PROBABLE CAUSE AFFIDAVIT

Detective Jonathan Herring affirms that he believes and has good cause to believe that on
the 23rd day of November 2024, in the County of Clark in the State of Indiana, William
D. Davis committed the offense(s) of:

o Murder —
IC 35-42-1-1

My belief is based upon the following facts and information constituting probable
cause as set forth below:

Your Affiant, Detective Jonathan Herring, is a Detective with the Jeffersonville Police
Department (JPD). I have been a sworn Law Enforcement Officer since March 2012, and
I am currently assigned as a Maj or Case Detective.

I have specialized training and documented law enforcementexperience specifically


related to investigations pertaining to crimes of violence, including but not limited to
Murder. I have participated in and conducted numerous death investigations, including
deaths determined to be Homicides, which have resulted in criminal prosecution.

The information contained in this affidavit is based on your affiant's personal


participation and information provided to your affiant by other sworn law
enforcement officers involved in the investigation. I believe this information to be
true and accurate and supported by information or physical evidence collected in
accordance with best case practices..

In support of said affidavit for probable cause, your affiant states as follows:

On November 23,2024, at 07:43 hours, Jennifer D. Dean (DOB: 06/11/1976), called 911
and advised her husband, James B. Truman (DOB: 12/ 16/1978) was deceased and she
observed a laceration on the back of his head. At 0745 hours, Dean stated Truman was
cold to the touch and refused to perform CPR. Responding officers arrived and requested
the coroner. Heartland EMS personnel pronounced Truman deceased at 08:02 hours.

Detective Joshua Schiller responded to the scene and requested additional detectives and
resources to assist with a suspected homicide.

Dean informed officers Shawn Huff (DOB: 03/07/1985) was sleeping in his car outside
the apartment at the time she discovered Truman. Dean approached Huff to inforrn him
of the situation, where Huff immediately woke up and departed the area. At
approximately 1015 hours, Officer Hunter Powell and Officer William Harris located
Huff in his white 2012 Volkswagen Passat bearing Indiana license plate 369CVM,
registered to Shawn Huff. Huff was detained and transported to the J effersonville Police
Department. Huff s Volkswagen Passat was towed to the Jeffersonville Police
Department.

Officer Travis Williams, Officer Alex Dalton, and Detective Schiller processed the crime
scene pursuant to a search warrant (Cause Number: 10C03-2411—MC-2623) authorized
by Clark County Circuit III, Judge Lisa Glickfield.

Investigators collected one (1) 9mm shell casing at the scene which Detective Herring
later transported to the Louisville Metro Police Department (LMPD) NIBIN (National
Integrated Ballistic Information. Network) unit on 11/25/2024. Detective Herring
transferred custody of the shell casing to LMPD NIBIN technician T. Starks for entry.

Interview with Jennifer Dean


November 23, 2024, at approximately 11:00 hours, Detective Herring, conducted an
interview with Dean, accompanied by her sister, Melissa Richards (DOB: 09/ 1 5/ 1973).
Dean stated she worked at Rivercrest Senior Living, 4917 Grant Line Road, New Albany,
Indiana. On November 22, 2024, Dean clocked in at 18:51 hours, and clocked out on
November 23, 2024 at 07:22 hours. Dean provided precise times as she utilized an
application to document clocking in and clocking out times. Dean called Truman at
05:23 hours where the phone call went straight to voicemail. Dean noted it was unusual
for Truman to have his phone powered off and he never arrived to pick her up fiom work.
Dean called Truman approximately fifteen (15) times in total, and every phone call went
straight to voicemail. Dean arrived at her residence, 500 Indiana Avenue, Apartment 4,
Jeffersonville, Indiana via Uber at 07:43 hours.

Dean noticed the fiont storm door and main door were unlocked, which was unusual as
Truman was paranoid and always kept the doors locked. Upon entering her residence,
Dean observed Truman laying there (on the floor in living room) and his body was cold
to the touch. Dean called 911 and continued to check Truman's body. Dean exited the
residence to contact Huff, who was sleeping in his Volkswagen Passat parked on the
street. Dean noted Huff regularly sleeps outside in his Volkswagen Passat. Dean intended
to inform Huff of Truman's death. Dean woke Huff up, noting he was very disoriented
and upon informing him Truman was deceased, Huff started his Volkswagen Passat and
departed the area.

