CONSTITUTION
(ARC)

APPRECIATION
The committee members expressed their profound gratitude and sincere
appreciation to the entire Al-Istissal Ruqya Community, for the opportunity to
serve in this committee.

ARTICLE 1: NAME
The organization shall be known as Al-Istissal Ruqya Community,
Nigeria, hereafter referred to as Eradication ruqya group (ERG).

ARTICLE 2: REGISTERED OFFICE:
The registered office of the organization shall be situated ( where
committee agrees to establish the national centre)

national body has to be somewhere that people can easily connect with
ARTICLE 3: AIMS AND OBJECTIVES (THIS SHALL BE EDITED TO GO IN
LINE WITH OUR BLUEPRINT AS OBJECTIVES):
3.1 ARC shall uphold strict observation of Quranic injunctions and
sunnah of the Holy Prophet Muhammad (S.A.W) without any sectarian
inclination.
3.2 The community shall observe the ruqya methods of Ben Halema Abdelrraouf
as baseline with other methods as long as they are in line with the injunctions
of the Qur'an and Sunnah of the prophet Muhammad (SAW)
3.3 The ARC shall propagate and strengthen the religion of Al-Islam
among all members of the group and the ummah at large and anywhere
in all ramifications.
3.4 The ARC shall engage in activities to promote the purpose of the group.
3.5 ARC shall promote cooperation with other recognized Muslim
bodies at the State, Regional, National and International levels in
accordance with guidelines of the Noble Quran and Sunnah.
3.6 ARC shall promote friendly relations and understanding between
Muslims and in accordance with the teachings of the Quran and the
Sunnah.
ARTICLE 4: MEMBERSHIP
4.1 Membership shall be open to any Muslim Raqi or student who subjects
himself/herself to Quranic injunctions and Sunnah of the Holy Prophet
Muhammad (S.A.W). Acceptance of membership shall be based on the
Shura agreement to strictlyabide-by, and support the goals,
objectives, constitution, rules and regulations of the ARC.

4.2 There shall be active membership by a process of registration with its
attendant obligations and responsibilities as may be specifically
determined from time to time by the recommendation of the
Management Committee.
ARTICLE 5: ORGANIZATIONAL STRUCTURE:
5.0 The ARC shall have the following Administrative Organs:
5.1 The Executive Council.
5.2 The General Assembly.
ARTICLE 6: EXECUTIVE COUNCIL
6.0 Functions:
6.1.1 The Executive Council shall be made up of 14 members.
6.1.2 It shall manage and administer all activities of the ARC under the
general direction and supervision of the General Assembly.
6.1.3 It shall have power to delegate responsibilities to other organs or
individual members of the ARC as it deems fit.
6.1.4 The Executive Council shall be responsible for appointment and
composition of its committees.
6.1.5 It shall have the right to invite any one as a non-voting observer and/or
consultant to its meetings.
6.1.6 The Executive Council shall, in consultation with the General
Assembly, appoint members of ARC to fill any vacant post following other
due processes of selection in the Executive Council.
6.1.7 It shall be responsible for the registration of members of the General
Assembly and updating the records of membership.
6.1.8 The Executive Council shall make recommendations to the General
Assembly on the appointment of the Ameer/Ameera and Committee
members of with due regards to Islamic knowledge, proven leadership,
Ruqya knowledge and catching experience and general acceptability on
the recommendations of the Shura Committee.

ARTICLE 8: FUNCTIONS/DUTIES/TENURE OF OFFICES:
8.2 AMEER
8.2.1 The Ameer shall be nominated by the Shura Committee and ratified by
the general assembly.
8.2.2 He shall be-in-place until he writes to resign or death. (open to
discussion)
8.2.3 He shall advise on all religious and spiritual affairs of ARC with
consultations with the Shura.
8.2.4 The Ameer shall be selected through consultations by Shura/Fatwa
Committee, if the incumbent Ameer resigns, leaves the country or dies.
8.2.5 The Ameer shall preside over the meetings of the General Assembly.
8.3 Functions of the AMEER
8.3.1 The AMEER shall direct all affairs of the organization and preside over
all Executive Council meetings.
8.3.2 He summons all meetings in collaboration with the General Secretary.

