MAY IT PLEASE YOUR WORSHIP:
I, Kiran Ghanshyam Ahuja the complainant abovenamed
residing at 701, Parekh Mahal, Chaitanya Nagar, IIT market,
Powai, Mumbai 400076, do hereby state on solemn affirmation
as under:
1. I say that the accused is an individual Indian inhabitant
having his address at House No. E-32, Radha Swami
Nagar, Bhatagaon, Raipur 492015.i further say that the
subject cheque has been signed by the accused .
2. I say that the present complaint is filled on account of
failure of the accused to maintain sufficient funds in it
account to discharge his debt/liability in respect three
crossed cheque drawn on Allahabad Bank Raipur 492001
for the amount of Rs. 65,000/- (Rupees Sixty-Five
Thousand Only) all dated 22/03/2021 bearing no 938511,
020335 and 020342 respectively in favour of the complainant and
subsequent failure of the accused to discharge the same within 15
days after the statutory demand notice dated 19/05/2021.
3. I say that the accused has failed to discharge the
liability towards the complainant of Rs. 65,000/-
(Rupees Sixty-Five Thousand Only) owed to the
complainant.
4. I say that the accused has his address outside the
jurisdiction of Mumbai. I say that in the present case,
the cheques were handed over to the complainant by
the accused for the Purpose of discharging the
liability if the Accused.
5. I say that as soon as I received the instructions to deposit
the subject cheques referred to above, accordingly
deposited aforesaid cheques in her bank account with
Kotak Mahindra Bank Ltd., I say that I have deposited the
said cheques within the period of validity. the said three
cheques were returned dishonoured as unpaid due to the
reason ‘INSUFFICIENT FUNDS’ as recorded in the three
Memorandums dated 05/05/2021. The complainant
maintains it account with Kotak Mahindra Bank Ltd, Airoli
therefore this Hon’ble Court has Jurisdiction to try and
entertain the present complaint.
6. I say that the complainant is filing present pursis U/S 202
of CRPC for issuance of process. I say that the
complainant does not want to examine any other witness
at this stage for the order of issuance of process.
7. I say that whatever is stated hereinabove is true to my
own knowledge and belief and based upon legal advice
which I believe the same to be true and correct.
