1036/A situated in the city of Belgaum, on a monthly rental
of Rs. 350/-, for the lease period of 8 years.

Agriculturist, Age: 24 years, R/o: Belgaum, Lease Deed
executed between us, as below:

The property bearing CTS No. 1036/A, measuring 770 sq.


yrds. in full, situated at Kalaigar Galli, Belgaum City, Tq.
Belgaum, Dist. Belgaum, owned by No. (1), its boundaries–
to the east: Property bearing CTS No. 1037, to the west:
Passage belonging to Nagesh Bharamani Chavan and
beyond that CTS No. 1032 owned by No. (1), to the south:
State Road and to the north: Property of Usmanso Kalaigar.
The property situated within the above boundaries is in
ownership of No. (1). The No. (2) is in possession of the
property as tenant for monthly rent of Rs. 350/- (Three
Hundred Fifty Only) from 1.5.1971 to 30.4.1979 and No. (2)
is continuing to be in possession of the said property as
tenant. No. (2) shall pay the rent amount to No. (1) every
month, within time and shall get receipt thereof and shall
not complain of payment of rent without any receipt. It is
No. (1) who shall pay the annual property tax of Rs.150/-
only and if the tax amount is above Rs.150/- the same shall
be paid by No. (2) only. The No. (2) or his successors are at
liberty to run their own business in the said property and he
is free to use the same. The tenancy of No. (2) would
commence of 1st day of every month till the end of
particular month. The building in CTS No. 1036/A is built as
per requirements of the previous Lease Deed. The building
structure built by No. (2) has to be removed by him at the
end of the tenure and has to deliver the vacant land to No.
(1).

The terms of this agreement are binding on the legal heirs


and successors of No. (1) and (2). Thus executed this Lease
Deed in between us No. (1) and (2) dtd 19 June 1971,
signed, Belgaum.

Mechanic workshop, Age: 41 years, R/o: H.No. 1780,
Kelkarbaug, Belgaum.

By Intending Vendor, (1) Bharamappa Mallappa Chavan, (2)


Mallappa Bharamappa Chavan, Caste Bhoi, Occupation
Agriculture, Age: 32 and 72 years respectively, R/o.
Belgaum. The terms of this agreement of sale are as under:

The vendor has got financial necessities for payment of


dues in Spl Execution No. 134/1954 filed by Davar Industries
Ltd before Civil Court Belgaum and in order to make
payment in said execution petition for such legal necessity,
that the property having been purchased by the said No. (1)
under Regd Sale Deed dtd 20.6.1949 and the intending
vendor is hereby agreed to sell as per prevailing market
price of ₹14000/- and same being just and proper
consideration, are hereby executing this Sale Deed and the
description of the same is as under:

All that piece and parcel of property bearing City Survey No.
1036/A, situated at Kalaigar Galli, near Old Bus Stand and
same is in the possession of the tenant by name Bhau
Dhanaji Kakatkar urf Bhau Mestri on monthly tenancy along
with open site situated towards the western side, totally
measuring 770 sq.yrds. and same is bounded by East- our
property bearing CTS No. 1036/B, West- passage out of the
same number and thereafter CTS No. 1032 and 1031B/2
that property belongs to us, South- public road and North-
CTS No. 1033, 1034, 1035 & 1034/1A. The above described
property is our ownership and we have under regd
Agreement of Lease dtd 24.4.1956 and as per terms of the
lease agreement, Sri Kakatkar has constructed a building at
his own cost for the purpose of his business and as per the
terms after the lease period is over the tenant Kakatkar has
to remove the same at his own costs and now having
transferred all the right, title and interest in your favour,
you will be entitled to receive the rents as landlord from the
tenant. Therefore under this sale deed we are transferring
all the right, title and interest within and above land with
easement and all other rights permanently and we have
received the consideration amount of ₹14000/- and hereby
acknowledge the same and we hereby handover the
possession and ownership rights under this sale deed and
accordingly we have notified the tenant Kakatkar that by
executing of this sale deed you will be his landlord and by
this you have become absolute owner of the same and
hereafter neither we nor our legal heirs, our successors will
have any right, title and interest whatsoever and you shall
be the absolute owner of the property and you shall go on
paying yearly rent of the land to the vahivatdar of Sayyed
Idrus Dargah and shall be go on paying the municipal taxes
yearly and you can use the property as per your desire. On
execution of this deed, we shall not have any right, title or
interest whatsoever and that we have not having any
dealing with any other person in respect of the property and
the property is free from all litigations and disputes of bhau-
bandi, sahukari, sarkari and in the case any such dispute
arises, we will settle the same at our own costs and will
continue to maintain your absolute right of ownership over
the land and the terms of this sale deed shall be always
binding upon us and our heirs, successors. You are hereby
also authorised and given rights to use the passage situated
towards western of this property for coming and going and
that right also includes in the consideration amount
received under the sale deed. Though the property stands
in the name of No. (1) above, but however in order to give
you freehold rights over the property, the No. (2) is also
executing this deed as consenting party.