8.3.3. He shall be responsible for day to day running of ARC.
8.3.4 He shall submit an annual report to the General Assembly through the
Executive Council.
8.5.5 He shall be a signatory to all accounts of the ARC.
Vice Ameer
8.3.1 The vice Ameer shall be nominated by the Shura Committee and ratified by
the general community.
8.3.2 The vice Ameer shall preside over the meetings of the General community in a
case where the Ameer is not available.
8.3.3 The Vice Ameer shall act for the Ameer in the Former’s absence
8.3.4 He shall perform other functions as may be assigned to him by the Chairman.
8.3.5 He shall be selected through consultations by the General community.
8.4 General Secretary
8.4.1 The General Secretary shall issue notice of meeting after due
consultations with the Chairman and Executive Council
respectively.
8.4.2 He shall keep the administrative records of ARC and see to the
smooth running of the Secretariat.
8.4.3 He shall open and maintain the registers of members of ARC.
8.4.4 He shall keep records of assets of the ARC.
8.4.5 He shall be a signatory to the bank accounts of the ARC.
8.5 Assistant Secretaries
8.5.1 There shall be Assistant General Secretaries.
8.5.2 He/she shall assist the General Secretary in the performance of his
duties.
8.5.3 He shall act for the General Secretary in his absence.
8.5.4 Each of the Assistant General Secretaries shall serve as Secretary to
each of the standing Committees of ARC.

8.5.5 The Assistant General Secretaries shall be appointed by the Executive
Council.
8.6.0 Treasurer
8.6.1 The Treasurer shall bank all monies collected by the next work day.
8.6.2 The Treasurer shall keep proper records of financial transaction.
8.6.3 The Treasurer shall disburse funds of ARC only through payment
voucher raised by him/her and duly signed and audited by the auditor.
8.6.4 The Treasurer shall be signatory to the ARC bank account. He
shall also be the custodian of all ARC account, cheque books and other
financial documents.
8.6.5 The Treasurer shall prepare and submit the required financial accounts
and budgets of the Executive Council quarterly or upon request, which
may be presented to the General Assembly.
8.7.0 Financial Secretary
8.7.1 The Financial Secretary shall receive all monies on behalf of ERG
and hand over same to the Treasurer.
8.7.2 The Financial Secretary shall co-ordinate donations in cash and kind
during Jumaat and Eid prayers, and account for same to the Treasurer by
the next work day.
8.7.3 The Financial Secretary shall prepare and present to the Executive
Council and General Assembly, the periodic statement of income and
expenditures of ERG.
8.7.4 The Financial Secretary shall open and maintain the register of
contributors in cash and kind of the ERG.
8.8.0 Auditor
8.8.1 The Auditor shall carry out internal audit of ARC books and account in
respect of all incomes and expenditures as well as assets and liabilities
of ARC every year or as may be requested by ARC and report to the
Executive Council and General Assembly as appropriate.

8.9.2 The Auditor shall have power to request officers of ARC to submit all
documents and information required for the performance of his/her
assignment.
8.9.3 The internally audited account shall be subjected to External audit.
8.10 Legal Adviser
8.10.1 The Legal Adviser shall provide legal counsel to all organs of the
ARC as required.
8.11. Publicity Secretary
8.11.1 The Publicity Secretary shall project a good image of the ARC in
terms of personal actions and official activities of the ARC.
8.11.2 The Publicity Secretary shall publicize the activities of the ARC
through the media or any other approved platform.
8.11.3 The Publicity Secretary shall be responsible for media watching in order
to bring to the attention of the Executive Council any positive or
negative publicity on the ARC.
8.11.4 The Publicity Secretary shall be responsible for the general information
and communication functions of the ARC.
ARTICLE 9: COMMITTEES OF THE EXECUTIVE COUNCIL
9.1 Development Committee.

9.1.2 Functions of Development Committee

9.1.2.1 The Committee shall be responsible for the development of the community,
its Ruqya Centre and organize ruqya campaign for the community.
9.1.2.2 It shall meet once in a month.
9.1.2.3 The Committee shall work hand in hand with the Executive Council.
9.1.2.4 The Committee shall give account of its activities at every meeting of the
Executive Council.
9.2 Fatwa and Shurah Committee
9.2.1 Membership of the Fatwa and Shurah Committee.
9.2.1.1 The Committee shall have six (6) members of which at least two (2)
members shall be well versed in Arabic and Islamic studies and the
other four (4 of which 2 may be female) members may be desirable for some
good reasons or in furtherance of some objectives of the
execution of the programs and activities.
9.2.1.2 AMEER shall be appointed by the SHURA Council.
9.2.1.3 Ameer of the shura shall be nominated by the shura on every meeting
based on needs and expertise.
9.2.2. Functions of Fatwa and Shurah Committee
9.2.2.1 The Committee shall be responsible for coordinating ruqya campaigns, as well
as others which are in consonance with the guidelines and aspiration of the
community.
9.2.2.2 The Committee shall be responsible for organizing Ruqya training and
holistic training program for educational activities of ARC.
9.2.2.3 The Committee shall give opinion/Fatwah on contemporary issues that
are of interest to the group in particular and the nation in general.
9.2.2.4 The Committee shall make recommendations to the Executive Council
on the appointment of the Ameer/Ameera with due regards to Islamic
Knowledge, proven leadership experience and general acceptability.
9.2.2.5 The committee shall give an account of its activities at the meeting of
the Executive Council.

