APPLICATION FOR MODOFICATION
OF BAIL ORDER DATED 05/10/2021
UNDER SECTION 439 (B) OF CR.P.C.

1. The Applicant states that he is a law-abiding Citizen of India and a
permanent resident of Maharashtra.
2. The Applicant states that the he lives at the address stated above, He
had arrested as an Accused with respect to FIR No. 02 of 2021
registered by the Bhayandar Police Station under the provisions of
Section 304 of IPC, lodged by the informant Mr. Nikolas Julies
Fanandez.
3. Applicant state that the story of the prosecution is that, the
informant who go for cycling every evening around 8.00 PM from
Radaswami Satsag bhayander to Mira Road Station West. On
31/12/2020 the informant went for cycling like every evening and at
about 8.15 PM as he reached to water sewer, near Nazreth Police
Station, he saw that the applicant/accused was sitting on the bridge
over the water sewer and after some time two men came near to the
applicant and started refusing him to sit there but the applicant/
accused was not ready to listen anything, because of that an
argument started between them. That time informant lien and watch
them and then he realized that the three of them are Security guards
near to the barricading. He saw that two men were trying to make
him understand and they were trying to take him towards their hut
by holding his hand. The applicant/accused was not listening them
and he pushed both of them away to resist taking him meanwhile
one of the men, who was at the edge of the bridge was fall in water
as accused pushed both of them and the informant saw the whole
incident.
4. The police authorities investigated the complaint and arrested the
Applicant on 01/01/2021. The Applicant was produced before the
Ld. J.M.F.C Court, Thane on 02/01/2021 the police sought police
custody for 6 days; however, the Ld. Magistrate remanded the
Applicant to judicial custody on 08/01/2021 to till today. The
Chargesheet has been filed in the above said matter.
5. The Applicant state that he had applied for bail before the Hon’ble
Session Court Thane, and the Hon’ble Court had granted bail to that
application with conditions on an order dated 05/10/2021.
6. The Applicant State that the Hon’ble Court had granted bail with
Condition of P.B. of Rs.50,000/-(Rupees Fifty Thousand Only) with
one and more Surety of like Amount and with other condition as per
an order dated 05/10/2021. Hereto annexed and marked Exhibit- A
Copy of order dated 05/10/2021 Passed by Hon’ble Session Court
Thane.
7. The applicant states that from the date of arrest i.e., 01/01/2021 till
today he has been in jail custody, despite getting bail on 05/10/2021
until today, the applicant has failed to furnish surety because the
applicant is a poor person and he is unable to bring or arrange
surety of Rs. 50,000/-.
8. The Applicants is 29 years old young person and He is the
breadwinner of his family. Applicant is ready willing to abide by
any terms or conditions imposed upon him while considering this
application.
9. The applicant states that Apart from this present case, there is no
criminal antecedents against him, as well as no criminal case or FIR
logged against him.
10. Applicant state that he is ready to obey all the condition directed by
the Hon’ble Court in Bail application of dated 05/10/2021 except to
P.B. of Rs.50,000/- with one or more surety. for that applicant seek
to modify the bail order and reduce the P.B of Rs. 50,000/- to
25,000 with one or more surety or Permanent Cash Bail of Rs.
25,000/-.
11. Therefore, accused prayed before the Hon’ble Court as under.
a. The Hon’ble Court, please modify Bail order passed by this
Hon’ble Court on dated 05 /10/2021.
b. The Hon’ble Court Modify bail condition and reduce the P.B
and S.B of Rs. 50,000/- to 25,000 with one or more surety or
Permanent Cash Bail of Rs. 25,000/- with such any term and
condition Hon’ble court deem fit and proper.
c. For such other further relief’s as necessary as per the
circumstances of the present Application.
