(hereinafter referred to as the "PURCHASERS" (which expression shall wherever
the context so requires or admits, mean and include their Legal Heirs,
Successors, Executors, Administrators, Representatives and Assigns etc.,) of the
Second Part;
WITNESSES AS FOLLOWS:
WHEREAS, the Vendors are the sole and absolute owners of all that piece and
parcel of Property being residential Flat bearing No. B062, In the Sixth Floor, in ‘B’
Tower, measuring about 1644 Sq. feet super built up area, containing Three bed
rooms, with One Covered Car parking space Slot bearing No.LB-24, in the
multistoried residential building known as “VAJRAM ESSENZA” constructed over
immovable that piece and parcel of the Sy.No.63, New Sy No.63/1,BBMP Katha
No.31/63/1, Situated at Chokkanahalli Village, Yelahanka Hobli, Yelahanka Taluk,
Bangalore, comes under the jurisdiction of BBMP and totally measuring 1 Acre
20 Guntas, which flat along with 440 Sq.feet undivided share in the total land
measuring 1 Acre 20 Guntas, with all rights, appurtenances whatsoever
hereunder or underneath or above the surface, which flat along with undivided
share of land is more fully described in the Schedule “B” and “C” hereunder and
hereinafter referred to as the "SCHEDULE “B” & “C” PROPERTY", they have
acquired the same vide registered Deed of Sale dated 24/11/2015, registered as
document No.3440/2015-16 of Book – I, registered before the Office of the Sub-
Registrar, Gandhi Nagar (Ganganagar), Bangalore.
AND WHEREAS the Vendors herein since the date of acquisition of the Schedule
“B” & “C” Property in the manner referred to above have been in peaceful
possession and enjoyment of the same without any let or hindrance from any
one and have been exercising acts of ownership and possession over the same.

WHEREAS the Vendors herein had also paid upto date taxes in relation to the
Schedule “B” & “C” Property and assures that the Schedule “B” & “C” Property is
free from all types of encumbrances.
WHEREAS the Vendors had offered to sell the Schedule “B” & “C” Property in
favour of the Purchasers herein and the Purchasers herein have agreed and have
come forward to purchase the Schedule Property. Hence, this Sale Deed.
NOW THIS DEED OF ABSOLUTE SALE WITNESSETH AS FOLLOWS:
1. That in pursuance of the above common intention and in consideration
of the Purchasers paying the entire sale consideration of Rs.1,10,00,000/-
(Rupees One Crore and Ten Lakhs Only) to the Vendors (1) 1.Mr.ARUN
KUMAR THOTTUNGAL ASOKAN,
a) a sum of Rs.1,10,000/- (Rupees One Lakh and Ten Thousnad Only)
through online transferred Ref No.NEFT 0811OP3126498419, dated
02/112023.
b) a sum of Rs.16,50,000/- (Rupees Sixteen Lakhs and Fifty Thousand
Only) through Demand Draft Ref No.006882, dated 01/02/2024.
c) A sum of Rs.________/- (Rupees _________ Only) vide Cheque bearing
No.__________, dated ___/02/2024, drawn on __________ Bank, Bangalore;
d) a sum of Rs.________/- (Rupees _______ Only) through online transfer
Ref No.___________, dated ___/02/2024.
e) a sum of Rs.________/- (Rupees __________ Only) Vide Demand Draft
bearing No._______, dated ___/01/2024, drawn on _______ Bank,
_____________ Branch, Bangalore, the said amount being the loan
amount sanctioned by the ___________ Bank, Bangalore, wherein the
Purchasers have availed the housing loan.
a) a sum of Rs.______/- (Rupees _____________ Only) through online
transfer from _______ Bank, BSR Code:__________, Challan No._________,
dated ________, towards 1% TDS.
the receipt whereof the Vendors do hereby admit and acknowledges before the
undersigned witnesses.
1a. Sale consideration will be released towards vendor (1) Arun Kumar thottungal
asokan (2) Mrs pallavi prakash has given NO Objection two on words same valid
latter attached 09/02/2024.
2. The Vendors is the absolute owners of all that piece and parcel of the
Schedule “B” & “C” Property do hereby sell, convey, transfer, alienate UNTO the
Purchasers all that piece and parcel of the Schedule Property TO HAVE AND TO
HOLD the same as his absolute owner with all rights, liberties, privileges,

