HAZEERA PETITION
MEANING
When an accused is on bail he must present in every relevant date
and give an application of his appearance, this appearance is
called hazira.
CONCEPT OF HAZIRA
Hazira means attendance of parties.
When a case is filled before court, a fixed date is set by the
court for hearing of a case and in each hearing both the parties
are required to be produce before the Court. The attendance of
the parties is produced in the Court in the form of Hazira by the
respective lawyers.
Generally, High Courts have powers to make rules and produce
of parties in cases.
IMPORTANCE/SIGNIFICANCE OF HAZIRA
This is easy way to know on the date of hearing whether the
lawyer or the party to suit are present or not without wasting
valuable time of the court.
On the other hand, by this process one cannot say that the case
is left unattended.
If complainant does not attend the criminal case, the case may
be dismissed for default.
In criminal case on the date fixed by court for hearing the
accused is absent warrant of arrest may be issued against him
and his bails bonds may be cancelled.
In the civil suit, if the plaintiff is not in attendance or found
absent, his case may be dismissed for default. On the other side
if the defendant is absent the Court may proceed ex parte in the
case.