Out of sale consideration of ₹14000/- received by us, out of


the same a sum of ₹12000/- have been received by us from
you as and when we required and out of the same a sum of
₹2000/- is received by us before and in presence of Sub
Registrar and therefore for the said consideration amount,
no separate receipt is necessary.

The vendors have hereby handed over all the documents of


title which were in their possession to the vendee.

In witness whereof this sale deed is executed this the 30 th


day of August 1956.

As per terms agreed by us, executed this Lease Deed


as below:

The property i.e. an open space bearing City Survey


No. 1036/A+B, measuring 762 sq. yrds. as per City Survey,
situated at Kalaigar Galli (near Old Bus Stand), Belgaum
City, Tq. & Dist. Belgaum, fully owned and possessed by No.
(1), and its boundaries are:– to the East: Property bearing
CTS No. 1037, to the West: Passage belonging to No. (1)
and thereafter property bearing C.Survey No. 1032
belonging to No. (1), to the South: State Highway, and to
the North: Property belonging to Usmansaheb Kalaigar; the
property within these boundaries.

The No. (1) is absolute owner in possession of the


above referred property. The No. (2), on 1 st May 1951, with
condition to pay every month rent to No. (1) in time, for the
period of Ten (10) years and as such if the No. (2) pays rent
to No. (1) without any default and objections, then the lease
period will be continued for further 10 years, which in total
for 20 years, and as such the No. (2) has acquired
possession of the property from No. (1). Out of the said
property, the property C.Survey No. 1036/B, is already
given on lease to other person by the No. (1). As such, it is
agreed that, till the possession of the said property is given
to No. (2), the No. (2) shall pay ₹125/- (One Hundred
Twenty-five Only) to the No. (1) every month as rent, and
further, after the possession of property C.Survey No.
1036/B is given to No. (2), the No. (2) shall pay a monthly
rent of ₹135/- (One Hundred Thirty-five Only) to the No. (1);
and till then, the No. (2) is at liberty to receive the monthly
rental amount of the C.Survey No. 1036/B from the tenant
already therein every month; as such, the monthly rental
shall be paid every month without fail to the No. (1) and
written receipt thereof to get from the No. (1); and the No.
(2) shall not complain of payment of rent without receipt.
Out of the property, the C.Survey No. 1036/A is an open
space and the possession thereof is given to the No. (2),
and there is a temporary structure on C.Survey No. 1036/B
belonging to No. (1) and the same is leased to other party,
and rent amount thereof is to be received by the No. (2)
from 1.5.1951 and the total rent amount is to be paid to the
No. (1) every month. After the possession of property and
the temporary structure belonging to No. (1) in the C.Survey
No. 1036/B is given to No. (2), the temporary structure is to
be demolished by the No. (1), and thereafter for the
property bearing C.Survey No. 1036/A+B, the No. (2) shall
pay monthly rental amount of ₹135/- to the No. (1) and to
obtain receipt thereof from No. (1) every month.