During the morning hours of November 23, 2024, Dean spoke with "Dale Wendall," later
identified as Wendall H. Mason (DOB: 08/07/1960). Mason was at Truman's apartment

until approximately 03:21 hours with Truman. Dean believed Mason texted Truman at
approximately 04:12 hours and 04:21 hours. Dean told Detective Herring the last time
she communicated with Truman was at approximately 0320 Hours, and phots of that text
communication between Dean and Truman are pictured below:

The second photo shows that Dean had Truman saved in her phone as "Son" with the
phone number of (812)946-9032. Dean stated Truman was working as a police informant
for another police agency, and Truman thought very highly of the officer with whom he
was working.

Dean and Richards claimed the damage to the door frame of Truman's apartment was
from last Friday as Truman kicked his own door in resulting from his paranoid behavior.
It should be noted on November 16, 2024, at approximately 0053 hours, officers
responded to Truman's apartment for a welfare check. Computer Aided Dispatch (CAD)
confirmed Truman kicked in the apartment door (JPD: 2024-40786).

Detective Herring stepped out of the interview room a short time later, and after
reviewing the interview, observed a conversation between Dean and Richards, where

they discussed Truman being murdered. Richards asked Dean .. do you think it had
anything to do with those people he stole that money from?" Dean responded "maybe."
Dean and Richards discussed the money and Dean stated she hasn't spent a penny of it.
Dean mentioned they had a "good" day yesterday and her sister seemed happy they have
a good last memory. At the time, Dean and Richards were unaware of Truman being shot
and suspected Truman had been struck in the back of the head with a baseball bat.

Detective Herring returned to the interview room and inquired about the surveillance
cameras at Truman's apartment. Dean stated the surveillance camera was mounted
outside, however, Shawn Huff recently brought the surveillance camera inside of the
apartment and the surveillance camera was sitting near the microwave.

Jennifer allowed Detective Herring to photograph her text messages, Truman's social
media posts, and "Billy," who Dean suspected Truman was in debt to. It was later
determined that the "Billy" Jennifer Dean showed me was deceased, William James.
Dean believed Dale would be able to identify Billy. Detective Herring informed Dean
that Truman was shot, and she informed Detective Herring about money Truman
supposedly took from someone. Dean advised Truman took $11,000 from a man, and he
(Truman) had been flashing money around, purchased new clothes, and vehicle(s). Dean
believed the individual Truman took the money from to be William James. Dean advised
William was on parole and lived in Kentucky, information consistent with the suspect,
later identified as William D Davis Jr. (DOB: 05/28/1969). Dean believed Truman took
the money from Davis over a month ago. Dean informed Detective Herring that Davis
knew Truman's address as he recently knocked on Truman's door. Dean believed the
money was possibly fronted, referring to money paid in advance, to Truman for drugs,
and that he didn't follow through with what he was supposed to do. She knows this from
overhearing his phone conversations with other people.

interview with Wendell "Dale" Mason


Detective Herring began speaking with Mason at approximately 1226 Hours in the same
interview room that Dean and Richards just vacated and the interview room camera
remained running for both interviews.

Mason was going through his tablet trying to find the social media account for the guy he
knew Truman had gotten into an argument with. He told me there was a car purchased
recently, and Mason allowed him to register the vehicle in his name because they were
concerned it would mess up Truman's child support payments. He then said Truman was
in an argument with the guy who gave him the money for the car and he was talking to
him crazy. Mason said Truman put it on loud speaker, and that the guy was "talking
crazy" and said "you don't know me.." and "I know people..", so Mason took over and
told the other male to think twice about talking shit to his friend. Mason estimated this
phone conversation was approximately 3-4 weeks ago. Mason said this argument was
over money, but he wasn't sure about how much money it was and didn't want to
quantify it.