easements, hereditaments, ways, water courses and free from all encumbrances,
affirms and assures that,
3. The Vendors had this day put the Purchasers in vacant possession of the
Schedule “B” & “C” Property and the Purchasers acknowledge having taken
delivery of the same.
4. The Vendors assures the Purchasers that the Schedule “B” & “C” Property
is his absolute property and that no other member/s of his family has/have any
manner of claim, right, title or interest over the same.
5. The Vendors assures the Purchasers that he has a clear, valid, subsisting
and marketable title in relation to the Schedule “B” & “C” Property and that there
is no legal impediment for the absolute sale of the Schedule “B” & “C” Property in
favour of the Purchasers herein.
6. The Vendors assures the Purchasers that the Schedule “B” & “C” Property
is free from encumbrances of whatsoever nature such as court attachments,
minor claims, maintenance claims, charges, lien, lis pendens etc.,
7. The Vendors assures the Purchasers that they have paid upto date taxes in
relation to the Schedule “B” & “C” Property to the concerned authorities and
undertakes to indemnify the Purchasers against any such payment/expense.
8. The Vendors undertake to indemnify the Purchasers against any
loss/damage/expense the Purchasers may incur/suffer on account of defect in
title, if any of the Vendors or arising from the claim of third parties if any.
9. The Vendors had this day handed over all the copies/certified
copies/original documents of title in relation to the Schedule “B” & “C” Property to
the Purchasers and the Purchasers acknowledge having received the same.
10. The Purchasers shall henceforth be entitled to peacefully and quietly hold,
possess, enjoy and exploit the Schedule “B” & “C” Property as their absolute
Property with all benefits accruing thereto, without any let or hindrance either by
the Vendors or any one claiming through or under them.
11. The Vendors had no objection for the Purchasers to get the Katha of the
Schedule “B” & “C” Property transferred into their name’s.
12. The expenses of Stamp duty and registration is borne by the Purchasers.
13. The Purchasers shall be bound by the rights and restrictions applicable under
the Karnataka Apartment Ownership Act, or such other rules and regulations as
may be framed from time to time by the flat owner’s association.
14. The Vendors has no objection for the Purchasers to get transfer Bescom
electricity meter to his into their name’s.

SCHEDULE – ‘A’
All that piece and parcel of the Sy.No.63, New Sy No.63/1, BBMP Katha
No.31/63/1, Situated at Chokkanahalli Village, Yelahanka Hobli, Yelahanka Taluk,
Bangalore, comes under the jurisdiction of BBMP, and totally measuring 1 Acre
20 Guntas, and bounded on the:
East by : Land in Sy No.61;
West by : 80 feet Road;
North by : 40 feet Road;
South by : Land in Sy No.62;
SCHEDULE "B"
440 Sq.feet undivided right, title and interest in the immovable property
mentioned in Schedule "A" above.
SCHEDULE "C"
Residential Apartment bearing No.B062, in Sixth Floor, in ‘B’ Tower, measuring
1644 Sq.feet super built up area, containing Three Bedrooms, Drawing room,
Dining room, Bathroom/s, Kitchen and Balcony, together with One Covered Car
parking space Slot bearing No.LB-24, Vitrified Flooring, including proportionate
share in common areas such as passages, lifts, lobbies, staircase, etc., of
multistoried residential building known as “VAJRAM ESSENZA” constructed over
Schedule "A" Property.
The market value of the Schedule ‘B’ & ‘C’ Property is Rs.1,10,00,000/- (Rupees
One Crore and Ten Lakhs Only).
