Dear Sir,
With reference to our work order, we hereby pleased to place a Amended Work Order for Earth work
(Excavation) up to sub grade top, Breast wall, Retaining wall, CTSB, WMM, DBM in our above mentioned
project on the following rates and terms & conditions:

Dense Graded Bituminous Macadam-Providing and
laying dense graded bituminous macadam with higher
capacity batch type HMP using crushed aggregates of

binder @ 4.0 percent by weight of total mix and filler,
8 transporting the hot mix to work site, laying with a Cum 8245 10000 8,24,50,000
hydrostatic paver finisher with sensor control to the
required grade, level and alignment, rolling with
smooth wheeled, vibratory and tandem rollers to
achieve the desired compaction as per MoRT&H
specification clause No. 505 complete in all respects.

TERMS & CONDITIONS
1.0 General: -
M/s Aushta is executing work of “Rehabilitation & up-gradation to 2-Lane with paved shoulder from
Existing Chainage Km134+950 to Km166+100 (Design Chainage Km116+980 to Km 146+700) (Package- VI)
under 31BRTF on Akhnoor-Poonch Road (NH-144A) in the Union Territory of Jammu and Kashmir under
project Sam park, Border Roads Organization (BRO) on EPC Mode” on Sub-contract of SGIPL.
2.0 Scope of Work: -
The scope of the work will be earth work (Excavation) up to sub grade top, Breast wall, Retaining wall, CTSB,
WMM, DBM as mention above as per approved working drawing with Technical Specifications. All
complete as per the direction of Engineer-in-charge.
3.0 Period of Completion:-
Eighteen (18) month from date of commencement. You shall be responsible and liable for timely execution
the work as per terms & condition in this regard.
4.0 Contract Price:-
The Contract Price shall be Rs. 35,22,67,295/- (Rupees Thirty-Five Crore Twenty Two Lakh Sixty-Seven
Thousands Two Hundred Ninety Five only).The above work is exclusive GST. No claim on this account shall
be entertained or allowed at any subsequently. TDS & Other taxes as applicable shall be deducted at source.
5.0 Mobilization: -
You have to mobilize required manpower for executing the work within 7 days of issue of this work order.
6.0 Programme:-
You shall have to execute the work as per scheduled program & program discussed with Project Manager.
Working plan / schedule of entire above scope should be submitted by Subcontractor after receiving WO
and shall be update from time to time.
7.0 Variation of Quantities:-
The quantities mentioned in the BOQ are final and are not liable to vary to any extent. The quantities
varying will be executed at the same rates as agreed and no extra payment will be made in this regard.
8.0 Safety:-
The Sub-Contractor is to provide all Temporary Barriers, Fencing, Hoarding etc. as may be necessary to
protect the public and others, and for proper execution of the works and shall remove and clear away at
completion of the works and make good all work disturbed. The Sub-Contractor shall take all precautions
and preventive measures against (precautions against fire, water and Construction Mishaps) all hazards at
the site and shall assume full responsibility for the same. Safety Equipment shall be provided by the Sub-
Contractor, including Personal Protective Equipment (PPE).
If any Violence or not maintaining Safely Rules / Guideline, Section-in-Charge / Safety Personals / Project
Manager have right to issue Debit Notes of any Amount and the Subcontractor is bound to pay that
amount, otherwise the same amount will be debited from his next RA Bill.
9.0 Measurement:-
All the measurements & Levels recorded jointly by the Aushta/Client Engineer are to be accepted by you.
10.0 Billing:-
Billing will be done monthly at the end of the calendar month. You should submit the bill in the prescribed
format as per the joint measurements recorded, which will be limited to the measurement accepted by
Client. Payment will be made on pro-rata basis after completion of work weight-age.
11.0 Payments:-
The payment will be made within 15 days after the certification of client bill. Payment to be made only
after submission of PAN number. You shall not be allowed price adjustment on the above work. You shall
responsible for all Statutory Compliance including Safety and shall submit Lab our Law Compliance like PF,
ESI, etc with your RA Bills.
12.0 Accommodation:-
Accommodation for the staff beyond site is the sole responsibility of agency. No extra payment will be
made in this regard. Lab our Hutment shall be arranged by Subcontractor at his own cost only Construction
water & power shall be arranged by Subcontractor at his own cost only.
13.0 Taxes:-
All statutory deductions will be done from your payments. The Rates are inclusive of all Indirect Costs,
Materials and Lab ours, T & P and Rates are fixed & firm till the completion of the scope of work with any
amendment of scope on subsequent date.IT-TDS shall be deducted from each RA Bill.
