Dear RWA Heads,
Please ensure the following government and legal guidelines regarding animals are circulated to all
residents:
These are the Government of India/Animal Welfare Board/Supreme Court laws regarding
animals in building complexes and gated communities. Please see that these are circulated to
all the residents
1. All animals that have been born or have resided from childhood in the area are known as
community animals
2. No community animals can be relocated or harmed. This has major legal consequences. Any injury,
killing, or relocation is a criminal offense and the culprit will be prosecuted.
3 No guards can hit or attempt to relocate animals, even on the orders of the RWA Committee
members. The security agency will lose its licence and the guards will be prosecuted. Therefore it is
sensible not to allow the guards to have sticks.
4. Feeding spots will have to be made within the premises and boards put in. These should not be
near any gate or entrance. It is the responsibility of the feeders to keep the places clean
5. Feeding timings can also be made. These should be when there are fewer people around: e.g. 9
am when most people have left for school or work and 7 pm when most people are in their homes.
6. All community animals should be vaccinated and sterilized
7. Every RWA community has to have an Animal Welfare Committee. It is the job of this committee to
see that the animals are fed and medicated and to regulate their behavior so that the interaction
between humans and animals is pleasant.
8. All pet dogs have to be on a leash when walked
9. Owners have to carry scoopers with them and pick up the feces which can be deposited in garbage
cans
10. Dogs can legally be taken in lifts but they should be muzzled for the duration of the lift ride.
11. Dogs can be taken on to green areas within the community. If there are objections timings of
am/pm can be made for the owners to walk their dogs. No owners can be banned from walking dogs
within the complex. There can be enclosed green spaces made where dogs can roam free provided
the owners keep it clean.
12. The High Court has ruled that any harassment of feeders, any videos taken without their
permission, and any statements by residents that show any intention to denigrate or break the law are
all liable to severe legal action.
13.No RWA/Society can, by law, impose a fine on any resident for any matter. Any fine imposed will
automatically be registered as a criminal attempt of extortion against the office bearers. It will also go
to the Registrar overseeing the building complex for immediate action against the RWA/Society
