APPLICATION FOR WAIVER OF COST ON BEHALF OF THE
DEFENDANT NO.10, MRS. PREETI
MOST RESPECTFULLY SHOWETH:-
1. That the above noted case is pending before thus Hon’ble Court
and fixed for further proceedings on 22.03.2024.
2. That the earlier hearing of the case was fixed for 12.03.2024. That
the counsel of the Respondent no. 10 was not able to appear before
the Hon’ble Court and due to the aforesaid reason the Hon’ble Court
imposed a cost of Rs. 2000/- on the Respondent no. 10 /applicant.
3. That due to the demise of the relative of the counsel of the plaintiff
the presence of the counsel and the accused could not be marked,
pertaining to which the Hon’ble Court was satisfied to impose a cost
of Rs. 2000/- on the Respondent no. 10 /applicant.
4. That the non presence of the counsel of the Respondent no. 2 was
neither intentional nor deliberate but due to the above stated reason.
5. That the imposing of the cost has caused grave inconvenience and
hardship to the accused, and it has grave prejudice to the interest of
the accused.
PRAYER
It is therefore most respectfully prayed before this Hon’ble Court in
the light of the above mentioned facts and circumstances that the
cost of Rs. 2000/- imposed on the Respondent no.10 may kindly be
waived off, in interest of justice.
