Under order 6 rule 17 of C.P.C. the applicant begs to submit as
follows:
That for the reasons sworn to in the annexed affidavit it is
respectfully prayed this Hon'ble Court may kindly be pleased to permit
to applicant/plaintiff No.4 to include the following the property in the
schedule as item No.6 by allowing this application as sought below in
the interest of Justice and equity.
Amendment sought for
Kindly permit the applicant/plaintiff No.4 to include the following
property as item No.6 in the schedule.
1. The land bearing Sy.No.9/1 totally measuring 31 guntas, Karab
01 guntas, Jatha 30 guntas, assessed valur Rs.1.36 paiese, situated at
Madalakote Village, Kasaba Hobli, Nelamangala Taluk, Bangalore

//AFFIDAVIT//
I, Gururaj S/o Late Jayamma and Shivanna aged about 30 years
R/o Thotadaguddadahalli, Dasanapura Hobli, Taluk, Bangalauru North
Taluk. I am the Planitiff No.4 in the above case do here by solemnly
affirm and state as follows:-
I submit that Planitiff No.4 I swear to this affidavit my self and
also on behalf of other plaintiffs we have filed the above case against
the defendants as sought in the plaint , the plaint averments may
kindly be read as part and parcel of this affidavit. At the time of the
filing the above suit we could not traced the particulars of the
proposed property the proposed property is also joint family property,
the proposed suit schedule property is ancestral and joint family
property of ours and defendants, we have equal shere, right in the
proposed schedule property, recently we came to know that fact and
obtaining the revenue records and give instructions to my Advocate to
include the proposed schedule property. Non filing of this application
well in time is purely bonafide one and not intentional one hence this
application to include the proposed schedule property as suit item
No.6.
If the application is allowed no harm or injury will be
caused to the other side, on the other hand if this application is not
allowed I will be put to irreparable loss and injuries which cannot be
compensated in any manner.
Wherefore, I respectfully prays that this Hon’ble court may
kindly be please to allow this annexed application as prayed therein, in
the interest of justice.