Mason told Detective Herring he was with Truman the previous evening and estimated he
arrived around 11 PM or so, and there was no one else at the apartment. He believes he
saw a red colored vehicle in the alley and he circled the block because James was
paranoid and he checks on things like that. Mason also thinks he saw a car backed in
when he left so he circled around, and that's when he saw Shawn Huff' s vehicle parked
out front of the apartment. He told me that he texted Truman when he arrived home at
04:03 AM and that he calls him "Hammerhead", and this communication was via

Mason then told Detective Herring the suspect sent him a message at some point about
the car and would later find the message. Detective Herring asked about the Audio Call
made between him and Truman at 0034 hours. Once he saw this, he realized he was
mistaken earlier about his timeline, and he made this call prior to leaving his residence
and coming to Truman's apartment. Mason discussed Truman's growing paranoia and
then went on to explain the issues that he (Mason) had with Shawn Huff. Mason and
Detective Herring discussed Huff and if he had ever seen him with a firearm. Mason
believed he might have a .380 that was stolen, but he never personally saw him with it.

When Detective Herring stepped out of the interview room, Mason called Jennifer Dean,
and they discussed the "money guy" and he asked her what his name was. Mason seemed

confused about the type of car or cars that the suspect utilizes and talks it through with
Dean. A short time later, Detective Herring entered the room, and he had located the
messages he was telling Detective Herring previously about with the "money guy." He
showed Detective Herring the Facebook profile for "Operators Billy (billy davis)" and
also showed Detective Herring the message about the car.

Interview with Shawn Huff


Shawn Huff was interviewed by Detectives Justin Salisbury and Levi James at JPD.
Ultimately, he was charged with possession of methamphetamine based on evidence
collected during a search warrant of his vehicle. Worth noting in this narrative, Huff
admitted to being at the location in his vehicle around the time that Truman was killed,
but he never went inside the apartment. Huff had knowledge of an approximate debt of
$12,000 (that Truman owed) and that the person who he owed money to slashed
Truman's tires. Huff willingly submitted DNA buccal swabs to Detective J arnes. Please
see Detective James' supplement report for full and complete details of this interview.

Furtherance of Suspect Investigation


Once the suspect name of "Billy Davis" was obtained, Detective Herring was able to
locate William D. Davis Jr (DOB 05/28/1969). Open-Source (TLO) records for law
enforcement revealed a possible address of 11802 Pond Creek Drive, Louisville,
Kentucky. Additionally, investigators were able to locate two (2) vehicles registered to
Davis.

o 2002 Red Chrysler PT Cruiser bearing KY registration number 4SSZSA with a
VIN 3C4FY48B62T295739
Officer William Harris assisted in this investigation and began searching Automatic
License Plate Reader (ALPR) for any information related to these vehicles of interest.
The following is an excerpt, copy and pasted from an initial supplement report by Officer
Harris:

"
Working in concert with the Jeflersonville Police Detective Division, I
collected information from ALPR systems regarding a vehicle developed 0f
interest, a white Chevrolet Equinox bearing Kentucky license plate
K9W626. The vehicle entered the city ofJeflersonville, Indiana by way of
the 2"d Street bridge off ramp to Court Avenue at 4:26 AM At 4:26 AM,
the vehicle traveled past Broadway Street on Court Avenue eastbound. At
5:23 AM the vehicle traveled past Mulberry Street on Court Avenue
westbound then traveled onto the 2"" Street bridge ramp southbound from

Court Avenue at 5:23 AM

It is worth noting that exiting on 2nd Street off ramp and then turning East on to Court
Avenue, is a direct and reasonable route to take to 500 Indiana Avenue. The above ALPR
data is not the only information available and relevant to the case, but this is being
highlighted for the purposes to support the probable cause for William Davis Jr.
Detective Ashley Humphreys and Officer Powell assisted in canvassing and collected
video which may have relevant information related to this investigation. The following
information was collected:

o At approximately 0426 hours a white SUV consistent with the suspect vehicle is
seen on surveillance footage from Liquor Land, 400 West Court Avenue,
Eastbound on Court Avenue which is consistent with the ALPR hit at Court
Avenue and Broadway Street.