The municipal tax etc. in respect of the said property,


if any, shall be paid by the No. (1) only, as owner. As the No.
(2) has got the open land on rent, if he wants to build
structure on the said land for his business purpose, he has
to build the same on his own; and on leaving the said
property as per agreement, the No. (2) shall remove his
structure on his own, and further the No. (2) shall use the
structure as his wish and same shall be given in possession
of No. (1) in vacant position.

Immediately after completion of 20 years of the No.


(2) as tenant on 30.4.1971, the No. (2) shall pay all dues to
No. (1) without any excuses of notice or vahivat and to
deliver the possession of the property to No. (1) without any
objections.

The No. (2) has right to be in possession of the said


property for 20 years as tenant if he pays regular rent; on the
contrary, if the No. (2) fails to pay regular rent, the lease deed
stands cancelled after 10 (ten) years of period; and if he pays
regular monthly rent, he has every right to be in possession as
tenant for 20 (twenty) years as agreed.

In the event, at any time, if the No. (2) fails to pay


monthly rent, the No. (1) is at liberty to cancel the
remaining lease period and has every right to take back the
possession of the property.

The above terms are binding on us, our heirs and


executors of our WILL.

Thus, we, with our own will and wish, being conscious,
executed this lease deed and signed on 24.4.1951.

have been allotted and handed over possession to my

request to effect the entry of the partition by mutating

yards respectively, all the eight properties adjoining to
each other, and boundaries of all the properties
compressing in unit is as under:

The properties thereon sold hereunder are within

trees, dry wood, stones, hidden treasure, all the
materials in the property, possession and easement etc.
is being sold to you for valuable consideration of
₹37000/- and we hereby transfer our possession to you
with consent of tenants therein. Henceforth, you will be
the owner of the above property. Henceforth, neither we
nor our heirs will have any right over the property, in any
way. Henceforth, you as owner, shall pay every year a
sum of ₹6/- as property tax (Bhoi Bhade) and the
Muncipal Tax from 1.7.49 shall be paid every year by you
in respect of the said property, and you along with your
family shall enjoy possession as per your wish
permanently and live happily. As per order of the court in
O.S. No. 104/1914 and 386/1926, space for passage is
left in the said property. We have not committed with
others in respect of the said property. Also, there are no
litigations of bhavubandi, savkari, sarkari etc and if
arises, will be settled on our own costs. We will secure
your ownership and possession over the said property in
accordance with this Sale Deed. This term is binding on
us and our heirs too.

Out of the consideration amount of ₹37000/-, in


the Agreement dtd 23.10.1947, a sum of ₹10000/- (Ten
Thousand Only) by Cheque No. 49861 drawn on the
Supreme Court of India Ltd., Belgaum, and a sum
₹10000/- (Ten Thousand Only) by Cheque No. 63321
dtd 29.4.1949 drawn on same bank, a sum of ₹5000/-
(Five Thousand Only) by Cheque No. 63334 dtd
13.6.1949 drawn on same bank, a sum of ₹3000/-
(Three Thousand Only) by Cheque No. 297663 dtd
1.6.49 drawn on the New Citizen Bank of India Ltd.,
Belgaum, a sum of ₹5000/- (Five Thousand Only) by
Cheque No. 408287 dtd 22.4.1949 drawn on same
bank, a sum of ₹1000/- by Cheque No. A048219 dtd
9.12.1949 drawn on same bank, in total ₹34000/- has
been paid by your father Sri Mallappa Bharamappa
Chavan and we have received the same, and remaining
consideration amount of ₹3000/- shall be paid by you to
us before the Sub Registrar Belgaum and accordingly
the total consideration amount is received by us and
therefore no need to issue separate receipt for the
same.

The sale agreement of said property was


committed with your father Mallappa Bharamappa
Chavan and this Sale Deed is executed in your favour
as per his wish only.

relevant documents to you.

The above terms and conditions are binding upon


us and our will-executor as well.

Therefore, we with our wish executed this Sale