9.2.2.6 Delegation of the committee to ceremonies/Lecture seminars and ruqya
training shall render financial accounts of donation/gifts to the
Financial Secretary and a formal report shall be presented at Executive
Council meetings.
9.2.2.7 The Committee shall meet at least once a month.
9.2.2.8 The Committee shall work hand in hand with the Executive Council.
9.3 Centre Management Committee
9.3.1 Membership of Centre Management Committee
9.3.1.1 The Committee shall consist of eight (8) members drawn across the
various states and regions
9.3.1.1.1. Chairman.
9.3.1.1.2. Vice Chairman.
9.3.1.1.3. Representative of Works and Maintenance of the Centre (1).
9.3.1.1.4. Representative of Security matters of the Centre (1).
9.3.2 Functions of Centre Management Committee
9.3.2.1 The Centre Management Committee shall be responsible for
maintenance/supervision of the Centre, its premises, service and utilities
i.e., cleaning, sanitation and control of use.
9.3.2.2 The committee shall recommend to the Executive Council any
improvement to the Centre premises as may be deemed necessary.
9.3.2.3 The Committee shall supervise the workers of the Centre.
9.3.2.4 The Committee shall handle other matters that may be necessary to
improve the management of the centres.
9.4 Welfare Committee
9.4.1 Membership of the Welfare Committee
9.4.1.1 Ameer.

9.4.1.5 Raqi

9.4.2 Functions
9.4.2.1 The Welfare Committee shall take care of matters relating to the welfare
of the members of the ARC.
9.4.2.2 The Committee shall investigate, and settle all matters affecting
members of the community brought to its notice by other members of
ARC or the general public
9.4.2.3 The Committee shall process all financial aids and disburse as
applicable.
9.4.2.4 The Committee shall report to the Executive council.
ARTICLE 10:
APPOINTMENT/RESIGNATION/SUSPENSION/REMOVAL/
DISQUALIFICATION.
10.1 Members of Standing Committees shall be approved through resolution
of the Executive Council provided that all standing committee shall be
headed by a member of Executive Council.
10.2 Any member of Executive Council who wishes to resign his/her
membership shall notify the respective Council formally through a
written resignation letter submitted to the General Secretary.
10.3 Such resignation shall take effect upon ratification by the General
Assembly.
10.4 The General Assembly shall have the powers to suspend or remove from
office any member found wanting in the discharge of his/her duties.

10.5 When allegations are made against any member of any organ of the
ERG, a panel of five (5) members shall be constituted of the Executive
Council to investigate the allegations and appropriate
recommendation(s) to the General Assembly.
10.6 Any member of the General Assembly/Executive Council shall cease to
hold office if:
10.6.1 He/she ceases to be a Muslim.
10.6.2 He/she resigns his membership of the committee.
10.6.3 He/she become incapacitated (due to prolonged illness etc.)
10.6.4 He/she is convicted of a criminal offence by a court of competent
jurisdiction.
10.6.5 He/she is removed from office under the provisions in Article 13.5.
10.6.6 He/she is removed from office under the provisions of Article 10.5.
10.7 A vacancy in the membership of an organ of ARC shall occur if a
member dies or ceases to hold office under any of the conditions in 10.7.
ARTICLE 11: CODE OF CONDUCT
11.1 Any member who desires to speak to the congregation on ruqya matters
must be well trained and at least understand the core mandates of ruqya.
11.2 No one shall distribute literature or medicine at the gathering of
ARC without authorization by the AMEER/AMEERA.
11.3 No one can sponsor any gathering on the grounds of ERG or at any
activity organized by ARC without the prior written consent of the
Chairman, Executive Council of the ARC.
11.4 Visitors and speakers from abroad or outside the membership of the
ARC do not necessarily represent the policies or the stand of ARC.
ARTICLE 12: FINANCE
12.1 Income.
12.1.1 Sources of income shall include members contributions, donations, sales
(e.g., Treatment means and Islamic medicine) treatment, Zakat and other
Halal Collections.