o At approximately 0427 hours, a white SUV consistent with the suspect vehicle is
seen on surveillance footage collected from Bachman Chrysler Dodge Jeep
located at 630 Broadway Street. The vehicle turns into the alley behind Truman's
apartment and the suspect turns off the vehicle's headlights before proceeding
down the alley.

o At approximately 0523 hours, a white SUV consistent with the suspect vehicle is
seen on surveillance footage from Liquor Land Westbound on Court Avenue,
which is consistent with the ALPR hit at Court Avenue and Mulberry Street at
0523 hours.

Based on the information developed so far, the victim (James Truman) last sent a
message to Wendell Mason at approximately 0403 hours and was presumably still alive.
Dean started calling Truman at 0523 hours and the phone was going straight to
voicemail. It is reasonable to believe Truman was already deceased, and the suspect had
turned off his cell phone. When Dean arrived home at approximately 0743 hours, Truman
was cold to the touch and first responding officers observed lividity which, based on my
training and experience, would take a couple of hours to occur in a climate-controlled
room.

On December 1, 2024, Detective Beahl received records from Verizon Wireless for the
device ending in 3816 (previously identified by investigators as a cellular number
associated with one of Davis's phones). These records were mapped using Zetx Trax and
Google Earth Pro, showing the device in question to be absent of any activity with the
network from approximately 03:57-07: 10 AM on 11/23/24. Detective Beahl then
evaluated the same time frame (03:57-07: 10) against other days within the record set,
discovering that an absence of records during this time of day is extremely abnormal for
this phone number.

During the investigation, Detective Cody Richardson assisted with the following;
Historical call detail records (CDR's) were obtained for a cellular number known to
belong to James Truman, (812) 946-9032. The number ending in 9032 was attributed to
being a Verizon cellular number. Historical and live records were obtained from Verizon
for this case due to James's phone not being located upon a search of the residence (500
Indiana Ave Apt 4). These records were obtained to locate and recover James's device.

Utilizing historical CDR's along with corroborating evidence from surveillance footage,
ALPR's and footage from other law enforcement agencies, it is my belief James's
cellular device was taken by Davis during the murder and was transported in Davis's
2019 white Chevrolet Equinox. This belief is substantiated by the following facts:

o
Leading up to 5:12 A.M., historical CDR's place the device ending in 9032 in the
area of 500 Indiana Avenue.
o At approximately 5:20 A.M. historical CDR's indicate movement away from 500
Indiana Avenue.
o At approximately 5:20:11 A.M., an ALPR hit from the camera located at
Court Avenue and Mulberry Street captures a white Chevrolet Equinox
bearing Kentucky registration K9W626 traveling westbound on Court
Avenue.
o At approximately 5:23 A.M., historical CDR's for the device ending in
9032 place the device in the area of Court Avenue near Mulberry Street.
o At approximately 5:23 A.M., surveillance footage obtained from Liquor
Land (400 West Court Avenue) shows a vehicle matching Davis's 2019
white Chevrolet Equinox traveling westbound.
o At approximately 5:23:51 A.M., an ALPR located on the 2nd Street Bridge facing
southbound, captures a white Chevrolet Equinox bearing Kentucky registration
K9W626 traveling southbound.
o Video surveillance was captured by Cornerstone Real Estate Group (300
Missouri Ave #102) shows a vehicle matching Davis's white Chevrolet
Equinox at approximately 05:23:45 AM

o From approximately 5:24 A.M. to 5:25 A.M., historical CDR's for the
device ending in 9032 place the device traveling in a southbound
direction, believed to be on the 2nd Street Bridge.

o At approximately 5:25 A.M., surveillance footage was obtained from the


Louisville Metro Police Department's Real Time Crime Center (RTCC) camera,
depicting the area of 2nd Street and Main Street shows a vehicle matching Davis's
2019 white Chevrolet Equinox traveling southbound fiom the 2nd Street Bridge,
turning westbound onto Main Street.

