IN THE CIRCUIT COURT OF THE ELEVENTH JUDICIAL CIRCUIT IN AND FOR MIAMI-DADE COUNTY, FLORIDA STATE OF FLORIDA ) SS COUNTY OF MIAMI-DADE. ) FYADAVIT JN § PPPRT OF ARREST WARRANT Before mey4 Yas Z ap */G0223.Wudge of the Circuit Court of the Eleventh Judicial Circuit, in and for Miami-Dade County, Florida, personally appeared City of Miami Police Department (“MPD”) Detective Nestor Amores (Badge 01-40732), who being by me first duly sworn, deposes, and says that there is probable cause to arrest Adrian Oneal Grimes A/K/A “Peanut” and/or “Nut,” a black male with a date of birth of December 03, 1994; Florida Driver’s License No. of ; Social Security No. 3 CIN of an IDS No, 2426493; FL- SUD No. 07227936; FRI No. 750896DD7; (hereinafter “Subject Grimes”) for the December 2012 murder and robbery of Bryan Herrera. Specifically, your affiant has probable cause to charge Subject Grimes with one (1) count of First-Dergee Murder, a capital felony, in violation of Florida Statute § 782.04(1) and one (1) count of Armed Robbery with a Firearm, a first- degree felony punishable by life, in violation of Florida Statute § 812.13(2), contrary to the form of the statute, in such cases made and provided, and against the peace and dij AFFIANTS’ BACKGROUND INFORMATION Your affiant is Detective Nestor Amores #40732, of the City of Miami Police Department. ity of the State of Florida, Your affiant has been a police officer for over 13 yeare and is currently in the Homicide Linit where he has served for over eight years and is presently assigned to the Cold Case Squad. Your affiant has investigated murders, attempted murders, aggravated batteries, death investigations, police shootings, as well as other crimes against persons and property. Your affiant has received general and specialized training in criminal, gang, and fraud investigations. Your affiant has also trained several detectives in the Criminal Investigations Section. Your affiant is also a Task Foree Officer with the Department of Homeland Security Investigations Violent Crimes and Gangs Division. “Your affiaut was assigued as the lead investigator for the murder of Bryan Herrera, DOB: 09/28/1996, a 16-year-old male, hereinafter referred to as “The Vietim,” which was documented AFFIANT Mt ASA Vi JUD Ayu Page f of 5 Arrest Warrant Affidavit re: Grimes ~ 121222-368817 under City of Miami Police Department case number 121222-368817 in March of 2022, FACTS IN SUPPORT OF PROBABLE CAUSE This affidavit is being submitted for the limited purpose of establishing probable cause and, therefore, does not include every aspect, fact, or detail surrounding this investigation. The affidavit is based upon information known personally to your Affiant based upon investigation and information obtained from others who have investigated this matter and/or have personal knowledge of the facts herein, including fellow law enforcement agents with whom your Affiant has spoken. During the course of this investigation, your affiant has learned the following: I. _ INITIAL POLICE RESPONSE (On Saturday, December 22nd, 2012, at approximately 11:04 a.m., City of Miami Police responded to Northwest 1th Avenue & Northwest 39th Street regarding a male who was shot. Officer R, Effece #01659 arrived on the scene where he located an unconscious male with an apparent ‘gunshot wound to the head. Ofe. Efiece advised the dispatcher of the vietim’s status. City of Miami Fire-Rescue #26 arrived on the scene and rendered aid to the victim, ultimately transporting the victim to the Ryder Trauma Center, where the victim succumbed to his injuries and was pronounced deceased at 1:40 PM by Dr. Jorge Garcia. In addition to providing the victim with aid, the first responding MPD officers secured the crime scene for further investigation. I, INVESTIGATION The victim’s body was transported to Miami-Dade County Medical Examiner’s Department, An autopsy was performed by Dr. Charles Glenn, M.D. Dr. Charles determined that the cause of death was a gunshot wound to the head and the manner of death was homicide. Homicide detectives, along with MPD Crime Scene Technicians responded to the scene. The crime scene consisted of the sidewalk/swale area on the east-facing side of 1100 Northwest 39 Street, Miami, Florida, 33127. Investigators located various items belonging to the victim, including a bicycle, hat, Playstation Portable handheld video game, and backpack. Missing from the vietim’s property was his cellular telephone. The victim’s cellular telephone was a black Metro PCS-branded ‘Android phone originally purchased by his father. The vietim’s cellular telephone was not connected to a network, therefore historical cell-site location information could not be retrieved at the time to locate the device. However, the victim was known by his Family to always carry his cellular telephone which he would utilize as a portable video game player and to communicate with others when connected to Wi-Fi, Investigators did not locate a casing. arriant 4 ss M0 supGE\\y NO Pate of 5 Arrest Warrant Affidavi rimes ~ 121222-368817 Shortly afier the incident, MPD received several 911 calls from persons who heard the shooting and witnessed the victim suffering from injuries, but only one of the 911 callers witnessed the incident, That 911 caller used phone number 305-634-2371, which belonged to Emest Sidney, the ‘owner of a home less than 100 yards from the incident. Officer. R. Buigues #00716, the primary reporting afficer on the date of the incident, advised that Mr. Sidney allowed the unknown eyewitness to use his phone to call 911 and that the eyewitness left the scene before police arrival in a ted-colored sedan, MPD and the vietim’s family made several public pleas for information while simultaneously pursuing all possible leads throughout the years. MPD exhausted each and every lead and tip provided, yielding no results until June 24, 2024, when the 911 caller (Mr. W.W.,a black male with a date of birth of July 13, 1974) came forwar On June 24, 2024, the State Attorney's Office