COMPROMISE AGREEMENT
UNDERSIGNED PARTIES:
GRELANDO P. LOS BAÑOS, Filipino, of legal age, married
and a resident of Brgy. Milagrosa Aston Fields Lot 10 Block
11, Calamba City, Laguna, the Complainant;
and
NELIA Q. CLERIGO, Filipino, of legal age, married and a
resident of Brgy. San Isidro Curva, Batangas City, the
Accused;
AGREE as follows:
To buy peace, both parties agreed to settle the civil aspect
of this case amicably;
The Accused acknowledged her obligation to the
Complainant in the amount of FOUR HUNDRED THIRTY
FIVE THOUSAND PESOS (P435,000.00) and shall be paid
in the following terms and conditions, to wit:
The said P435,000.00 shall be paid by the accused to
the complainant in fifteen (15) monthly installments in the
amount of TWENTY NINE THOUSAND PESOS
(P29,000.00) per month through Eastwest Bank postdated
checks under the name of the accused, to be paid every
fifteenth (15th) of the month starting November 15, 2022
until January 15, 2024.
Failure to pay without any coordination from the
accused to the private complainant shall make the obligation
in this agreement due and demandable;
Failure to perform her (Clerigo) obligation for a second
time shall entitle the complainant to the issuance of a writ of
execution to enforce and implement the compromise
agreement.
That upon the approval of the Court of this Compromise
Agreement, both parties agree to move that a decision on
the civil aspect of the case be rendered and pray that the
criminal aspect be sent to the archives.
Upon the fulfillment of the accused of the said
obligation terminating the civil aspect of the case, the
complainant shall execute an Affidavit of Desistance stating
under oath that he is no longer interested in pursuing the
criminal aspect against the accused.
The parties hereby execute this Compromise
Agreement voluntarily without fear, intimidation, force or
duress.