12.1.2 Voluntary contributions for any project of ARC in any form from any
source must be consistent with the purpose of ARC and the principles
of Islam.
12.2 BANK ACCOUNT
12.2.1 A single current account where income(s) are deposited, and expenses
carried out shall be adopted. ARC shall maintain the following
bank accounts according to the policy guidelines of the General
Assembly.
12.2.1.1 Expenses Account: Interest free account for ARC current income and
expenditure. The Executive Council shall regulate flow of fund into and
from this account.
12.2.1.2 Development Account: Account created to keep donations collected
from specific projects shall be approved by the General Assembly.
12.3 Signatory to Account
12.3.1 All cheques in respect of legitimate expenditures for ARC shall be
signed by the AMEER and any of the two exco’s i.e., General Secretary
and Treasurer for withdrawal.
ARTICLE 13: END OF TENURE AND SUCCESSION OF ORGANS
13.1 An organ of the community (General Assembly and Executive Council)
shall cease functioning in its various capacities upon the expiration of its
tenure, and its executive powers shall revert back to the General
Assembly.
13.2 The General Assembly shall commence the process of appointment of
new officers for any organ whose tenure is about to expire not later
than 3 months to the end of tenure.
13.3 All Exco members of the Executive Council shall prepare and submit
Handing over notes to the secretariat.
13.4 Officers of the Executive Council appointed by the General Assembly
shall assume office(s) automatically on the day following the end of
tenure of the previous holder(s) of the office(s).

13.5 Article 13.1, 13.2, and 13.3 shall apply only to end of tenure vacancies
or vacancies arising from the resignation of all members of the Executive
Council. For a vacancy arising from the removal from office,
resignation, incapacity or death of an individual officer of the Executive
Council, any one of its members may be appointed to the vacant position by
the Executive Council in an acting capacity for a period not exceeding six
months pending the appointment of a substantive officer by the General
Assembly. The General Assembly shall appoint a replacement from a
vacancy in the Executive Council arising from the removal of office,
resignation, incapacity or death of an individual member.
ARTICLE 14: IMPLEMENTATION OF THE CONSTITUTION
14.1 This constitution shall come into effect within three months after it has
been approved by the General Assembly and General Secretary shall
ensure that the constitution is duly filed at the corporate affairs
commission/minister of welfare and social development.
ARTICLE 15: AMENDMENT
15.1 Any proposal for amendment shall be notified to the General Secretary
at least thirty days before the date of the meeting at which the proposed
amendment is to be moved. Such amendment proposal shall be signed
by at least one fifth of the members of the ARC or thirty members of
ERG whichever is larger.
15.2 All members shall be notified of such a proposed amendment at least
fourteen days before the date of the meeting.
15.3 Proposal for any amendment of the constitution or part thereof shall be
decided by two-third of members present and voting at a General
Assembly meeting.
15.4 Any such amendment sought to be effected pursuant to Articles 13.1,
15.2 and 15.3 shall become effective upon the amended constitution being
fully filed at the corporate affairs commission, within three months by
the General Secretary.
ARTICLE 16: SPECIAL CLAUSE
16.1 The income and property of the ARC wherever derived shall be
applied solely towards the promotion of the objectives of ARC as set
forth in this constitution and no portion thereof shall be paid or
transferred directly or indirectly, by way of dividend, bonus or otherwise
by way of profit to any member of ARC, provided that nothing

herein shall prevent the payment, in good faith or reasonable and
proper remuneration to any officer of ARC in return for any service
rendered to the ARC.
16.2 No member of executive council or general assembly shall be appointed
any salaried office of ARC or paid by fees, and that no remuneration or
other benefit in money shall be given by ARC to any member of such
Executive Council/General Assembly except repayment of out of pocket
expenses or reasonable and proper rent for premises demised or let the
ARC provided that the provision last aforesaid shall not apply to any
payment of any company to a member of ARC
ARTICLE 17:
17.1 In the event of winding up or dissolution of the ARC, if there remains,
after the satisfaction of all its debts and liabilities, any property
whatsoever, the same shall not be paid to or distributed among the
members of ARC, but shall be given or transferred to some other
Islamic institution(s) having objectives similar to the objectives
of ERG or to some charitable Islamic cause(s).
17.2 Such Islamic institution(s) or Islamic charitable cause stated above shall
be determined by a two-third majority of all registered members present
at the General Assembly of ARC.