14.0 Retention Money:-
5% of the Gross Value of the Bill will be deducted as Security Deposit from each Running Bill and it may be
released from our Head Office after 2 Months of Successful Completion and the date will be counted from
the date of your Final Bill.
15.0 Insurance:The Contractor shall take all necessary insurances & ESI for the period up to the
completion of Work to cover all plants, machineries, equipment, manpower & third party
damages for property and men required and engaged for the satisfactory performance of the
Work.
16.0 Recovery:-
Any material supplied by the company to you shall be recovered at the actual cost+10% handling charge.
Similarly , services provided by the company to you, including equipment, arrangement of contractor’s etc.
for the scope of work shall be recovered from you on actual +10% handling charge.
17.0 Termination of Contract:-
SGIPL reserves the right to take back part of the work or the whole work giving 2 days notice if
a) The agency fails to adhere to its approved work schedule or any other failure / misconduct to achieve
the same.
b) The contractor is unable to mobilize the equipment in the stipulated time.
c) The contractor will be terminated in case his staffs have an altercation/ quarrel / manhandling / verbal
abuse / threatening of the Aushta/ Client Engineer Staff.
d) GST monthly return to be submitted electronically.
e) Any dispute arising of this work order shall be under jurisdiction of Hon’ble Courts in Faridabad.
f) When GST was deposited by Sub contractor and show on GST portal then GST amount will payable.
g) whether Vendor should charge IGST or CGST-plus-SGST; (ii) from where the billing should be
undertaken and to which registration of Shree Girrajjee Infra Heights Pvt.Ltd.; (iii) whether the Vendor
should be responsible to generate the E-Way Bill; (iv) the format of invoices/credit and debit
notes/advance receipt vouchers; (v) maintenance of #Compliance Rating# above a specified threshold
etc.) And the relevant timelines for such compliances based on the applicable GST laws.
18.0 Sub-Contractor obligation
The Contractor shall ensure that:
a) The Sub-Contractor shall arrange all skilled lab our, supervisor, tools & tackles, etc required for
execution of the Work at its own cost.
b) While performing the obligation under this Work Order, the Contractor shall comply with all lab our /
industrial laws / ESIS/ PF and other applicable laws, rules, regulations, orders and also direction /
instruction given by the concerned statutory authorities and indemnify the Client against any / all
losses / expenses incurred on observance of the statutory laws / regulation
c) The Sub-Contractor shall ensure to pay minimum wages to the lab our as fixed by concern Govt. by the
stipulated date, from time to time;
d) Sub-Contractor shall comply with the Contract Lab our (Regulation & Abolition) Act, 1970 and the Rules,
1971 framed therein in regard to all matters provided therein and shall comply with the provisions of
various Lab our Laws and Acts such as Payments of Wages Act, 1963, Minimum Wages Act, 1948,
e) Workmen Compensation Act, 1923, Industrial Disputes Act, 1947, Personnel Injuries (Compensation
Insurance) Act, 1963, Lab our cess Act, 1996 etc
f) Payment against wages, lab our benefits, whatsoever as provided in lab our laws & other laws of State,
other incidental expenses for the welfare of lab our etc. shall be sole liability of the Sub-Contractor. If
the Client has to make such payment as stipulated above on behalf of the Sub-Contractor, the same
shall be deducted from the bills of the Sub-Contractor or security deposit, available with the Client;
g) In case of any accident to any workmen in the course of performance of Work because of any reason,
any compensation, if payable, shall be paid by the Sub-Contractor at its own cost. No claim of the
Contractor shall be entertained on this account;
h) The Sub-Contractor shall be responsible and liable for providing general site security and taking safety
measures within the Work area including its Camp and office area by arranging necessary fencing,
barriers, lighting, guard, watchman etc. to the satisfaction of the Client.
i) The Sub-Contractor shall obtain approval of In-charge before starting the work.
j) If diversion will require, it will be made by contractor its own cost.
19.0 Indemnify:-
Contractor (BRS) shall indemnify Aushta / Client against any losses and claims in respect of injuries or
damages caused to any person or material or physical damage to any property whatsoever which may arise
out of or in consequence to execution of the said work in complying with any loss and statutory obligations.
Any damage or losses arising thereof shall be debited entirely to the account of contractor and SGIPL shall
not be liable for any losses or damages