Based on the device ending in 9032 traveling a route consistent with the 2019 Chevrolet
Equinox observed in numerous sources of corroborating video, it is Detective
Richardson's belief the device ending in 9032 was taken by Davis and was transported in
the 2019 Chevrolet Equinox attributed to Davis.

Based on the above listed facts, Detective James, Officer Harris, and Officer Powell with
assistance from Louisville Metro Police Department Violent Crime Unit began
surveillance at William Davis's residence,11802 Pond Creek Drive, Louisville,
Kentucky.

The following is copy and pasted from Officer Powell's case report supplement regarding
surveillance of William Davis's residence:

"0n Sunday, November 24, 2024, at approximately 2:30 p. m., I, Oflz'cer


Hunter Powell, Detective Levi James, Officer William Harris, and
members of the Louisville Metro Police Department (LMPD) Violent
Crime Unit (VCU) initiated surveillance at 11802 Pond Creek Drive,
Louisville, Kentucky. The purpose of the surveillance was to identzfiz
vehicles associated with the address, as well as identifi/ a person of
interest, William Davis (DOB: 05/28/1969). The suspected associated
vehicles are as follows:

o White 2019 Chevrolet Equinox bearing Kentucky registration K9W626


o Red 2002 Chrysler PT Cruiser bearing Kentucky registration 485ZSA
Upon arrival t0 the above listed address, both vehicles were on scene at
the location. The Chevrolet Equinox was parked in the driveway of the
residence, and the Chrysler PT Cruiser was parked 0n the street in front
of the address.

At approximately 3 :54 p. m., a female, later identified as Misty McMichael


(DOB: 09/10/1975), exited the residence and walked over and entered the
Equinox in the driveway. During the same time, Mr. Davis appears from
the rear of the residence and walks over to the Equinox. For the next
several minutes, while Ms. McMichael is in the passenger seat of the
vehicle, Mr. Davis walks around the Equinox and opens the hatch of the
vehicle and appears to be cleaning the interior of the vehicle. At
approximately 3 :5 7 p. m., Mr. Davis rolls the trash can to the end of the
driveway onto the edge of the roadway. At approximately 4: 04 p. m., Mr.
Davis begins wiping down the dash of the vehicle with a rag or paper
towel.

At approximately 4:06 p. m., Mr. Davis gets into the driver seat 0f the
Equinox and backs out of the driveway and begins traveling down Pond
Creek Drive. At this time, I notified the members of the LMPD VC U
assisting us and informed them that Mr. Davis had departed the residence.
The LMPD VC U continued moving surveillance on Mr. Davis and
subsequently conducted a stop 0n his vehicle in front of 991 2 Evening Star
Way, Louisville, Kentucky. Detective Levi James arrived at the stop
location. For more information regarding Detective James 's interaction
with Mr. Davis and Ms. McMichael, reference his respective supplemental
report. Meanwhile, Oflicer Harris and I maintained constant surveillance
"
of the residence at] I 802 Pond Creek Drive after Mr. Davis departed.
A short time later, Officer Harris observed a female leave the target residence in a Jeep
Liberty which was stopped by LMPD VCU at a nearby Thorntons gas station without
incident. The female was later identified as Carolyn Nicolas, the mother of William
Davis Jr. Officer Harris conducted an interview with her and the following is a portion
from his supplement:

"Carolyn told me she has two sons, Billy Davis and Mark Davis, and Billy
lives with her at her home and has resided therefor approximately six to
seven years since being out ofprison. Billy recently moved his girlfi'iend in
with him at the house, who Carolyn only knows by a first name ofMisty.
She said Billy had been working at a company called Dynacrafi' until
recently when he was terminated. Carolyn said he needed t0 start a new
job soon due to his comments about running out of money and going
through his savings.

I asked Carolyn about the schedule Billy had been keeping recently and
she explained he left the house for at least an hour and a half the previous
night and returned with various food items. Two nights previous, she
explained he left the house to retrieve groceries for approximately an hour
in the 7:00 PM timefiame. When I asked if he left the house in the middle
of the night at times, she told me she did not think he did but could not be
sure.

