DEED OF ADJUDICATION

WITH ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

That I, NENITA R. ALEJANDRO, of legal age, widow, Filipino and a


resident of Linabuan Norte, Kalibo, Aklan, Philippines, freely and
spontaneously declare and manifest:

That I am one of the surviving heirs of the late MACARIO CABALES


who died a long time ago;

That, upon his death, he is the owner of a parcel of land located at


Brgy. Tigayon, Kalibo, Aklan, Philippines, more particularly described as
follows:

“A parcel of land designated as Lot No. 966


pt. situated at Brgy. Tigayon, Kalibo, Aklan and
containing an area of 1,573 sq.m., more or less
(actual area after survey is 2, 080 square meters)
. Bounded on the North by Lot No. 966; on the
East by Lot No. 969; on the South by Lot No. 950;
and on the West by Lot No. 965. Said land is
declared under ARP/TD No. 17-01-014-01558 for
the year 2018 in the name of Macario Cabales
covered by OCT No. (22375) RO-755 in the name
of Mario Flores”

That MACARIO CABALES left no known unpaid debts and obligation;

That said land was solely owned by me by virtue of a Deed of


________________________ executed on _________________ by my co-heirs, copy
of a Deed of ___________________ dated ___________________ is hereto attached
and made an integral part of this document;

That, in accordance with the provisions of Section 1, Rule 74 of the


Rules of Court, I hereby adjudicate unto myself in the above - described
parcel of land, subject to the liabilities imposed by Section 4, Rule 74 of the
Rules of Court;

That, for and in consideration of the sum of __________________________


PESOS (Php_____________.00), Philippine Currency, to me in hand paid by
and receipt of which is hereby acknowledged to my full and entire
satisfaction from the BUYER, MEL RICHIE G. FLORES, of legal age, single,
Filipino with residence and postal address at Magdalena Village Extension,
Kalibo, Aklan, Philippines, by these presents do hereby SELL, CEDE,
TRANSFER and CONVEY by way of ABSOLUTE SALE unto said BUYER the
THREE HUNDRED TWELVE (312) square meters, portion of the above-
described parcel of land designated as Lot No. 966-E, as reflected in the
hereto attached Sketch Plan prepared by Geodetic Engr. Lucas L. Francisco;

That I hereby warrant my title over the THREE HUNDRED TWELVE


(312) square meters, portion of the above-described parcel of land with
full rights to dispose of the same, free from all liens and encumbrances, and
that henceforth, full rights and possession shall pertain to the buyer, MEL
RICHIE G. FLORES;

Philippines, by these presents, do hereby NAME, CONSTITUTE AND APPOINT MARILYN
N. IGUIS, of legal age, Filipino, and a resident of Torralba, Banga, Aklan, Philippines as our
true and lawful attorney-in fact for us and in our names, place and stead to do the following
acts and things, to wit:

1. To process and follow-up all papers with the BIR, Registry of Deeds, DAR and
Assessor’s Office Province of Aklan and any government agencies for registration of
the documents of Deed of Adjudication with Absolute Sale over THREE HUNDRED
TWELVE (312) square meters, designated as Lot No. 966-E in the said offices and
sign papers necessary in the processing as well as the release of the tax declaration
and title in the name of MEL RICHIE G. FLORES;
2. To secure, request, get, claim and receive our Certificates of Live Birth, Marriage
Contracts and Death Certificate of Macario Cabales from the Philippine Statistic
Authority (PSA), Kalibo, Aklan;
3. To apply, process, follow up and claim our TIN with BIR;
4. To sign for and in our behalf, execute, prepare, acknowledge and deliver any and all
documents necessary to accomplish the authority herein mentioned;
5. To pay the necessary charges, taxes, fees and other expenses legally required to
accomplish the authority herein above-mentioned;

GIVING AND GRANTING unto my said attorney-in-fact full power and authority to do
and perform all and every act and thing whatsoever requisite or necessary to be done in and
about the premises as fully to all intents and purposes as I might or could do if personally
present; and HEREBY RATIFYING AND CONFIRMING all that my said attorney-in-fact shall
lawfully do or cause to be done by virtue of these presents;

I, NENITA R. ALEJANDRO, of legal age, widow, Filipino and a resident of Linabuan


Norte, Kalibo, Aklan, Philippines, after having been duly sworn to in accordance with law, do
hereby depose and say:

1. That I am the seller of a THREE HUNDRED TWELVE (312) square meters,


designated as Lot No. 966-E covered by OCT No. (22375) RO-755 in the name of
Mario Flores in favor of MEL RICHIE G. FLORES, of legal age, single, Filipino
with residence and postal address at Magdalena Village Extension, Kalibo, Aklan;

2. That the said original certificate of title of the said land was under my custody for
safekeeping;

3. That I hereby undertake that in the event the transaction of sale is need to
registered in the Registry of Deeds I shall submit the original title certificate of the
said land to MEL RICHIE G. FLORES or his authorized representative for the said
transaction and will return to me after; and

4. This affidavit is made to attest the veracity of the foregoing statements and for
whatever purpose it may serve.

DEED OF SALE OF A PORTION OF LAND

KNOW ALL MEN BY THESE PRESENTS:

MECCAH SHANDRA N. IGUIS, of legal age, single, Filipino with


residence and postal address at Andagao, Kalibo, Aklan, Philippines,
hereinafter referred to as the SELLER;

-and-

MEL RICHIE G. FLORES, of legal age, single, Filipino with


residence and postal address at Magdalena Village Extension, Kalibo,
Aklan, Philippines, hereinafter referred to as the BUYER.

WITNESSETH:

WHEREAS, the SELLER is the owner of that portion of a parcel of land by virtue
of hereto attached Deed of Absolute Sale of Portion of Land executed by the Heirs of
Macario Cabales on February 19, 2019, which bigger parcel of land is more particularly
described as follows:

“A parcel of land designated as Lot No. 966 pt. situated at


Brgy. Tigayon, Kalibo, Aklan and containing an area of
1,573 sq.m., more or less (actual area after survey is 2, 080
square meters) . Bounded on the North by Lot No. 966; on
the East by Lot No. 969; on the South by Lot No. 950; and
on the West by Lot No. 965. Said land is declared in the
name of Macario Cabales under ARP/TD No. 17-01-014-
01558 for the year 2018”

That, for and in consideration of the sum of SIX HUNDRED TWENTY FOUR
THOUSAND PESOS (P624,000.00), Philippine currency, to me paid in cash by MEL
RICHIE G. FLORES, of legal age, single/married, Filipino with residence and postal
address at Magdalena Village Extension, Kalibo, Aklan, Philippines, I do hereby CEDE,
SELL, TRANSFER and CONVEY, by way of ABSOLUTE SALE unto the said MEL
RICHIE G. FLORES, his heirs, successors and assigns the THREE HUNDRED
TWELVE (312) square meters portion of the above-described parcel of land
designated as Lot No. 966-E, as reflected in the hereto attached Sketch Plan prepared
by Geodetic Engr. Lucas L. Francisco;

That I hereby warrant my title over the THREE HUNDRED TWELVE (312)
square meters portion of parcel of land above-described with full rights to dispose of
the same, free from all liens and encumbrances, and that henceforth, full rights and
possession shall pertain to MEL RICHIE G. FLORES;

That the adjoining owners have been notified about this sale but have refused to
exercise their right as provided for by law.
