B. SPECIAL CONDITIONS :-

1. The Tenderers should quote theil rates stdctty adhering to Terms and Conditions
stipulated in the Tender Document. Unsolicited correspondence after opening of
the Tender shall not ie entertained. Conditional / deviational tenders may be
rejectcd without making any relerence to the Tenderers. The conditional rebatc
shall not be olTered.
2. No Tcnderer will be allowed to withdraw his Tender dudng the validity period.

Subletting ofthc Contact is not permited.

3. The Bidder shall submit the technical Bid and financial Bid using online "E-
Portal" BOQ and the appropriate Bid submission sheets, Bidding forms. fhese
foms must be completed withoul any alterations to their format , and no
substitutes shall be filled in ink or typed with the information requcsted.

4. No advance shall bc paid towards mobilisation and cosr ofmaterials.

5. No compensation shall be admissible for any loss suffered by the contactor during

thc cxecution of the work. It shall be the contmotors sole responsibility to protect
Gram PanchayaV Panchayat samiti staff and his employees against aaaidents from

any cause and he shall idemnify Panchayat samiti,Gram panchayat agains any
claims for damage for injury to pe$on or property, resulting from any such
accidents wilh ncccssary insurance cor er.

6. The Supplier / conftactor should have necessary contact License / Authorise

rvhole scll Supplier / Authorised Dcaler etc. and comply with the Labour Laws as

applicable.

7. The conhactor are advised to visit the site before quoting the rates for all items as

well as the lump sum items. The quoted mte shall include all the prevailing taxes
including Goods and Servioes 1ax etc.

8. NO conditional rabate will be accepted.

 9. Post qualification of the Bidder: - Thc Procuring Entity shall determine to its
satisfaction that the Bidd that is sclected as the lowest Bidder is qualilied to
perlorm the Contracl satislaclorily.
10. Procuring Entity's Right to Accept Any Bid, and to Reject Any or AII Bids :-
Thc Procudng Entiry rcscryes the right to aacept or reject any Bid, and to annul
the Bidding process and rejcct all Bids at any timc prior to Contact award without

assigning any reasons there of and without thereby incurring any liability to the
Bidders.

as far as possible, within 30 (Thirty) days after submission ofan invoice or requcst

13.Termination for lnsolvency:- The Procuring Entjty may as any time terminate the

contract by givirig Notice to the supplicr if the Supplier becomes bankrupt or otherwise
insolvent. ln such event, termination will-be without compensation to the supplier,

5 form of appeal
(a) An appeal under para (1) or (3) above shall be in the annexed ftom along with as
maay copies as tlere are respondents in the appeal.
(b) Every appeal shall be
-accompanied
by an order appealed againsl if any affidavit
vod&ing the facts stated in the appeal and proof ofpayrnent of fee.
(c) Every appeal may be presented to first appellate Authority or second appellate
authority, as the case may be, in person or through registered post or authodsed
representative.
(6) Fee for lilling appeal
(a) Free for first appeal shall be rupess two thbusand five hundred and for second
appeal shall be rupees ten thousand, which shall be non-refundable.
(b) The fee shall be'paid in the from of biink demand draft or banker's cheque of a

scheduled bank in india payable in the name of Appellate Authority concerned.

(7) Procedure for disposal of appeal
(a) The First Appellate authority or second appellate authority, as the case may be
upon filing of appeal, shall issue notice accompanied by copy of appeal, affldavit and
documents, if any, to the respondents and fix date bf hearing.
(b) On the date fixed for hearing, the first appellate authority or second appellate
authority as the case may be, shall
(1) hear allthe parties to appeal present before him; and
(ii) peruse or inspect documents relevant_records-or copies thereof relating to the
matter.
(c)After hearing the parties, perusal or inspection of doucments and relevant records
or copies thereof relating-to the matter, the appellate authority concerned shall pass
an order in writing and provide the copy of the order to the parties to appeal free of
cost.
(d) the order passed under subclause (c) above shall also be placed, on the state
public procurement Portal,

Annexure D : Additional Conditions of Contract

1. Correction of Arithmetical errors -
Provided that a financial Bid is substantially responsive the procuring
entity will correct arithmetical errors during evaluation of financial bids
on the following basis:
i.if there is a discrepancy between the unit price and the total price that is
obtained by multiplying the rmit price _and quqntity the unit price shall
prevail and the total- price shall be corrected, unless in the opinion of tle
procuring entity there is an obvious misplacement of the decimdl point in the
unit price, in which case the total price as quoted shall govem and the unit
price shall be corrected;
(ii) if there is an error in total corresponding to the addition or subtraction of
subtotals the subtotals shall prevail and tlte total shall be corrected: and
(iii) ifthere is a discrepancy between words arid figures the amormt in words
shall prevail, unless the amount expressed in words is related to an
arithmetic error, in which case the amount in figures shall prevail subject to
(i) and (ii) above.
If the bidder that submitted the lowest evaluated bid does not accept the
correction of errors, its bid shall be disqualified and its bid security shall be
forfeited or its bid securing declaration shall be executed.
2.Procuring entity's Right to vary quantities
(i) At the time of award of contract the quantity of goods, works or services
originally specified in the bidding document may be increased or decreased
by. a specified percantage, but such increised or decreased shall not exceed
twenty percent of the quantity specified in the Bidding document it shall be
without any change in the unit prices or other tems and conditions of the
Bid and the conditions of contract.

(ii) If the procuring Entity does not, procure ary subject matter of
procurement or procures less than the quantity specified in the bidding
document due to change in cicumstances, the bidder shall not be entitled for
any claim or compensation except otherwisi provided in the conditions of
contract.
(iii) In case of procurement of goods or sgrvices additional quantity may be
procured by placing a repeat order on the rates and condition of the original
order. However the additional quantity shall not be more lhan 25o/" of lhe
