HIGH SCHOOL SUMMER PASS™ PARTICIPANT RELEASE OF LIABILITY AND WAIVER OF CLAIMS

WARNING! By signing this document you will waive certain legal rights, including the right to
sue or claim compensation in circumstances outlined in this Agreement. Please read carefully.

In consideration of Pla-Fit Canada Franchise, Inc. and its franchisees (collectively "Planet Fitness") permitting
the participant in the High School Summer Pass™ named below (the “Participant”) to enter any Planet Fitness
facility in Canada and also permitting use and access to all Planet Fitness equipment and services (collectively
the “Activities”), and for other good and valuable consideration, the undersigned, being the Participant and, if
applicable, the Parent/Guardian of the Participant on behalf of Participant agree to all the terms and conditions
set forth in this agreement (this "Agreement").

1. Assumption of Risks
PARTICIPANT IS AWARE AND UNDERSTANDS THAT THE ACTIVITIES INVOLVE MANY RISKS,
DANGERS AND HAZARDS, INCLUDING BUT NOT LIMITED TO THE RISK OF SERIOUS INJURY,
CONTRACTING COVID-19, DEATH AND/OR PROPERTY DAMAGE. PARTICIPANT IS VOLUNTARILY
PARTICIPATING IN THE ACTIVITIES AND FREELY ACCEPTS AND FULLY ASSUMES ANY AND ALL
OF THE RISKS, DANGERS AND HAZARDS INVOLVED AND THE POSSIBILITY OF INJURY,
CONTRACTING COVID-19, DEATH OR PROPERTY DAMAGE, WHETHER CAUSED BY THE
NEGLIGENCE OF PLANET FITNESS OR OTHERWISE. PARTICIPANT ACKNOWLEDGES THAT
HIS/HER USE OF A PLANET FITNESS FACILITY AND ANY EQUIPMENT OR SERVICE IN A PLANET
FITNESS FACILITY IS ENTIRELY VOLUNTARY. PARTICIPANT UNDERSTANDS AND
ACKNOWLEDGES THAT PLANET FITNESS DOES NOT MANUFACTURE FITNESS OR OTHER
EQUIPMENT LOCATED IN ITS FACILITIES, BUT PURCHASES AND/OR LEASES EQUIPMENT AND
THEREFORE PLANET FITNESS SHALL NOT BE HELD LIABLE FOR DEFECTIVE EQUIPMENT.

2. Release
Participant hereby expressly waives and releases any and all claims which Participant has or may in the
future have against Planet Fitness, their affiliates, and their respective directors, officers, employees,
volunteers, officials, sponsors, agents, representatives, shareholders, successors, affiliates, and assigns
(collectively, "Releasees"), on account of injury, death or property damage arising out of or in connection
with Participant’s access and use of a Planet Fitness facility, including participation in the Activities, due to
any cause whatsoever, including without limitation the negligence of Planet Fitness or any other Releasee,
breach of contract, or breach of any statutory or other duty of care owing under occupiers liability legislation
or otherwise. Participant covenants not to make or bring any such claim against Planet Fitness or any other
Releasee, and forever releases and discharges Planet Fitness and all other Releasees from liability under
such claims.

3. Indemnity
Participant shall defend, indemnify and hold harmless Planet Fitness and all other Releasees against any
and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards,
penalties, fines, costs, or expenses of whatever kind, including reasonable legal fees, in connection with
any third-party claim, suit, action or proceeding arising out of or in connection with Participant’s access
and use of any Planet Fitness facility, including participation in the Activities.

4. Conduct
Participant agrees to follow all Planet Fitness rules and directions related to the Activities. Participant
represents that he/she is in good medical condition prior to participating in the Activities. If at any time I
believe conditions to be unsafe, that I am no longer in good medical condition to participate in the
Activities, I understand that I can immediately discontinue further participation in the Activities. Planet
 Fitness strongly recommends that Participant obtains the approval of a physician prior to participating in
the Activities.

5. General
This Agreement constitutes the sole and entire agreement between Planet Fitness and Participant with
respect to the subject matter contained herein and supersedes all prior and contemporaneous
understandings, agreements, representations and warranties, both written and oral, with respect to such
subject matter. If any term or provision of this Agreement is held to be invalid, illegal or unenforceable in
any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other term or provision of
this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. This
Agreement is binding on and shall enure to the benefit of Participant and Participant’s heirs and next-of-
kin, and Planet Fitness and its successors and assigns. This Agreement shall be governed by and
construed in accordance with the laws of the province in which the Planet Fitness facility is located and
the federal laws of Canada applicable therein.

PARTICIPANT ACKNOWLEDGES THAT HE/SHE HAS READ AND UNDERSTOOD ALL OF THE TERMS
OF THIS AGREEMENT AND THAT PARTICIPANT IS VOLUNTARILY WAIVING SUBSTANTIAL LEGAL
RIGHTS (ON PARTICIPANT’S BEHALF AND ON BEHALF OF PARTICIPANT’S HEIRS, EXECUTORS,
ADMINISTRATORS AND NEXT-OF-KIN) INCLUDING THE RIGHT TO SUE PLANET FITNESS AND THE
RELEASEES.

RESIDENTS OF BRITISH COLUMBIA, NOVA SCOTIA, NEW BRUNSWICK OR NEWFOUNDLAND & LABRADOR:
