22.THE ALL INDIA SERVICES (HOUSE RENT
ALLOWANCE) RULES, 1977.
In exercise of the powers conferred by sub-section (1) of Section 3 of the All India
Services Act, 1951 (61 of 1961), the Central Govemment, after consultation with the
Governments of the States concerned, hereby makes the following rules, namely
4, Short titte and commencement-
(1) These rules may be called the All India Services (House Rent Allowance) Rules, 1877.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definition- In these rules, unless the context otherwise requires, "member of the Service”
means a member of an All India Service, as defined in section 2 of the All India Services Act,
1951 (61 of 1951).
3. Regulation of House Rent Allowance -
(1) A member of the Service, serving in connection with the affairs of the Union, shell be
entitied to draw House Rent Allowance at such rates, and subject to such conditions as
may be specified by the Central Government from time to time, in respect of officers of
the Central Givil Services, Group ‘A’.
Provided that where any special orders have been issued by the Central Govemment to
regulate the grant of House Rent Allowance to the members of the Service serving in
connection with the affairs of the Union, such members shall be entitled to draw House
Rent Allowance under such special orders.
(2) A member of the Service. serving in connection with the affairs of @ State, shall be
entitled to draw House Rent Allowance at such rates, and subject to suich conditions, as
may be specified by the State Government concemed, from time to time, in respect of
officers of the State Services, Class |:
Provided that the House Rent Allowance allowed to a member of the Service under this
‘sub rule shall not at any time be less than what he would have drawn under sub rule (1),
had he been appointed to serve in connection with the affairs of the Union at the same
station,
(2) Every officor whose initial pay ie fixed in annaritanna with suib-rula (5) or sub-rule (BA)
of Rule 4 of the Indian Administrative Service (Pay) Rules, 1954 or sub-rule (6) or sub-
rule (6A) of the Indian Police Service (Pay) Rules, 1954 or sub-rulo (6) of Rule (4) of the
Indian Forest Service (Pay) Rules, 1968, shall be entitled to draw House Rent Allowance
in the same manner as a member of the Service under sub-rule (2).
4, Interprotatlon-If any question arises as to the interpretation of these rules, it shall be referred
to the Central Government, who shall decide the same.

GOVERNMENT OF INDIA’S DECISION
7661. An officer owns a house, but living in a rented house, which has been leased in the name
of his wife. The rent of the house is, however, reported to be paid by the officer. Since the house
has been leased in the name of wife of the officer, a question has been raised whether in view of
Note 2 below Rule 4 of the House Rent Allowance Rules applicable to the Central Governments
servants, the officer can be granted HRA or Is it necessary that he should first get the lease of the
house transferred in his own name to get the HRA. It has boen decided in consultation with the
Ministry of Finance that the officer concerned cannot claim House Rent Allowance on the basis of
the rent paid by his wife. However, as a co-sharer of the accommodation, he can claim HRA in
raspect of 40% of the rent actually paid by his wife, Alternatively, he can claim HRA in terms of
‘the provisions of para 1(5) of OM No. 11011/1/E-lI-B/75, dated the 25" February, 1977 if this
‘would be more favourable to him. He will of course, have to give the appropriate certificate as
required in the instructions contained in the Ministry of Finance OM No. 2(37\/E-II.B/64, dated the
27” November, 1965 as amended fram time ta time

2. Acceptance of Recommendations of 6° Central Pay Commission regarding grant
of House Rent Allowance(HRA) and Compensatory(City) Allowance (CCA) to All India Services
officers: :
1. _ Lam directed to enclose herewith a copy of latest instructions of the Government
regarding House Rent Allowance(HRA) and Compensatory(City) Allowance on the
recommendations of 0° Central Pay Commission to Central Government employees and
io state that the matter regarding extension of these instuctions to the All India Services
officers had been under consideration in this Department.
2, __Itis conveyed that the instructions contained in Ministry of Finance, Department
of Expenditure’s Office Memorandum No.2(13)/2008-E.1I(B) dated 29" August, 2008 are
applicable to the All India Services officers. However, in the States where CCA continues
to exist, after its abolition at the Centre w.e.f. 1.9.2008, this allowance becomes an
allowance specified to those Stal

Commission relating to grant of House Rent Allowance(HRA) and Compensatory(City}
Allowance{CCA):
1. The undersigned is directed to say that, consequent upon the decisions taken by the
Goverment on tho recommendations of the Sixth Central Pay Commission, the
President is pleased to decide thal, in modification of this Ministry's O.M.No.2(27)-
E.N(BY64 dated 27.11.1965 as amended from time to time, O.M.No.2(23)'9/-E.AI3)
dated 3.10.1997 and O.M.No.2(21VE,I(B)/2004 dated 18.11.2004, the admissibility
of these allowances shell be as under:-
(i) SOMPENSATORY(CITY) ALLOWANCE:
‘The Compensatory(City) Alowance(CCA) stands ABOLISHED.
(i) HOUSE RENT ALLOWANCE:
2. Based on the recommendations of the Sixth Central Pay Commission, the earlier
classification of cities has been revised viz, A-1 to "X’, A, B-1 & B-2 to “Y" and C &
Unclassified toZ’. In determining the revised classification the revised classification,

the population of Urban Agglomeration area of the city has been taken into
consideration. Accordingly, the rates of House Rent Allowance shall be as under:-

