JUDICIAL AFFIDAVIT
I, PMS Sanshine B. Valdez, of legal age, single, a Cyber Forensic Specialist with
postal address Disimungal, Nagtipunan, Quirino after having been duly sworn to
in accordance with law depose and state, that:
PRELIMINARY STATEMENT
The person examining me is Atty. Benjie S. Doce with address at Lower Ground
Floor RCBC Building Session Road, Baguio City. The examination is being held
at the same address. I am answering his questions voluntarily, to the best of my
knowledge and fully conscious that I do so under oath and may face criminal
liability for false testimony and perjury.
PURPOSE
This affidavit/testimony of witness Sanshine B. Valdez is being offered to prove
the existence of sufficient provocation on the part of the accused.
The questions asked and my corresponding answers thereto are as follows:
Q: What is your current employment, Ms. Witness?
A: I am presently working as a Cyber Forensic Examiner I at the PNP Regional
Anti-Cybercrime Unit of CAR.
Q: How long have you been employed with the PNP - RACU?
A: I have been working at my present employment for about 4 years since 2020
Q: As a Cyber Forensic Specialist, what are your duties and responsibilities, Ms.
Witness?
A: As a Cyber Forensic Specialist, my tasked is to conduct identification,
preservation, collection, authentication, and analyzation of digital forensic
evidence, submit a forensic report and to testify in court.
Q: Ms. Witness, have you undergone trainings and seminars to qualify you as
Cyber Forensic Specialist?
A: Yes, I have attended 14th National Forensic Science Specialization Training
(Cyber Forensics Specialization Course) in Brentwood Apartelle, Leonard Wood
Road, Baguio City, Philippines on June 12-17 2022;
Q: In the course of your examination as such, did you happen to examine a
device particularly the (1) piece Black/ Red Flash Drive HIKVision (16 GB)
A: Yes Sir.
Q: Under what circumstances did you come to examine the (1) piece Black/ Red
Flash Drive HIKVision (16GB)?
A: The request came from PCOL. Francisco B. Bulwayan Jr., City Director of
Baguio City Police Office. The request for examination of the then (1) piece
Black/ Red Flash Drive HIKVision (16GB) was made on July 13, 2024.
Q: After receiving such request, what did you do next, if any? A: After receiving
the request for Digital Forensic Examination together with the Black/ Red Flash
Drive HIKVision (16GB) recovered at the crime scene, I examine the digital
evidence to the PNP RACU Laboratory for examination.
Q: Have you successfully created a forensie dise image of the USB drive
requested by the Baguio City Police Office?
A: Yes. Sir
Q: How did you facilitate the creation of dise image Ms. Witness? A: I used Cyber
Forensic Software specifically FTK Imager and Autopsy. Q: What is FTK Imager
and Autopsy?
A: FTK Imager is an application that enables the creation of digital forensie
images, preservation, extraction of data for forensic use at a specific point in
time. Autopsy on the other hand, Autopsy provides a platform for analyzing
forensic images. It can generate detailed reports of the findings, which are crucial
for presenting evidence in court.
Q: After successfully imaging the devices, what have you discovered? A: I
discovered 16 system files and 24 deleted documents including the list of
borrowers. Please refer to Annex B. Q: Tell us more about the analysis you
made.
A: Sir/ Ma'am, I discovered three (3) suspicious items which contains valuable
information. Please refer to Annex C.
