FIRST PARTY, has the following responsibilities:
a. Thru the Punong Barangay with the assistance of the Barangay Officials will intensify the campaign
on segregation at source of waste materials.
b. All recyclable materials shall be collected and deposited to the MRF.
c. The Punong Barangay shall assign an MRF Manager or any designated person to classify and
prepare the recyclables to be brought to the junkshop or for pick-up by the junkshop.
d. Prepare a report of all collected, deposited and disposed recyclable materials.
The Junkshop, being the SECOND PARTY, has the following responsibilities:
a. To pick-up or receive and but the recyclable materials from the Barangay.
b. To pay the Barangay the corresponding price of the materials sold.
c. To report to the Barangay any rejected scrap.
d. To submit a written report to the barangay of all accepted scraps.
4. TERMS AND CONDITIONS
It is mutually understood and agreed by and between the parties that:
a. Each party takes cognizant of the responsibility to abide fully the provisions of the Memorandum of
Agreement.
b. This Memorandum of Agreement is entered into the basis of trust and equality that each party will
benefit the fruits or outcomes of the partnership.
c. This Memorandum of Agreement may be amended from time to time by mutual agreement of the
parties in a written modification signed by the parties.
d. This Memorandum of Agreement may be terminated by mutual agreement of the parties, and shall
automatically terminate upon completion of all responsibilities as stated herein unless otherwise
amended.
5. EFFECTIVITY DATE AND SIGNATURE
This Memorandum of Agreement (MOA) shall be effective upon the date of the last party to sign this MOA
below. The parties shall indicate agreement with this Memorandum of Agreement by their signatures
below.