The term "basic pay" In the revised pay structure means the pay drawn in the
presctibed pay band plus the applicable grade pay but does not include any other
type of pay like special pay, etc In the case of Government servants in the pay
scales of HAG+ and above, basic pay means tho pay in the prescribed scale.
In respect of those employees who opt to retain their pre-revised scales of pay, the
pay for the purpose of these orders shall also include, in addition to the basic pay in
the applicable pro-tevised scales, Stagnation Inctement(s), Dearness Pay and Non-
Practising Allowance as per orders in force on 1.1,2006.
The list of cities/towns classified as ‘XY’, and ‘Z' for the purpose of grant of House
Rent Allowance is enclosed as Annexure to these orders.
The following orders have been issued by this Ministry in the past for grant of
HRAICCA at higher rates to the Central Government employees posted within the
municipal area:-

rates in the rural areas of A&N and Lakshadweep Islands).
However, due to (i) inclusion of Navi Mumbai within the UA of Greater Mumbai as per
2001 census (ii) placement of existing ‘C’ class cities/towns as well as Unclassfied
places under new category 'Z”, (ili) abolition of CCA and (Iv) upgradation of Jammu,
Kolkata & Chennai on account of inclusion of UA, the special dispensation shall
continue to be extonded only to the folowing citfes:-
(Faridabad, Ghaziabad, NOIDA and Gurgaon at “X" class city rates.
(i) Jalandhar Cantt., Shillong, Goa & Port Blair at "Y" class city rates.
7. All other conditions governing grant of HRA under existing orders shall continue to
apply.
8. Special Compensatory Allowance @ 2.5% of basic pay admissible we. 1.8.97 to
Group ‘C,'D’ and Group ’B’ non-gazetted employees whose pay scales correspond to
‘or are lower than the pay scales of Group ‘C’ employees posted at Ganchinagar as
per this Ministry's O.M.No.2(64)97-E.II() dated 4.7.2001, also stands ABOLISHED.
9, These orders shall be effactive from September 1, 2008.
10. The orders will apply to all civilian employees of the Central Government. The orders
will also be applicable to the civilian employees paid from the Defence Services
Estimates. In respect of Amed Forces personnel and Railway employees, separate
orders will be Issued by the Ministry of Defence and the Ministy of Railways,
respectively.
11. In so far as the persons serving in the Indian Audit and Accounts Department are
concerned, these orders Issued in consultation with Comptroller & Auditor General of
India.

and no separate order Is being issued by the Department of
Expenditure.

2. Since the Government in its Order second cited has
enhanced the rate of Dearness Allowance payable to AIS Officers
serving in the State from 17% to 31% and paid in cash with effect
from 1.1.2022, the rates of HRA shall also be revised from the existing
rates as indicated above to 27%, 18% & 9% for X,Y & Z class cities
respectively with effect from 1.1.2022 le date on which the
enhancement of Dearness Allowance crosses 25% to AIS Officers
serving in the State. The audit authorities concerned are requested to
issue necessary pay slips to the officers concerned for the drawal of
enhanced HRA as indicated above.

ORDER:
‘The Official Committee, 2017 constituted to examine revision of pay
and allowances has inter-alia made recommendations regarding revision of
House Rent Allowance and City Compensatory Allowance by retaining the
existing slab rates suitably modifying the existing pay ranges based on the
revised level pay and also based on the upgradation and reclassification of
certain cities / towns.
2. The Government has carefully examined the recommendations of
the Official Committee, 2017 and has decided to accept them. Accordingly,
Government issue the following orders:-
(A) REVISED RATE OF HOUSE RENT ALLOWANCE
&. The revised rates of House Rent Allowance to employees in different
pay ranges in the revised pay structure and different grades of cities and
towns shall be as follows:~

4, (1) Higher rates of House Rent Allowance are admissible to employees
entitled for rent free quarters but not provided with quarters. ‘The revised rates
of House Rent Allowance in lieu of rent free quarters shall be as follows:~

5. The present prevailing different grades shall be retained and some
cities /towns shall be upgraded and reclassified for the eligibility of House
Rent Allowance in different grades as detailed below:

RECOVERY OF RENT FOR OCCUPYING GOVERNMENT QUARTERS
6. (1) The Government also direct that in respect of employees in the
Level-5 and below in the pay matrix and the employees who are entitled to
the [aeilily of tent free accommodation, uv keut seeuvery shall be made as
hitherto for occupying quarters provided by Government or its agencies. For
others, the revised rent recovery shall be as indicated below:

(2) The revised rent recovery shall take effect from 1+ October, 2017.
‘The rent recovery already made at old rates with effect from 1-1-2016 to
30-9-2017 needs no revision even after the re-fixation of pay in the revised
pay structure.
(3)The Government also direct that the Government employees
occupying houses provided by Accommodation Controller and who pay rent
above the rate of rent prescribed for occupying Government quarters be
allowed such amount in excess of the rent prescribed for occupation of
Government quarters as House, Rent Allowance subject to the maximum8 413
limit of House Rent Allowance eligible to them.
{B) REVISED RATE OF CITY COMPENSATORY ALLOWANCE
7. The cities of Tiruppur and Erode, which was classified as ‘Y’ by
Government of India for the purpose of House Rent Allowance shall also be
included for City Compensatory Allowance. Accordingly, revised rates of City
Compensatory Allowance (CCA) for employees in different pay ranges in the
revised pay structures shall be as follows:

8, The revised rates of House Rent Allowance and City Compensatory
Allowance shall take effect from 1st October, 2017.
9. These orders shall apply to the Government employees and
teachers including employees of local bodies and also to the teachers and
employees in aided educational institutions.
10, Ameniiments to the Tamil Nadu Special Pay and Allowances Rules
will be notified separately,