Carolyn told me Billy drives a white Chevrolet Equinox and cares for it
well. She said he does not let anyone borrow or drive his car. I asked
Carolyn about Billy is living situation at the house; she explained he has an
apartment-like situation in the basement of the house but has access and
flee room 0f the entire residence.

I asked her ifBilly had any issues or conflicts with other people and she
said there have been issues in the past with an ex, resulting in a protection
order; but nothing other than that.

Carolyn told me there should not be any firearms at her residence and she
does not allow anything like that around. She did not believe Billy had any
firearms either Carolyn told me the only people living at the residence
"
were Billy, his new girlfriend Misty, and herself

During the investigative detention of William Davis, Detective James attempted to


interview him, but Davis invoked his right to an attorney fairly quickly. At this time,
Davis's phone(s) and vehicle were collected as evidence. Prior to the stop, Detective
Herring submitted a search warrant affidavit to seize electronics and vehicles belonging
to Davis to the Honorable Judge Glickfield, who signed the warrant. A copy of this
warrant was given to LMPD Detective Stovall, who began the process of domesticating
the warrant in Kentucky. Ultimately, Detective Stovall received a search warrant to seize
and search the Chevrolet Equinox as well as the residence at 11802 Pond Creek Dr. The
vehicle was later towed to 701 West Ormsby Avenue, Louisville for vehicle processing
by LMPD Detectives and Crime Scene Unit (CSU) in the presence of Officer Alex
Dalton on November 24 at approximately 2214 hours.

LMPD Detectives began executing the search warrant of the residence at approximately
1130 hours in the presence of J PD Detectives and Officers. Prior to the search warrant
being signed, Detectives canvassed the neighborhood and talked to a neighbor, who
wishes to remain anonymous, based out of fear of Davis. The neighbor advised that about
a week and half ago, Davis was seeking information on where to buy a firearm because
someone took $10,000 from him. That same neighbor advised on either Sunday,
November 17, 2024, or Monday, November 18, they saw Davis and noted he appeared to
be high on methamphetamine. A short time later the neighbor heard several gunshots
come from the backyard of 11802 Pond Creek Drive.

Officer Jonathan Happel and his K9 Partner Lobo (a Belgian Malinois who is annually
certified in firearms detection and apprehension through the North American Police
Work Dog Association) performed a search in the backyard of 11802 Pond Creek Dr
based on this information and quickly located three (3) spent shell casings on the back
deck of the residence. These casings were photographed and collected by LMPD CSU
technician Forlines. During the search warrant, Officers collected five (5) cell phones,
two (2) tablets, and one (1) laptop from the basement bedroom that Carolyn advised was
Davis's room. Officers also observed a white powdery substance and glass pipe
consistent with narcotics, specifically methamphetamine. All items were taken to the
LMPD property room to be released to JPD at a future date. The illegal narcotics
remained in the custody of LMPD.

Additionally, a trash can that was seen being pushed to the street by Davis prior to him
leaving the residence resulted in a trash pull. Those trash bags were collected by
Detective James and Detective Richardson and transported to the JPD Evidence Bay. The
following day Detective James and Officer Harris sorted through the trash pull and
located several evidence items of interest. One of which is a vehicle purchase agreement
with Wendall Mason's name and address for a Chevrolet Cruz, which is the vehicle

operated by Truman and was parked outside the residence of 500 Indiana Ave #4. See

The three casings collected by CSU Forlines were submitted to NIBIN. On November 25,
2024, Detective Herring transported the shell casing collected from 500 Indiana Avenue,
Apartment 4 to NIBIN. Later that day, NIBIN produced a presumptive investigative led
that matched the cene casing to the casings collected at Davis's residence. These casings
will be sent to the laboratory for final confirmation.

I believe all of the statements that have been gathered during the course of this ongoing
investigation are supported by the physical evidence that has been documented so far in
this case. These facts and circumstances are submitted to establish probable cause for the
consideration of a Clark County Judge to issue an arrest warrant for William D. Davis, a