received an unsolicited call from an attorney for Mr. W.W. The attomey advised the State Attomey’s Office that his client had information on a murder that occurred three days before Christmas in 2012. Mr. W.W. and his knowledge of the case ‘was unknown to the State Attomey’s Office or MPD. After researching the homicides that occurred around the proffered time, the State Attomey’s Office referred the attomey for Mr. W.W. to your affiant, Based on the information, your affiant scheduled a meeting with Mr. W.W. and his attorney for July 11, 2024, to determine the veracity of the information. At the meeting, Mr. W.W. stated that he was driving to a relative’s residence when he tumed southbound onto Northwest 11 Avenue and 39" Street and noticed two people, a black male, and a hispanic male, in a struggle with each other: Mr, W.W. later identified the hispanic male as the victim, Bryan Herrera, by a single photo. Mr. W.W. further stated that as he drove by the struggle, he stopped his car, a Burgundy Nissan Maxima, looked over to the individuals in the struggle, and tried to stop the struggle by me, Mr. W.W. ‘mentioning the proximity to Christmas and asking, “Can't we just get along?” Atthi saw the vietim silently mouth the words, “I’m being robbed” while simultaneously seeing the black ‘male had a gun pointed at the victim. Because the black male robber was armed, Mr. W.W. decided not to intervene and allowed his car to idle forward southbound on 11" Avenue towards 38” Street ‘As Mr, W.W, was idling towards 38" Street, Mr, W.W. saw the victim attempt to get out of the black ‘male’s grasp when Mr. W.W. heard a gunshot. The black male then fled the scene on a bieyele north towards 39" Street and then west from 11" Avenue, Mr. W.W. drove to Mr. Sidney's home, where Mr. Sidney was working on his lawn, and asked to borrow Mr. Sidney's phone. Mr. W.W. confirmed he called 911 requesting help for the victim before leaving the scene. AFFIANT ash. supa Page 3 of 5 Arrest Warrant Affidavit re: Grimes ~ 121222-368817 Mr. W.W. advised he knew the black male who shot the victim from the neighborhood and for several years before the incident as “peanut” or “nut.” Mr. W.W. said he also knew the black male subject lost one of his eyes in an unrelated shooting after the incident, Mr. W.W. further advised that he knew the black male subject was, at that time, incarcerated at the Federal Detention Center in Miami, Florida, Mr. W.W. advised he knew this because when he was recently incarcerated at the Federal Detention Center for a pending case where he is charged with distribution of 500 grams or more of cocaine, he saw the subject at the same jatl. Your affiant was able to obtain information on a federal inmate who was mi Grimes, a black male witha date of birth of December 03, 1994 (hereinafter “Subject Grimes”). Based ig one eye in Miami, Florida — obtaining the identity of Adrian Oneal on Mr. W.W.'s personal knowledge of Subject Grimes from several years before the ineident and 12 years since the incident, your affiant showed Mr. W.W. a single photograph of Subject Grimes where he was missing one eye. Mr. W.W. positively identified Subject Grimes as the black male subject whom he saw shoot and kill the vietim. Your affiant later obtained a photograph of Subject Grimes from approximately six (6) months after the incident where he was not missing an eye and presented this photograph to Mr. W.W., who further confirmed Subject Grimes’ identity and visage at and around the time of the incident and before Subject Grimes lost his eye. Itshould be noted that at all times pertinent herein, including Mr. W.W.'s meeting with MPD, subsequent meeting with the State Attorney's Office, as well as at the time of the issuance of this warrant, Mr, W.W, has been advised that MPD and State Attorney's Office will not be offering Mr. W.W. any benefit in exchange for his cooperation and Mr. W.W. has acknowledged the same. Neither MPD nor the State Attorney's Office has been in contact with the United States Attorney's Office on behalf of Mr. W.W. nor does it intend to do so. I. CONCLUSION Based on the totality of the circumstances, the evidence shows Subject Grimes was attempting to rob the victim when Mr. W.W. drove by no a robbery ‘was being robbed by Subject Grimes, Corroborating the victim's statement, Mr. W.W. observed 1g the struggle. Not knowing it was progress, Mr. W.W, attempted to stop the struggle when the victim mouthed that he Subject Grimes pointing a firearm at the victim, causing Mr. W.W. to cease his intervention and begin to idle away. Mr. W.W. then saw the vi n allempt to escape Subject Grimes’s grasp and heard a gunshot. Mr, W.W. then saw Subject Grimes flee the scene following the shooting, black Metro PCS-branded Android cellular telephone with him. Accordingly, there is probable cause that Subject Grimes did unlawfully and feloniously kill Bryan Herrera, a human being, while engaged in the perpetration of or in an attempt to perpetrate a robbery, in violation of Florida Statute § 782.04(1), and succeeded in said robbery by taking Bryan Herrera’s property, to wit his black Metro PCS branded Android cellular telephone with force, violence, assault, or putting in fear and during the commission of the offense, Subject Grimes was armed with a firearm that he discharged causing death to Bryan Herrera, in violation of Florida Statute § 812.13(2) Probable cause, therefore, exists to charge Subject Grimes A/K/A “Peanut” and/or “Nut,” a black male with a date of birth of December 03, 1994; Florida Driver’s License No. of Social Security No. 5 CIN of an IDS No. 2426493; FL-SID No. 07227936; FBI No. 750596DD7; with one (1) count of First-Dergee Murder, a capital felony, in violation of Florida Statute § 782.04(1) and one (1) count of Armed Robbery with a Firearm, a first-degree felony punishable by life, in violation of Florida Statute § 812.13(2). contrary to the form of the statute, in such cases made and provided, and against the peace and dignity of the State of Florida.
